  • Ohio dental malpractice accident attorney, Scott Kuboff, talks about a common question on medical and dental malpractice claims: do I have a case? I can't answer without a review of records and the opinion of an expert. But, here is a little insight into my thought process.

    All dentists need to be recorded. Incompetence is not an excuse.

    I'm in New Mexico. The other day, I went to go see a new dentist to see about repairing a cavity and two upper teeth. He said that 2 come back in 2 weeks to get my cavity repaired. I went back 2 weeks later, but the front desk lost my medical history packet that I had JUST filled out the first day I came 2 weeks ago. Then I went back to see a different doctor than the one who examined me for my first time there. He started applying the Lidocaine or Novocaine anesthetic, for my cavity. But instead of waiting for a few minutes for the anesthetic to take affect, HE JUST STARTS DRILLING RIGHT THEN AND THERE! Since it was a deep cavity, it went to the nerve. But since he told me that he couldn't get the nerve to properly numb up, and I couldn't properly relax, since this was a new dentist to me and he didn't wait for the Novocaine to properly take effect, he just gave me a temporary filling and told me that that tooth, along with the other two on my upper row, needed to be extracted. Then he referred me to a different dentist location in a different town because I was told by a nurse that helped with my filling that if I tried to get extractions in my current town, it would be out of pocket, but somehow my insurance covers the extractions in a different town for some reason. And just 5-6 weeks later, my temporary filling JUST POPPED OUT. Now my nerve's been exposed, I'm in enough pain to make me cry if I accidentally hit my nerve the wrong way because my pain tolerance is so low, and it's a few weeks before I can get the dentist that I was referred to for extractions to examine me and see what should be done. Does that mean I might have nerve damage? I'm genuinely unsure about the amount of damage. And I'm worried about it potentially developing into an abscessed tooth, which could be life threatening. Because my old dentist in my hometown was MUCH more professional and understanding, at least to not lose my medical history paperwork after the first visit. Does this count as a case of Dental Malpractice?

    Hi, i had a tooth extraction on 1-22-2024. Its been a nightmare ever since. My root was in my sinus cavity. Dentist never did an x-ray to see the anatomy of my roots and sinus. I could feel immense pressure on my sinus as he was rocking it back and forth to loosen it up. I had to stop and yell , "My sinus, my sinus!" Dentist stopped and looked frozen for a minute. He was then a bit more gentle with the extraction. He put stitches in and they dissolved within a couple days. Long story short, he never explained to me what happened, only said to not suck thru a straw because it would come out my nose. I went back in the following day because the massive air flow and pain was debilitating. Thats when he said i had a sinus perforation. He shrugged off and said it would close and heal within a couple weeks. That never happened. I went to a second dentist who said it was the largest perforation hed ever seen...and there were two of them, not one. There is also a piece of root left in there i was never informed about. Im still dealing with this open hole in my mouth to my sinus and its almost 3 1/2 months later. Im at a loss of what to do. Its been physically and emotionally taxing.

    A doctor just refunded me the full amount for a crown that wasn’t the tooth giving me the pressure sensitivity sensations. Without explaining why I was being refunded. They did this after realizing the extreme sensations were on the tooth NEXT to the tooth he filed down and put the crown on. So I think I’m in the beginning stages of them trying to hide their mistake.

    A bit of my top back tooth came off so I went to the dentist. I struggle with mental illness and I let my dentist know that and it was on my forms so that I could explain that it heavily affects my dental hygiene. She then told me I needed 4 fillings, and I went and got them done. I had pain after the filling in one specific tooth, and when I saw my dentist again about this she said it was due to not using interdental brushes. Pain just kept getting worse, so I saw a different dentist in the same practice who told me the filling was done wrong but I could not make another appointment since they wanted to charge me to fix something that should have been done right the first time. After a few months of constant pain that progressively got worse, I went again since I am entitled to free dental care now, and now I am being told I need root canal treatment and that my filling was fine but it was just a deep filling. Three different dentists in the same practice have told me three different things about the same tooth. I was never informed I was being given a deep filling, never consented to one and I was never told the risks that come with one. This problem tooth also made my jaw swell immensely which is very embarrassing to go out with, and when I asked the dentist if the infection at the root of my tooth could spread, he said no, which I am aware is incorrect and it can even spread to my bloodstream in rare cases. They prescribed me high fluoride toothpaste at the time that I believe made any calculus I had near that same problem tooth increase dramatically to all teeth surrounding it. Also, under NHS policy, all fillings done have to stay in for a year, and mine fell out just a few months after getting it done. This not only put me in constant pain for months, but also affected my mental health immensely, as well as trying to gain work experience since I am a student. I cannot go to a different practice since they don't take NHS patients, and all the dentists I have seen at this practice have been purposefully withholding information from me. Time to take legal action :(

