NY Judge Convicts Man Over Gunsmith Hobby & Says 2nd Amendment Doesn't Exist In Her Courtroom

    A Brooklyn man, Dexter Taylor, has been convicted in New York City for building his own firearms that he never shot.
    A delusional New York judge had the audacity to tell his attorney during the trial when he brought up the Second Amendment during his opening statement, "Do not bring the Second Amendment into this courtroom. It doesn’t exist here. So you can’t argue Second Amendment. This is New York."
    What's truly pathetic and disheartening is that actual criminals in New York treat the legal system like a revolving door.
    But when a 52-year-old Software engineer makes guns in his home from legal parts as a hobby, they try to throw him in jail for 10-18 years.
    What's crazy is that on the federal level, Making your own gun is Legal. People have been making their own guns for hundreds of years.
    The Gun Control Act of 1968 allows an unlicensed individual (a regular “civilian” that doesn’t hold a Federal Firearms License or FFL) to make a (non-NFA) firearm for personal use, but not for sale or distribution.
    It's not like he was selling the guns, for crying out loud, he never even shot them.
    What this judge said is the language of a tyrant, not a judge; saying things like that should have you tried for treason.
    But that is where we are in this country.
    A country where a judge and a state can unilaterally eliminate a constitutional right.
    Thankfully, we have a legal system where you can appeal your case to higher courts and overturn unconstitutional decisions, but doing this isn't cheap, which is why I included a link to Dexter Taylor 2A Legal Fund:

    Keep in mind, this isn't just about Dexter Taylor; this is about all of our rights under the Second Amendment because if this case can get to the Supreme Court, not only will it overturn Taylor's conviction, but it will set a new legal precedent, thus making it extremely hard for states like New York and Judges like Abena Darkeh to prosecute law-abiding citizens for exercising their constitutional rights.

      --------------------------------------------This so often happens when a chief of police is ( allegedly ) running an illegal private security business. These illegal businesses use our tax payer equipment, desks, lights, telephones, cop man power and in many cases double bill the city and bill the paying customer that needs the private security services. The cop then pays the button nose chief of police a bit something something.. This is called RACKETEERING. 3 OF the criteria for RACKETEERING is hierarchy, intimidation, and fraud. There is no time off for bad cops. To the public it looks like they are on paid vacation, but mostly the cops work this illegal private security business. The only one fooled here is YOU!!!!!! The Chief of police needs a bad cop to work an illegal private security business. It's a kind of brotherhood. " Hay bro we have something on each other", a mutual agreement. Also, most cops drink vodka to sleep at night. An alcoholic cop may have pulled you over and you would never know. Or could you? The big giveaway is the menacing, belligerent, confrontational, aggressive dangerous grainy VODKA VOICE. When you get pulled over , make as little contact with an alcoholic cop. Like any alcoholic, they are dangerous with a license to carry a gun and kill. They will testilie against you and get away with it. You are dealing with a gang with a badge.. Sometimes , with corrupt judges there are many conflicts of interest, but you will never know. Sink your teeth into this and pass it on....And please, learn some law because obviously, the cops follow protocol and not the Constitution.. Get Constitutional Law for dummies or any book. Cops don't have continuing education. Because of the rampant alcoholism, they should be breathalyzed after every incident and before they can start our tax payer police cars.. Many of these guys are void of empathy and murder people without a second thought. We the People need to enforce the Constitutional Law.

      Judges don't have qualified immunity. Judges have judicial immunity, which is a type of absolute immunity. The defendant has no recourse to sue the judge. He can appeal it to a higher court, but that is not guaranteed, not quick, and not inexpensive.

Unfortunately, in most states it is the state Supreme Court responsible for doing so, and many of them are themselves in contempt of the Constitution.

      Last I knew the issuance of CCW permits have been up to county sheriffs for a while. Unless that changed with one of the new gun laws NY seems to be passing with the turn of every session. So you might want want to bark up that tree some.

    As a defense attorney, my first response to that judge would be “Your Honor, are there any other amendments to our US Constitution, that I should be aware of, that you don’t recognize in this courtroom?
    After her response to that question, my final comment would be “well thank you your honor for immediately granting all the ammunition we needed for the basis of our appeal”

The judge could be removed from office, disbarred, and charged for whatever criminal violations she committed. The state, county, and whichever agencies were involved could then be sue for civil damages ($$$)

    Former gunsmith here (mostly cap and ball) with a friendly PSA. Gunsmithing is illegal without proper licenses and approval (Type 007 FFL manufacturing lic.) in America. The law saying you can make your own gun only applies to a single semi-automatic gun. Anything past a single homemade gun or any automatic weapons and you need a manufactoring license. Just because you can own something doesnt give you the right to make it. Especially if its a gun made after the turn of the 1900's. The judge was wrong for her comment on the 2nd ammendment, but that doesnt change the fact that if the guy made more than one or an automaic he is just in the wrong and broke the law.

      A judge that fails to uphold the Constitution has certainly violated their oath of office, and should be debarred immediately, but per the US Code itself, this does not rise to the level of treason.
