Has already happened to many American business people. Even an honest skipper might unexpectedly change plans during the voyage, so there could be mutiny at sea!

Alex. What is a minimum size of "treasure" a Claimant to show to entice the lawyer to accept no win no fee basis? Where does the ATE policy come into this, I am confused?
Interesting question. A fast track claim of £20,000 say, a lawyer is going to want £5,000 of that treasure I would say, to be very "guesstimate" about it. But if it was a really strong case he may go up. (or down if weak, of course.) ATE is not about your lawyer's costs, but about an insurance company paying your opponent's legal costs if you lose. (Big business intimidates small claimants with the mere threat of these costs, into not bringing a claim at all.) Not everyone worries about this, let's say if they have a strong case or can afford the risk. But for larger cases where the costs can exceed the value of the claim, it becomes an important consideration.
Would you take on a Council for professional Negligence?My Business has suffered due to council ignoring planning laws and regulations.The Council even stated that you don't need a licence to Serve alcohol to paying customers ! Also allowing a business to serve/sell food/alcohol to public without and licences or regualtion as they state its "low level" or " infrequent". Glad it worked Mr Roulston - it's really tricky area trying to explain to clients. We are going to do one on "damages-based agreements" next. I think.
I have a map - know the value of the treasure - know the route - know how to sail .... what would you do?? .. Leave the skipper behind!
