That's been happening for decades. 20 years ago I bought a Beachbody workout set from Amazon and it was a cheap burned copy of the set. I got my money back pretty easily but Amazon wanted me to send them the product, which I couldn't legally do (could be construed as distribution of pirated copyrighted material). The real issue? The same seller was back online within 2 weeks, selling the same pirated version of the workout set. ☹ I love Amazon and rarely have any problems but let's face it, buying from 3rd party sellers is like buying from a flea market - some of the goods are going to be of dubious quality and origin. Forcing Amazon to do a better job of vetting their sellers isn't a bad thing.
My cousin brought a riding lawnmower form a guy of Facebook for $500.00 runs good used it about a year than the police showed up one day and asked about the lawnmower the guy that sold it to him stole it, they got my cousin E mail address and was able to get is ISP and track his address down, My cousin did not know it was stolen but the police took it, now my cousin is suing the guy that he brought it from

Amazon is responsible because they are essentially a store. They're selling the stuff, they're making a profit off of it even when a third seller sells it Amazon is a store. So if you go down to your local store and either buy a product in the store or they send it to you even if it comes from a third seller they're responsible for it. And what other store can you walk into and find damaged and counterfeit products and unsafe products on the shelf for which the store says we're not responsible for that. Yes they are and stores have staff to vet and verify that the products aren't junk or counterfeits.

I have gotten to the point where I will only buy something from from them that I absolutely cannot find anywhere else, because I'm so tired of either getting junk (e.g. tank tops full of holes - obviously counterfeited the brand name) or not the product that I ordered (they send a different cheaper product but still charge the higher price of the item ordered). That is called "bait & switch" and it is illegal and they've been doing it for a long time.

In Wisconsin it is illegal for a company to knowingly sell defective merchandise. If they unknowingly sell defective merchandise the company must take it back and either give a refund or replacement.
My family sold cosmetics via FBA on Amazon few years ago. The company literally destroys a seller who sells counterfeited products. I saw cases where few big sellers that sell more than 10 million dollars worth of products on Amazon got their account deactivated because one of the product they sold was claimed as counterfeited. The news says Amazon platform is getting punished for selling hazardous products but honestly this is wrong. The sellers are the one who should be knowing very well about the products.
The food they sell in the grocery store is counterfeit, too. The produce and seafood gets shipped from overseas. If it's a national or regional chain, they're selling products from all over the world. It won't be local unless it's independently owned usually.
I had a seller send me a postcard for an incentivized review. Give a 5 star rating and receive $30 in gift cards. The product was 5 star worthy. Gave a review & the gift card codes they sent were not legit. Removed my review & reposted same info I am posting now.
About time! My hubby had a row with Amazon a few years back over a faulty piece of computer equipment. Amazon refused to take responsibility, supplier said it was Amazon's fault...and hubby gave up. He eventually found the same part in a local shop at half the price! He never used Amazon again.
I purchased a Dell desktop PC from Amazon and went to register it with Dell and found it to be stolen from a Dell warehouse out of Virginia.. Amazon had no choice but to refund my money and Dell sent me a replacement pc at no cost for alerting them that they were being sold on Amazon. The seller was removed from Amazon and Dell reached out to me asking me if I had any issues with my computer.. I also found out that Dell DOES NOT SELL ANYTHING ON AMAZON MARKETPLACE, THOSE ARE LISTED AS THROUGH THIRD PARTIES.. IF you see anything that is being from DELL MARKETPLACE, its from a third party, and that equipment could be either refurbs, used, possible stolen or return resold (From a Dell rep I spoke to on the phone, and listed on Dell website )
Should. Your local corner store hire staff to order products and it's their responsibility to make sure that they're not counterfeits or garbage. Why has Amazon been exempt from this. They are a store. They sell products, and they make a profit off of it even if they do some of it through a third-party seller. To make it lawful, they need to apply it to all businesses selling products online, and it might even extend to things like auctions (eBay) and handmade crafted products (Etsy), forcing those platforms to implement stricter rules. I think it would be a great thing if it protected consumers. The good thing is since the U.S. is such a huge customer of foreign goods this is going to force those businesses to implement quality standards, which will benefit people in those countries with safer working conditions (I hope). :)
I’ve thrown out a few charging cables that I bought from Amazon that suddenly stopped charging my devices, and started turning very very hot . Now I make sure I unplug all chargers from my house before I leave for trips,even the pricey chargers I bought directly from Apple, just in case. The majority of third party sellers on Amazon are in China. I think I read somewhere it is over 70%. If you click on a third party seller's name, more likely than not their business address will be in China. Chinese sellers/manufacturers bulk ship their products from China to Amazon warehouses around the world and they use Amazon fulfilment (FBA) to process and ship any orders. Because these sellers are in China it's difficult to hold them responsible for any product safety issues etc. If you close their Amazon seller account they will open a new account under a different name and address. Hence it's right that Amazon is held more accountable for the safety of the products sold on its platform. Some of the safely certificates issued, claims made etc by some Chinese sellers/manufacturers are questionable and should be scrutinized more by Amazon.
Many of the China products are Amazon's own knockoff brands. They use bizarre names that appear to be jumbles of letters to avoid any trademark conflicts and expedite company registration. Amazon front-loads these schlock fly-by-night brands in your results when you search for anything on their platform anymore. To get shown any reliable and well-known brands, you have to apply multiple filters. The China "brands" also engage in fraudulent practices like "brushing," farming reviews, holding service hostage for positive reviews, and sending used/returned and even soiled merch to customers who've purchased _new_ items. Amazon has jumped the shark.
Depends on the regulations. I don't see how they should be responsible for the items of another manufacturer (they should be responsible for making sure the manufacturer isn't scamming people). If regulations were always good you would still be able to buy small trucks in the US. Want to know why you can't? EPA wants regulations that essentially want trucks bigger for "efficiency" and it's now why we can't buy a New Toyota Helix that would be great for the majority of people that want a small truck that don't need a trailer. You probably hate that there is always big trucks on the road yet it's because of a regulation the government agency (luckily Chevron Deference got ruled on so they can't make up laws) did that prevents this. We don't need "more regulation" we need "logical regulation".
TEMU is fairly new and have been advertising so much. They know what's coming, so they make their own site and are trying to get consumers to move over to that site before Amazon puts it's "foot down". Can't do anything about TEMU except not use the site.

