Forward to the Past at Fort Hare. Forensic investigator Sarah Burger explains

  • Sixteen individuals stand accused of racketeering to defraud Fort Hare University of R171 million. Forensic investigator Sarah Burger reflects on her experience, now as a co-accused, to try and fathom what is going on.
    A meta-analysis of the content of this conversation suggest three normative ethical questions.
    Firstly, is the criminal justice system being deliberately abused by certain police officers and prosecution officials to sabotage the success of the case by deliberate unconstitutional methods of arrest of many of the accused and deliberate prosecutorial overreach in charging them all with racketeering? Is this an elaborate strategy to sabotage the case so that the alleged kingpin, Isaac Plaatjies, is then acquitted too?
    Secondly, has the Premier of Eastern Cape Oscar Mabuyane hoisted himself on his own petard by trying to challenge the SIU mandate to investigate whether he is implicated in academic fraud at UFH regarding his Masters and PhD Thesis proposal? Why did he not simply show evidence of the legitimacy of his qualifications instead of trying to evade the SIU’s investigation? Why wasn’t he and others accused of academic fraud also charged and arrested?
    Thirdly, will the handling of this case contribute to the effective cleansing of corruption from FHU to restore the legitimacy of an institution that cherishes academic freedom in the pursuit of truth?
    Woven together as strands of a metaphorical rope, will the State now find itself trussed up in knots, and its efforts to prosecute those who have corrupted the university defeated yet again?
    Forensic investigator Sarah Burger explains the Hollywood style arrest of Bradley Conradie and herself on the day before the start of the Easter long weekend on 28th March 2024, which saw them flown in a charted Lear Jet from Cape Town to East London and locked up way beyond the constitutionally permissible time of 48 hours before appearing in court for a bail hearing. The Prosecution then misled the accused and their legal teams into believing that the NDPP had authorised the charge of racketeering, as required by law. Six months later, in September 2024 on their second appearance, the Public Prosecutor admitted that an application had only just been prepared as the docket had only been finalised then. It took seven months for the docket to be made available to the accused. Sarah Burger believes the State will be severely embarrassed once the matter comes to trial, as there is no incriminating evidence against her.
    Coincidentally the interview took place soon after Nobel Peace Prize Laureate Professor Maria Ressa had spoken at Wits University, and excerpts of her talk are included to spice up the discussion.
    To contrast Oscar Mabuyane’s alleged shortcuts to overstate his academic record, this video also includes a brief insert of Mr Saci Macozoma telling of his own experience of getting an education, as a political prisoner on Robben Island from 1977 to 1982.
