    As someone said mixing the two different stones together would’ve looked nice. Maybe if he had a zen garden already he could’ve meditated and found the beauty in mixed stones.

    I agree with judge John. The defendant held his stones hostage and should of had to pay for all of them.

    At the end the plaintiff is talking about the company would’ve left the stones where he wanted them, so why didn’t he use them

    Hard to believe the plaintiff never bothered to call the supplier and say hey, these are the wrong color stones, what do I do? So a lawsuit was the first thing he did? I do believe him though that the defendant made excuse after excuse as to why he wasn't available, and it's telling the defendant was keeping the stones hostage at his own house.

      At best the plantiff couldve only returned half of the materials. The defendant held them on his property, which could present problems if someone just showed up and started hauling then off.

    Unfortunately, if you’re returning the stone they will only take back all or nothing. It’s not like they will take back unused stone. I agree with John. The fact that the defendant had half the stone would have made it difficult to actually make a return but I do believe the plaintiff made no effort to actually trying to return the stone.

    Wow...the stones don't have to be exactly matching. It's a garden, variety in stones might look nice. He probably read some self-help book that recommended a zen garden and has no idea. The plaintiff is a cheap jerk. Pay the man to work! They expect everyone to break their back for pennies.

    It is actually possible that plaintiff had defendant to order everything needed including rock for him and he just paid. Clients ask my husband that, just order and i will pay 🙃. Husband always say, no you got to show up and pick your tile/rock/door or something major. Stuff like thin set that would not make a difference in color and looks husband makes preorder and then client pays.

      @@MrCharlesEldredge as far as i know he called and paid for it. They can do preorder for clients and then client calls or comes to the store and orders/pays. So it is very possible that plaintiff did not order it himself.

    Wouldn't it have saved time, money, stress and a flippin' court case on national TV if he just either 1. brought one of the existing rocks with him as a color/size comparison to the quarry (or wherever they purchased the second rocks) or 2. take a sample rock home from the quarry to compare BEFORE going through the entire process of purchasing and delivering?? I'm beside myself that the defendant is a "professional".

    Imagine being so entitled that you sue a guy who’s only job it was to pick up an order that YOU had placed & paid for & deliver that order. Then bc their was a color issue, you turn around and INSIST he returns the rocks for free without being charged. This guy is horrible!

    They're not going to be able to pick them up. They load those stones with a vforklift. They aren't going to be able to be able to pick them up at the house.

    I'm not sure I understand why the plaintiff's colour order was not the same as the colour delivered, and therefore why this is NOT the defendant's fault. It seems he plays a much bigger part in this than simply delivering stone, because he is able to keep part of the order at his place and also has a backhoe. And also the defendant tried to add extra payments to his work, when if he is just the delivery guy, he wouldn't be able to charge extra...

      The portion of your comment questioning why the defendant is not obligated regarding the colour of the stone, is because the plaintiff had no proof.
      All he did was hold up an invoice to the camera that stated the Pennsylvania blue colour was ordered, and they were tan instead. That does not prove the defendant had a hand in changing the colour.

    I agree with her husband. The defendant didn't even deliver the full order only half of it how was the plaintiff suppose to do a return or exchange if they only had half the order and the defendant delayed the possible return of the product by faking sick. I think he used that stone on another project.
    On another note if they would've delivered for $65 then dude should've had them done that and just had the defendant move it to the backyard or however. Would've been easier on everyone

    Just caught the Plaintiff in a lie. Earlier he stated that the defendant called him and said they were the wrong stone, now he just ssaid I did not understand why ther defendant could not see they were 2 different stones. If he did not see it then how could he have called and stated they were wrong.

    Completely wrong judgement. The defendant should have gotten $250 for his half day work with the backhoe. That is more than a reasonable amount for backhoe work.
    Delivery for any amount of stuff from Home Depot is $75 to the curb, not matter how little or much it is or how many items there are. That’s because they make a profit with the sale of the items. And they don’t “undeliver” for the same amount or for free; you have to return the stuff yourself and Home Depot keeps the delivery fee.
    It’s true the defendant has half of the stone in his possession. If he could make use of it , perhaps a judgment would be for him to keep the stone. If not, then the plaintiff should pay for arrangements to transport that stone somewhere else.

    Why wouldn't she just order him to deliver the stones he has and then make him pay him for that ?! Also when you order something they should have it there and ready and the delivery guy should deliver it to him cuz its what he ordered. But unfortunately the judges don't always listen to what everybody has to say

    He clearly said early in the trial the backhoe was on the truck with one pallet of stone. Due to weight. How do you think he picked up the stones? Using the backhoe to move the pallet of stones.

    This is why when you're having work done at your property or home you need to first of all fine the right people then second you need to iron out and outline everything needed to be done on paper in a signed contract. This is what I've done everytime I have work done no matter what it is.

    That isn't so much a wall as it is a curb. If the defendant had to split the stone in half and was able to deliver half in 4 hours, why didn't he just deliver the other half the same day? No one pays per day for just this reason. The DA plaintiff was too lazy to make a lousy phone call to see if the supplier would pick up the stone, or anyone else for that matter.

    The stone shouldn't have been at the defendant's house at all. It would've made more sense to bring it all to the plaintiff's house and then use the back hoe to transport it into the back. I know it was probably more convenient for the defendant to do that, but I would be annoyed at that if I was the plaintiff. So what if the stone company would've only delivered it to the front? He'd still have all his stone!

    In Response to the last question by a viewer: we've learned that masks and even vaccines don't work as well as we hope they would. Throwing a bunch of people in jail for not wearing masks that don't work as well as we hoped is not the answer. That would be a totalitarian government. That would not be freedom. Living free has consequences too. Living free means you can't force your will on other people. Freedom is not forcing one will on all.

      these are not new, they are from 2020 and 2021, during the worst of the Covid-19 pandemic. Masking was quite common and still many people mask up for the phobia it created. Be nice to the people who still mask up for their own reasons. And I guess you have been too busy not masking to hear, the covid has not been eradicated, it is still here and will be here as it mutates like the flu does.

    It is annoying that Judge Milian interrupts people and won't let them tell their full side of the story, I've also noticed that she continuously yells stop stop even when the person is not speaking it's ridiculous, I don't understand why she does this? She's gotten very rude over the years with her litigants, I also don't agree with her on the case about the stones I think that the defendant did pick out the wrong color and I think the plaintiff was able to prove that by the paperwork he showed the judge, I think once she has her mind made up about something she won't go back on it, I don't know if she feels like it makes her look dumb or undermines her but it's beyond annoying. One more thing, I don't believe they would of picked up those stones, should he have asked? Sure but i can almost guaruntee it would of cost more than the $65 they charged to drop it off if they agreed to it at all.

      @ Breakup2Makeup, How did the plaintiff have any proof the defendant changed the colour?
      All he did was hold up an invoice for the camera that stated "Pennsylvania Blue" that only proves what he ordered, even though the colour of the stone delivered was tan.
      Nowhere in that chain of order did the plaintiff prove the defendant contacted the quarry and changed the colour. The ruling was correct as per the defendant not being responsible for the colour snafu!
