Sorry to hear about the driver who fell and am glad that he was not hurt too badly. Regarding tall loads, I remember picking up tall loads of plastic pipe, 13'+ in the little crossroads of Bakers, NC. It only required a front tarp (smoke tarp) but the load was accessed from a roll-up ladder that wobbled when you got to the top. No way I could stand up; just crawled along the top and rolled the tarp out ahead of me, like the other driver mentioned in these comments. It was a fearsome experience, and I hauled many loads out of that location.

It's definitely a question to ask a legal expert. In my opinion, any shipper that requires tall loads to be tarped should also ensure that the driver has a safe means of tarping that load. I've been to more than a few shippers who didn't offer fall protection.