    I’m in Florida but I wanted your opinion on this: went to a new dentist because I was having excruciating lower jaw pain. I wasn’t sure which tooth it was coming from. I had all new X-rays done and I was told I had a crack in my tooth and I needed a crown. The process was started (I had the temp crown put on). It was a painful process- they even had to ‘shave’ one of my top teeth down so the temp crown could fit. 2 weeks later- still excruciating pain and now TMJ. I can’t open my mouth without horrible jaw socket pain. So I went back to the same dentist and they said “oh you’re pain is probably coming from your unerupted molar”.

    • @foodiegal9923
      @foodiegal9923 2 ปีที่แล้ว

      So then they referred me to an oral surgeon. The problem is- that means she was mistaken that I even needed a crown. The original pain was not even from the tooth that is having the crown put on. So that means I started this work, had my healthy tooth damaged for an unnecessary crown. I’m going to my another dentist for a second opinion. But do I have a case since the wrong tooth was worked on?

      An expert would have to review your records/radiographs. However, since this is a Florida claim you should reach out to a Florida lawyer (I'm from Ohio) to discuss more fully.

    My front tooth had a chip and the dentist drilled off a huge amount of the side an filled it in. That was about 4 years ago. As time went by the filling had gotten weaker and weaker so that now it’s super thin and feels like it can break at any moment. (None of my other fillings by other dentists have decayed like this)
    My dentist mislead me a year ago by stating that he can’t redo the filling and I need a root canal for the front tooth…. So I agreed….
    WHEN HE DID THE ROOT CANAL, HE DID IT ON THE WRONG TOOTH RIGHT NEXT TO IT. He said my fillings were leaking on that tooth. I had 100% not approved it. I was in utter shock to see that he had done the wrong tooth.
    A previous time I had work done, he drilled off a large amount of a completely different tooth and just left it like that… about a month later I was in utter agony and had no choice but to have the tooth pulled.
    I have had some bad teeth since I was a kid, but I feel like the root canal on the front tooth was just an insurance scam.
    Now I am completely embarrassed to smile because of my front tooth looks super decayed next to a shiny fake tooth(highly noticeable), it’s really taken a toll on my confidence. It is super uncomfortable and all day it bothers me. I am still in need of my front tooth being repaired… I really don’t want to go back to this dentist.
    Would you recommend that I would have a case against my dentist? What steps can I take if this qualifies… I really feel cheated.
    Sorry for the long post

    I need help i went to a local dentist to have implants put in. I had went to several other dentist first and had the basic idea of what was going to happen i knee what i wanted so when i found somebody local i was excited to get this done. He charged me 22k for the process. The first day he pulled all my teeth i didnt have a lot but charged me to pull more than i had. His handling of my mouth wad very poor. After he had my teeth out he put in these temporary teeth when he did he was jambing these things in my mouth and it hurt so bad. I didnt take anything for the pain i dont take pills at all so i took the pain but when he put that temporary set in i really felt it. The temporary teeth was so hard to get in cause he had them made wrong the teeth pointed to the left they were not set right from the start the center line pointed left big time and it was very noticeable. I asked him how long did i have to ware them crooked teeth over and over i finally got mad cause it embarrassing to smile and my teeth be crooked he was upset about it but went ahead and made me what i thought was temporary teeth later i find out that these where my permanent teeth that didnt make sence cause i was paying for implants not dentures he told me that he has always done teeth like this i need to back up a little when he was putting in the studs i cant tell what he was doing i was told by every dentist i went to that there should be a minimum of 3 studs on top and bottom all of these dentist said they always put 4 on top and 4 on bottom. I couldnt tell the day he did all of this what he was actually doing i was focusing on not letting the pain get to me. He only put 2 on top and 2 studs on bottom
    To make a long story short and leave out alot if details he has not given me implants im still without teeth and he has his money i have had one stud fall out because it was crooked and the other stud on the bottom broke into to pieces because i can not ware my bottom teeth with the top dentures in the top i still have to glue in everyday sometimes 2 and 3 times a day they dont fit right and are constantly fallibg out it very embarrassing to say tge least the last time i saw this dr was 4 months ago and he gives me a card telling me what to say to this other dentist and that he couldht do anything else for me
    I paid this man alot of money that took me a very long time to save up i wont ever get that money back i have to many other obligations i had one chance to get this done abd this guy robbed me of that. What can i do