When buying an appliance and an option for an extended warranty pops up, it is a scam. Asurion warranties especially. You get virtually nothing, and Amazon cannot assist you in getting a refund when you select the option. Beware of their extended warranties.
They already do pay taxes, they offset everything so that they make up for it. I hate corporations but I'm not naive in the "they don't pay taxes" when they absolutely do but with some of the loopholes they can offset alot more than what the working man can afford.
With the other comment in mind, I looked over the earnings report from this last quarter and their income tax. Came out to a tax rate of 23%, or $2.467 billion, so something like $10 billion a year in taxes.
This is good! I had a replacement computer battery explode in my computer while in my lap. Sent the battery to HP for diagnostics and it was found to be a counterfeit. I asked for Anazon to replace my damaged computer and they told me the seller was responsible, not them. The seller did not respind to me at all. Amazon never replaced my computer. 😡
You probably should've gotten the battery directly from the computer manufacturer. If you had a warranty, putting in an off market battery would more than likely void the warranty, as well... sometimes, it's just better to deal with the dealer or manufacturer.

Saw a video of a guy buying fuses on Amazon and they turned out to be just wires. So the fuse would never pop. Online stores should be aware of everything on their shelves just like brick and mortar stores.

I agree with the CPSC decision. If anyone walks into a brick-and-mortar store and purchases a defective or dangerous product, they are liable for it. Amazon, of which I am a customer, wants the best of both worlds; the ability to sell any product without liability for 60% of their sales since they aren't responsible for what is sold in their store. How about every large box that arrives seems to have someone that 'loosened or ripped' the tape in order to peek inside and see if the product is worth stealing to them? 40% of my boxes look to be tampered with. And it's not just the handling or shipping that led to ripped tape or boxes,many of these are strategically ripped in order to peek in..Anyone else have these problems?
This sounds good, but it may also hurt other small sellers. Now there is just a general stigma against buying any product that isn’t listed as “From Amazon”
I have found other retailers, like Home Depot, Lowes, Staples, etc. a much more convenient place to go for quality things. For HD, the return policy, even by mail, was fast and I had a full refund within a few days.

If a carbon monoxide detector is faulty and puts your family's life in danger, does your money back really cover it, either? Its important that they ARE held accountable: I bought a beautiful copper cooking pot, but found out it was unlined - which causes copper-poisoning. I told them our country didnt use to allow things like that to get through. The Rep agreed & refunded it. But so much of whats available is also unlined, I had to give-up my search in frustration.
Such a finding should have been done years ago. It is ridiculous that Amazon has gotten away with selling fraudulent and unsafe products for so long. Any fines that come from violations need to be a significant percent of their revenue as to be disruptive and a genuine deterrent, not just the price of doing business.

Never had a problem with products from Amazon. And if something arrives defective/doesn’t work, you can just return it for full refund. Don’t see what the big deal is or how this changes anything. You’ve always been able to return stuff, even after it’s opened.

