- Cruelty to a woman by her husband and his relatives is known as section 498A of the Indian Penal Code. Although this law was made to protect women from cruelty, but in the last few years it is being used most inappropriately. The Supreme Court of the country and various High Courts have given many important decisions against 498A in the last decade. In a recent decision of the Calcutta High Court, the court even said that women are increasing legal terrorism in the name of 498A. Madhya Pradesh High Court said in its decision that a package of 5 is going on in 498A cases, where not only the husband is being targeted, but the husband's family members are being included in the FIR.
Legal Reporter spoke exclusively to Supreme Court lawyer Rohit Priya Ranjan on the entire issue and learned how the FIR under section 498A can be quashed by the High Court.

ज़ब तक नारको टैस्ट जैसा कोई प्रावधान न हो.... तब तक न तो झूठे केस रुकेंगे न victim को न्याय मिलेगा..... और जिसके पास एविडेंस हो तो ही केस दर्ज हो... अगर evidence तो जल्दी उस पर फैसला हो... और कॉल रिकॉडिंग को एविडेंस मान कर FSL Report जल्दी होनी चाहिए...
सबसे पहले कानून में फैले भ्रष्टाचार को खत्म करे तो निर्दोष सबूत पेश कर सके
झूठे मुकदमे बाज औरत् को सख्त सजा मिलनी चाहिए।

एक बार high court में stay लग जाये तो उस केस की सुनवाई नहीं होती.. Ordnary me डाल कर उसे कोई सुनता नहीं