I told him I had Tourette’s and even took multiple trips to the ER after my surgery. I’m going to have to have either braces or more surgery to correct my bite. I recently had filling done for cavities with zero anesthetics and my doctor would with gloves take his phone out of his pocket use it put it down or be on the phone while doing the procedure and touch my mouth. After he was done I instantly noticed I had a huge gap and could not close my teeth, I asked one of the nurses if that was normal and she said yeah it’ll grind down over time. I went through a week of or two of extreme migraines until I was finally convinced to go back and then they ground my teeth down too far and now my front teeth touch which was never the case and now I have extreme sensitivity on one tooth with cold substances. And where I have scar tissue from a previous wisdom tooth procedure now is extremely painful because of the pressure because my teeth close too far down which shoots a migraine into my right temple if I don’t remember to keep my jaw slightly open. Do I have a case?

Two weeks before the surgery, the office staff calls me and states that they will will need a 50% down payment and 50% on the day of surgery. Am I missing something? I had a wisdom tooth removed back in 2020 and have been suffering from facial pain ever since, I've complained to my dentist who extracted the wisdom tooth so he tooth a x ray and said there was nothing wrong. I ended up coming back again and got referred to a oral specialist witch witch us all time consuming.. the specialist could see how horrible I looked at the time and basically said he doesn't have the technology and it sounds like I might have tmj and recommend doing jaw exercises, as time went on the pain got worse and so I eventually saw a surgeon again and got a mri scan and it came back saying nothing is wrong.. so i started getting physiotherapy on my jaw for awhile witch is all money and time consuming, time went on and pain has become worse even more and I can feel a lump so I have been going to different dentists to see what they think the problem is and they all say they can't see anything in the scans its out of their league go see a doctor, the doctor said I could have muscle damage and starts feeding me pain killers.. I just don't get why he would say that when the scans ain't showing anything "apparently"... there is clearly a lump growing.. been the worst 3 years of my life and I'm totally thinking about talking to a lawyer about where I stand with this issue because i totally feel like ive been over looked.. something isnt adding up... why can't they diagnose the issue? Is our technology that bad or are they trying to kill me? It's gotta be a cyst its just gotta be... I'm worried that is spreading or turned cancerous. There's bits and pieces I've left out but I've got alot of paper work to prove all this.

      Nerve damage is a risk/complication of most dental procedures. To know whether there is a claim to be made, you would need to know the nature/extent of the damage. This requires a more formal neurological workup. Follow-up with your provider and request a referral to a neurologist. Since this sounds like a New York claim, you'll need to discuss it with an attorney in your state relative to the merits of a claim.

      @Scott Kuboff thanks. I think leftover cement falls within normal realm of complications that can happen with crown/bridge work. And can be easily removed later on. A very minor complication and I would not consider that "malpractice". It's not like a broken jaw from an extraction. Or dropping an endo file down patient's throat by not using rubber dam.

I have great oral health I go to ALL my visits and I’m very very proactive with my oral health and when I seemed help from my dentist they ignored me and didn’t care I sent text I sent emails and no reply till I left a review on my experience they called me 3 minutes later to apologize. I just want my dentist to cover these expenses I have never had jaw issues I have even had my wisdom teeth taken out I have had MANY cavities and fillings done and never a single issue. Till I went in for my crown and the doctor had to give me 4 injections with the last one being directly into the nerve because he wasn’t able to numb me enough for the crown. Now I’m stuck with a permanent crown because I can’t even get my jaw to open or close properly for them to put the permanent crown. I just really need reimbursement for the TMJ specialist and treatment that wasn’t caused by me or some underlying unknown health condition. My dentist did this to me and I have a family to support I don’t just have $750 laying around just for fun

He brushed it off with a "it could get in the way and crack your crown so if it doesnt fit we have to shave it down" and he moved off it and finished the bottom crown preparation. I went home and smiled in the mirror and it would have definitely cleared. Both sides on my tops are identical so i can tell how they seat together, it was the sharp part on the out side and it wouldve definitely cleared. He was rushing, it was a good tooth, he didnt even ask me and just did it. Im quite upset because i have a plan for my teeth and how i want them to look in the future. I have a wide smile and to me its noticable. Has anyone else had this happen and taken any legal action?