Key words in the title "can be held responsible." Which means not quite yet approved. Why not? Consumers should be protected when they give their money to purchase a product on any platform or store. From tools, toys, house steamers, irons, clothing and glassware, to name a few, one should not have to worry about lead in the toys; the equipment breaking after a few weeks, steamers burning you, hover boards burning your house down, glassware with lead, etc., Too many companies are just getting away with to much and the consumer is left damaged. Same as these companies who are leaking people's data without any repercussions. These companies are destroying people's lives when their data is leaked due to poor security. Those who purchase hazardous items on Amazon - Amazon should immediately refund the buyer - buyers should not have to go through the seller to collect their money back when there is a recall. The consumer should be protected at all times. All companies must be held liable and accountable.

Even sold by Amazon can be 3rd party. It doesn't matter who you order from as they are all stored in the same bin. When an item is ordered regardless of which seller it is just going to be a random product out of the shared bin.

Amazon is no different than most “department” style businesses. You can order from Walmart online and chances are it is a third party vendor filling the order. If there is a problem or you need to return, Walmart will likely try to tell you it’s not their problem even though they are the sales agent. You have to fight for your consumer rights.

I have gotten to the point where I will only buy something from from them that I absolutely cannot find anywhere else, because I'm so tired of either getting junk (e.g. tank tops full of holes - obviously counterfeited the brand name) or not the product that I ordered (they send a different cheaper product but still charge the higher price of the item ordered). That is called "bait & switch" and it is illegal and they've been doing it for a long time.

My family sold cosmetics via FBA on Amazon few years ago. The company literally destroys a seller who sells counterfeited products. I saw cases where few big sellers that sell more than 10 million dollars worth of products on Amazon got their account deactivated because one of the product they sold was claimed as counterfeited. The news says Amazon platform is getting punished for selling hazardous products but honestly this is wrong. The sellers are the one who should be knowing very well about the products.

About time! My hubby had a row with Amazon a few years back over a faulty piece of computer equipment. Amazon refused to take responsibility, supplier said it was Amazon's fault...and hubby gave up. He eventually found the same part in a local shop at half the price! He never used Amazon again.
I purchased a Dell desktop PC from Amazon and went to register it with Dell and found it to be stolen from a Dell warehouse out of Virginia.. Amazon had no choice but to refund my money and Dell sent me a replacement pc at no cost for alerting them that they were being sold on Amazon. The seller was removed from Amazon and Dell reached out to me asking me if I had any issues with my computer.. I also found out that Dell DOES NOT SELL ANYTHING ON AMAZON MARKETPLACE, THOSE ARE LISTED AS THROUGH THIRD PARTIES.. IF you see anything that is being from DELL MARKETPLACE, its from a third party, and that equipment could be either refurbs, used, possible stolen or return resold (From a Dell rep I spoke to on the phone, and listed on Dell website )

Should. Your local corner store hire staff to order products and it's their responsibility to make sure that they're not counterfeits or garbage. Why has Amazon been exempt from this. They are a store. They sell products, and they make a profit off of it even if they do some of it through a third-party seller. Amazon is the store and they need to hire to staff to make sure that their products are safe not garbage and not counterfeits.

To make it lawful, they need to apply it to all businesses selling products online, and it might even extend to things like auctions (eBay) and handmade crafted products (Etsy), forcing those platforms to implement stricter rules. I think it would be a great thing if it protected consumers. The good thing is since the U.S. is such a huge customer of foreign goods this is going to force those businesses to implement quality standards, which will benefit people in those countries with safer working conditions (I hope). :)

I’ve thrown out a few charging cables that I bought from Amazon that suddenly stopped charging my devices, and started turning very very hot . Now I make sure I unplug all chargers from my house before I leave for trips,even the pricey chargers I bought directly from Apple, just in case. The majority of third party sellers on Amazon are in China. I think I read somewhere it is over 70%. If you click on a third party seller's name, more likely than not their business address will be in China. Chinese sellers/manufacturers bulk ship their products from China to Amazon warehouses around the world and they use Amazon fulfilment (FBA) to process and ship any orders. Because these sellers are in China it's difficult to hold them responsible for any product safety issues etc. If you close their Amazon seller account they will open a new account under a different name and address. Hence it's right that Amazon is held more accountable for the safety of the products sold on its platform. Some of the safely certificates issued, claims made etc by some Chinese sellers/manufacturers are questionable and should be scrutinized more by Amazon.

Depends on the regulations. I don't see how they should be responsible for the items of another manufacturer (they should be responsible for making sure the manufacturer isn't scamming people). If regulations were always good you would still be able to buy small trucks in the US. Want to know why you can't? EPA wants regulations that essentially want trucks bigger for "efficiency" and it's now why we can't buy a New Toyota Helix that would be great for the majority of people that want a small truck that don't need a trailer. You probably hate that there is always big trucks on the road yet it's because of a regulation the government agency (luckily Chevron Deference got ruled on so they can't make up laws) did that prevents this.

