After 3 emi default, customer will convert to NPA non performing asset and then legal notices will serve to client through court. Go and get some knowledge. Don't mislead here.
The legal process to follow proper recovery procedures of loan is follows: Once customer misses to pay EMI on time then the account becomes delinquent and then collection process starts. Collection process involves sending first sms then followed by email and then if customer stills does not pay then remind customer via a phone call. If still customer misses to pay then a legal letter should be sent. If customer still do not pays, then and only then recovery process should be started. If any bank starts recovery process without completing collection process, then that bank can be sued for this mis management and harassment. Recovery process can only be started after collection process of 90 days are over. Starting recovery process before 90 days is not allowed.

And the person can only send the response from the customer to the superiors for further action but cant talk rudely or force/threaten anyone. Isnt it a crime under IPC for threatening someone. Also, if someone is defaulter, then, go through the legally proper way. Deliver the notices and then the money be taken through the seizure of asset of equivalent value. But you cant do it in this way. And it would be better if uou know your loan amount wont be returned then dont provide loans to undeserving candidates. A failure of bank due to bad loans would lead to massive and countrywide issues. I agree that banks do malpractice when issuing credit cards etc but when we are knowingly taking debt we need to be ready to fulfil our duty of repayment. If you cant be sure, its best to not take the loan and if the loan was taken with best intention and understanding of mind then its on the customer to approach bank and ask them to give them some relaxation. Ia pretty sure you do not know the rules. The woman is abiding by tue rules. A loan can be considered as a default only after 3 EMIs are missed. A collection agent cannot reach out to a customer without authorization from the bank, which has to be communicated by bank directly to the customer. The bank cannot send anyone to the customers residence without authorization letter for collection. These are rules which are set by RBI.

The lady is absolutely right. People don't understand and still giving fault to the lady. Banks have no legal rights to have recovery agents and have no rights to forcefully go to someone place to recover money. The case may go opposite if they visit uninvited. Moreover, the recovery agents are always harassing to customers. It is clearly written on the loan agreement that period of emi default is 90 days as per RBI guidelines and banks cannot force anyone to forcefully to clear EMIs every month when they can't pay it. Proper procedure should be followed and this lady gives everyone a good knowledge on how to handle those recovery agents. These recovery agents doesn't have any idea about rules, laws or guidelines but simply gets a contract by banks thinking that they can just simply threaten anyone to pay loan defaults.

There is no space for recovery agent. The agreement is between the bank and the borrower.....if it is a default the bank can only approach the court. Nothing more. No threaten no muscle no abuse.

The person applying for the loan should be even more responsible: they must have the decency to return the borrowed money on time with interest. Or else they must not take any loan. Even an idiot can tell if he would be able to pay back someone at a particular time or not if he knows his cashflows.
The thing is it's the business of banks to give out loans for profit. And there are certain amounts for which mortgaging an entire house is too much. Like Rs 5 lakhs, Rs 12 lakhs etc. Banks in these cases give out loans based on the monthly income of the borrower. But what happens is that these people think they can do away without payment and they instead choose to spend money on short term things. In such cases, the banks have done their due diligence and it's the fault of the borrower.
Irresponsible borrowing led to the 2008 financial meltdown. A person who wilfully defaults on loan payments is not worthy of being considered a person: he's an animal, a thief! He should be sued for everything he has. And most importantly he/she deserves no mental peace.

Ia pretty sure you do not know the rules. The woman is abiding by tue rules. A loan can be considered as a default only after 3 EMIs are missed. A collection agent cannot reach out to a customer without authorization from the bank, which has to be communicated by bank directly to the customer. The bank cannot send anyone to the customers residence without authorization letter for collection. These are rules which are set by RBI.

The lady is absolutely right. People don't understand and still giving fault to the lady. Banks have no legal rights to have recovery agents and have no rights to forcefully go to someone place to recover money. The case may go opposite if they visit uninvited. Moreover, the recovery agents are always harassing to customers. It is clearly written on the loan agreement that period of emi default is 90 days as per RBI guidelines and banks cannot force anyone to forcefully to clear EMIs every month when they can't pay it. Proper procedure should be followed and this lady gives everyone a good knowledge on how to handle those recovery agents. These recovery agents doesn't have any idea about rules, laws or guidelines but simply gets a contract by banks thinking that they can just simply threaten anyone to pay loan defaults.

Second agar koi customer apni emi nehi de pata hai to woh bank ke graviance cell me letter ya application dal sakta hai to share his problem..nd bank graviance cell bhaut active n situation ko samjha ke aapko solutions bhi dete hai.

SIR PLEASE SUGGEST IF I HAVE A CREDIT CARD LOAN OVER DUE FROM CITI BANK, AND NOW IF CITY BANK MARGE TO AXIS BANK , AND THE OVER DUE IS MORE THAN 3 YEARS, NO CHEQUE BOUNCE OF LAST PAYMENT PAST 3 YEARS BACK, NO ECS WAS TGERE ACTIVATED, NOW AFTER MARGER CITY TO AXIS DOES AXIS IS COMING LIMITATION ACT ?