      I'm sorry to hear about your experience. I would address your concerns with the dentist and see if he offers any solution that is acceptable to you. Otherwise, get a second opinion concerning the treatment needed to correct and consult with a lawyer in your state to determine if it rises to the level to justify pursuing a lawsuit.

    Can I sue my front teeth had cavities my dentist said the best bet is to put a crown on both and it should be good after looking at my X-rays then he shaved both my teeth down put a temp crown until my permanent ones came then I went back 3 weeks later on the appointment date and they tryd to take the crowns off but it hurt BAD EVEN WHEN THEY TOOK THEM OFF SO THEY DID ANOTHER X RAY AND SAID IT NEED A ROOT CANAL I SPEND ALMOST $2,000 on the crown now they telling me nevermind now you need a root canal so come back in 3 weeks and now I got to pay for a root canal

      It is not the type of case I would take on if it arose in Ohio. Its not uncommon for people to require root canals following that type of work; particularly if the cavity was closer to the pulp.

    Can the lawyers actually help in cases like these? My significant other has talked to a few lawyers to get support and most of all don’t have the courage to take on our case. My partner’s lower jaw surgery seemed to go well at first and then a few months later we noticed the bite was crooked and she couldn’t chew properly. A year and a half later, the bite is still crooked and both the surgeon and orthodontist are brushing it off as normal when in fact it’s not. How would you feel if you spend thousands of dollars to fix your underbite to end up with a crooked bite in the end. We can’t even enjoy a nice steak dinner together anymore, it’s hurting our relationship and her overall nutrition and health. I’m very concerned that it’s so hard to find good doctors and lawyers in Ohio. I recommend people to go to LA or New York for much better practice honestly.

    • @scottkuboff
      @scottkuboff  ปีที่แล้ว

      It depends on the case - how likely it is that a breach of care can be established and are the recoverable damages sufficient to justify pursuing it. In Ohio, the Revised Code and Rules of Civil Procedure require an “Affidavit of Merit” to accompany any complaint in order to show a good faith basis for the allegations. This requires plaintiffs to hire an expert to review all relevant records to provide an initial opinion and then the complaint to ensure the allegations are consistent with their review. The expert is then consulted regularly throughout the discovery process and then they must write a formal report of what they will testify to at trial. Without an expert, there is no case. Given the requirement to use experts, the likely recoverable damages must far exceed the costs of the experts, otherwise, a client is not going to be in a position to receive compensation for the injuries, harms, and losses. Time is also a consideration. In Ohio, you only have 1 year to bring a claim. If you want, you are welcome to submit an intake iboldobrien.cliogrow.com/intake/90cfe16f9db18cd129067d0b78b50083 and perhaps we can discuss it offline.

    She made me sign AFTER the fact, and their receptionist was texting me with her phone.. like.. not an automated service. So I asked for the name- she wouldn’t give it to me. The “dentist d. Aida” put a hole in my crown, a hole in the surface of a bottom tooth, and killed my other front tooth by drilling too far into the base/back of it. When she did finally get the polisher into her hand, she fumbled for some time and it spun, they all jumped.
    I came in about a filling that popped out. After 30xrays (many failed) she said she needed more contrast and ignore it-!!! Set me up for two more “deep cleanings” that would cost me $100 each out of pocket despite being as poor as they come.

    • @alwaysyouramanda
      @alwaysyouramanda 2 ปีที่แล้ว

      I tried talking to the receptionist via text about it and she said “those are run on sentences” explained the polisher, and I left her with “YOUR GIRL HARDLY TOUCHED THAT THING TO ME” as it was the drill. I could see it.

    • @alwaysyouramanda

      The owner eventually reached out and offered to see me for free. Lol excuse me-?? That basically was free and I’d expect that he’d just want to murder me.. because his girlfriend royally fcked up. It was his name on the cards as I was leaving that was the final red flag telling me “you better not go back.” And I didn’t see another dentist for a whole year- (and reluctantly at that- I had a panic attack i think..? I’m still emotional about it all- wrecked!) but it felt like someone was holding a blow torch to my face one day. I needed a root canal. Found a chili seed in the hole which explained the AGONIZING pain that seemed to come up out of nowhere. I watched that hole get bigger and bigger- too terrified to trust a dentist again- I still don’t. I think this new one just wants to break my tooth… she’s been so rough and my third appointment ISNT for the cap-? It will have been three months since she took the root!!!