TEMU is fairly new and have been advertising so much. They know what's coming, so they make their own site and are trying to get consumers to move over to that site before Amazon puts it's "foot down". Can't do anything about TEMU except not use the site.

When buying an appliance and an option for an extended warranty pops up, it is a scam. Asurion warranties especially. You get virtually nothing, and Amazon cannot assist you in getting a refund when you select the option. Beware of their extended warranties.

With the other comment in mind, I looked over the earnings report from this last quarter and their income tax. Came out to a tax rate of 23%, or $2.467 billion, so something like $10 billion a year in taxes.
This is good! I had a replacement computer battery explode in my computer while in my lap. Sent the battery to HP for diagnostics and it was found to be a counterfeit. I asked for Anazon to replace my damaged computer and they told me the seller was responsible, not them. The seller did not respind to me at all. Amazon never replaced my computer. 😡
You probably should've gotten the battery directly from the computer manufacturer. If you had a warranty, putting in an off market battery would more than likely void the warranty, as well... sometimes, it's just better to deal with the dealer or manufacturer.

Saw a video of a guy buying fuses on Amazon and they turned out to be just wires. So the fuse would never pop. Online stores should be aware of everything on their shelves just like brick and mortar stores.

There is a reason the price is the cheapest you found for a item.
But don't you expect your local store to have staff whose responsibility it is to make sure that they're getting quality products that are not junk not unsafe and not knock offs? Amazon is a store, plain and simple. They're making a profit off of the item sold even when they send it in from a third-party seller, Amazon is the store.
I agree with the CPSC decision. If anyone walks into a brick-and-mortar store and purchases a defective or dangerous product, they are liable for it. Amazon, of which I am a customer, wants the best of both worlds; the ability to sell any product without liability for 60% of their sales since they aren't responsible for what is sold in their store.
Generally, the items I purchase are okay but there have been a few marketplace items that were crap and Amazon made me jump through so many hoops to resolve.

Amazon third party sellers have to have receipts proof of purchase for all their inventory, it’s not stolen.
How about every large box that arrives seems to have someone that 'loosened or ripped' the tape in order to peek inside and see if the product is worth stealing to them? 40% of my boxes look to be tampered with. And it's not just the handling or shipping that led to ripped tape or boxes,many of these are strategically ripped in order to peek in..Anyone else have these problems?

I have found other retailers, like Home Depot, Lowes, Staples, etc. a much more convenient place to go for quality things. For HD, the return policy, even by mail, was fast and I had a full refund within a few days.

There's a difference between distributing legit products (which Amazon does) and allowing sellers from all over to sell just anything on their platform. (Which Amazon also does.) I'm glad YOU'VE had a good time getting refunds, many other people have not when the item is sold by a third party seller. Amazon will tell you to take it up with them. If a carbon monoxide detector is faulty and puts your family's life in danger, does your money back really cover it, either? Why change it is b/c Amazon is getting worse and worse in how it treats its customers and more and more Chinese sellers of knockoffs and faulty items are taking advantage of Amazon's system. Amazon is making money allowing them to sell bad items on their site and then when complaints roll in they say "not our fault, we're just hosting the sale." I kept getting dirty used products marked as brand new. Even sold by amazon products can be broken because apparently the warehouses are not regulated well.

I bought a beautiful copper cooking pot, but found out it was unlined - which causes copper-poisoning. I told them our country didnt use to allow things like that to get through.
The Rep agreed & refunded it. But so much of whats available is also unlined, I had to give-up my search in frustration.
Such a finding should have been done years ago. It is ridiculous that Amazon has gotten away with selling fraudulent and unsafe products for so long. Any fines that come from violations need to be a significant percent of their revenue as to be disruptive and a genuine deterrent, not just the price of doing business.

Key words in the title "can be held responsible." Which means not quite yet approved. Why not? Consumers should be protected when they give their money to purchase a product on any platform or store. From tools, toys, house steamers, irons, clothing and glassware, to name a few, one should not have to worry about lead in the toys; the equipment breaking after a few weeks, steamers burning you, hover boards burning your house down, glassware with lead, etc., Too many companies are just getting away with to much and the consumer is left damaged. Same as these companies who are leaking people's data without any repercussions. These companies are destroying people's lives when their data is leaked due to poor security. Those who purchase hazardous items on Amazon - Amazon should immediately refund the buyer - buyers should not have to go through the seller to collect their money back when there is a recall. The consumer should be protected at all times. All companies must be held liable and accountable.

Amazon is no different than most “department” style businesses. You can order from Walmart online and chances are it is a third party vendor filling the order. If there is a problem or you need to return, Walmart will likely try to tell you it’s not their problem even though they are the sales agent. You have to fight for your consumer rights.
