What if you have a defensive attorney that keeps saying that it’s not good to even bring your case up to the prosecutors in hopes that they won’t even get to it? Would it be wise to just send the prosecutor this stuff yourself?
In my experience, the prosecutor is not going to just forget about your case or misplace it. I understand not wanting to poke the bear, but I really don’t think it applies to this situation. I would not send this to the prosecutor yourself. As a potential defendant, you don’t want to make statements, and your attorney will probably also be upset if they find out that you have done so. However, I would insist (nicely) that your attorney sends it.
What can you can do a person do if they could not hear the plaintiff in in the EPO hearing? I could hear the judge fine, but I could not hear the plaintiff at all because it sounded like she was 50 feet away. Again, I could hear the judge perfectly. I was on Zoom in a different state. Also, how can handle this in the future? I do not have any idea of what the plaintiff said in the hearing. I also was only able to see the judge.
Can you cover the topic about continious violence against family charge? What proof DA need? Obviously it is multiple events, so when DA office are reviewing case what is the statute of limitations on they use? An example of an assault could happened July 2022 and the next assault June 2023, July report was made and then now June 2024 DA still reviewing. Can they still charge the felony? Or now it is misdemeanor because its been 2 years of the July 2022 assault? Im sorry that charge its a lil confusing . If you can cover that an different examples would be great.
Can you please make a video on the rights of the alleged victim (me) to have info on protective orders? The cops told me they’d only take this drunk veteran in to get help if he “did something physical” despite manyyyy phone calls by myself and neighbors that he clearly needed help. I’m his landlord and yes he did actually put his hands on my neck that day, but I definitely did my part to get the situation to that point because otherwise the cops refused to take him to get help at the VA . I signed the affidavit by the public defender saying what you said in this video - it was a bad night etc (yes we were “involved” the last couple months but he was still always on a lease and had his own space). The cops never told me there was a protective order and it’s been a month and he’s going to trial for a felony in about 1 week , but I am not allowed to contact him nor him me. He’s distant from his family on purpose and so am I from mine and I am in fact assigned a court ordered fiduciary because my family is not bad people , they just don’t align with what I feel is best for me, and I see it a mile away why he chose to separate from his family. Since the courts would not let me communicate with him, and I happened upon his sisters phone number I texted and the 1 sister and now she’s essentially making it even worse because she’s acting like I’m the enemy and I’m not sure she’s equipped to wisk him away (he is schizophrenic which I’m ok with). I’m female and 20 yrs older than him, no kids, and I’d never impose my will on him but I don’t know if anyone has let him know that 1. I didn’t terminate his lease so if the state would drop the protective order he could stay here for as long as he wants to 2. The cops told me they were going to get him help and I was never informed and even now nobody will give me a copy of this restraining order. He was considering a gender transition, myself am an artificial intelligence engineer so I spend my days working from home talking to synthetic humans that I cook up or my ai agent, so already neither of us has a particularly normal life. He talks to invisible people, I talk to synthetic people, I’m probably on the spectrum and he definitely needed help with alcoholism. I just wanted the VA to be able to help him, because when they dragged me in to get help it changed my life 100%, but charging him with a felony after repeated calls to 911 where they refused to get him help and kept pressuring me to evict him or to build a case against him and get him committed was too much . We are in Texas … I’m supposed to get to file pro se but the clerks have rejected every single one of my motions to modify the restraining order or to clarify it. I feel so defeated. I know you’re in cali but I do think this is a very different case and I know they are trampling my rights as the victim and his as someone with mental health, starting from the police dept’s failure to keep this from escalating by taking him to the designated city mental health professionals … maybe I’ll never see him again and that is what it is, this is kind of my last ditch effort