    I think the dentist pulled the wrong tooth I went in the dentist for a check up and to be cleared for braces General took my X-rays said I didn’t have any cavities and I was cleared for braces I went paid for my braces to be put on but they only put the top on with rubber bands except for the last bracket didn’t have rubber bands on it so there’s my wisdom teeth then there’s the tooth in front of my wisdom tooth and the tooth I front of that tooth has the last brace bracket on it and the top two teeth in back of my vampire teeth has no bracket or rubber band on it because I have a overbite and the orthodontist scheduled a appointment for me to get those two teeth pulled out so they can bring my over bite back however 2 days after I got braces put on
    my tooth in the back either wisdom tooth or the one in front on the top left side a tiny piece of tooth came off and was giving me sooo much pain I know it was something going on but I was confused because the dentist took x rays of my teeth and said i didn’t have any cavities all I needed was a cleaning and could get braces so when I went and go origel clove oil all kinds of stuff for pain until I had my next appointment to get the two teeth the orthodontist said needed to be extracted for treatment I told the oral surgeon about my teeth hurting in the back and about a piece coming off I told him the pain is in the back either wisdom or the one in front I’m not sure but a piece of tooth came out they took X-rays and said it was the wisdom tooth i asked was he sure he said yes so he took out my wisdom tooth which took a very long time he was stretching my lips out I have scars on the outside of my lip inside of cheek he said it took so long because it had a cavity and was crumbling and I will have alot of swelling and bruise because my tooth had two roots i don’t see how they didn’t notice the cavity when I went in for braces consultation just 1 week before coming back in also I think he pulled the wrong tooth I still fell the same feeling in the tooth that is in front of the wisdom tooth he also was in a rush he said he couldn’t even pull my two teeth out that I was originally scheduled for because he’s like 2 or 3 hours behind and I had to come back for those my appointment was at 11am he didn’t start working on my tooth until 2:30 by the time I left it was 4pm

      Wisdom teeth extraction is a fairly common practice. If you are still having some pain, it is best to address your concerns with your dentist to see what can be done to address it. But if you think you have a legal claim, I recommend contacting an attorney in your state to discuss in more detail.

    I have the best dentist off all I was told I need a root canal even after telling the dentist that the tooth has never bothered me but he kept insisting on doing the work now mind you I have state insurance In PA and have no idea what is covered the state insurance recommended this dentist so the dentist starts the root canal and after he's done I'm going up to set up my next appointment to finish it by getting a crown and they hand me a bill for 3k saying I need to pay out of pocket in order to finish the procedure so I call the insurance company and ask why I have to pay 3k for a root canal well apparently if your under 20 you don't need prior authorization I'm 35 so the dentist office needs to send paperwork in and see if I'm approved first before the procedure, so I call the dentist office and the girl who handles billing for the office says to me I never sent it in bc they say no anyways, okay why didn't you say that before you guys started this root canal knowing my insurance doesn't cover it now I don't know what to do 😭 O yeah this is Donald Trump's buddy Hazzorri he was in trouble for trying to have sex with a patient but of course I didn't know this before going to him

    • @scottkuboff
      @scottkuboff  ปีที่แล้ว

      I understand your frustration, however, this sounds more like a billing issue than anything else (unless, of course, you are saying the root canal was not medically necessary). While I am licensed to practice in PA, I limit my practice in the commonwealth and currently do not accept such claims in PA. I recommend reaching out to a lawyer near you who handles these cases. Brendan Mulligan in Philadelphia is one to consider - he is a dentist and plaintiff attorney. 610-444-8899.

    I had my tooth extracted 3 days ago by a dentist who used brute brute Force to remove the tooth. He never even checked to see if any of the tooth was still left in there or attempted to clean it out. I swear the man used at least 30 lb of pulling force and I was afraid that he might have broken or hurt my jaw in some way

    • @scottkuboff

      If you believe you have been injured, it is important to seek appropriate medical care. If this is an Ohio claim, you're welcome to submit a case evaluation request: iboldobrien.cliogrow.com/intake/90cfe16f9db18cd129067d0b78b50083 This is not to say the claim has merit or not, just to get going on an intake. Negative outcomes can always arise, especially in dentistry. Simple fillings can turn into root canals. If you expect perfection, then never get a cavity. And if you expect everything to go 100% perfect at every treatment visit, you are in lala land. Yes, crap happens, however, after looking at some of the posts here, these are people who have no clue.

    • @scottkuboff

      While most bad outcomes have nothing to do with negligence, many people will not know that unless they reach out to other providers or lawyers.
