    Hello sir mgbigay ka naman ng complete details na kelangan nakalagay sa DOAS pra sa mga buyer may idea sila kung tama b yun pinipirmahan nila sa seller kse cla gumawa ng DOAS.

    Gd am po attrny nais ko po sana ihingi ng payung ligal tubgkol po sa apartment n binenta ko sa pinsan ko ble 2 apartment po iyun n magkatbi iisa lng ang title kptd ko po nktira sa isang unit total of 28 sqr mtr po ang lot isang 12 sqr mtr at isang 16sqr mtr yung 16 po ibinenta ko sa pinsan ko dhl iisa lng ang tittle ng 2 unit nbigay ngyun po gsto nya angkinin pti yung unit ng kpatd ko dhl hwak nya dw yung title n nklgay 28 sqr mtt pero isang unit lng binenta nmin sa knya n my sukat n 16 sqr mtr marming slmt po

    Paano po kung yung absolute sale ay na notarize ng wlang apperance ng mga mayari at wla ding acknowledgement receipt at titulo na hawak ung buyer.. Meaning illegal process po ang ngyari

      @@KarenDCruz-f4p Supposedly dapat kaliwaan, pagkanotaryo ng deed of sale, saka ibibigay naman ung original title. If may mga paglabag si Seller sa agreement nila ni Buyer, merong misrepresentation or deceit, then pwede pong filan ng case ni Buyer either ipa cancel yung sale, filan ng estafa if merong panloloko na kasama, etc.

      pano po pag nag deny of law firm na ​sila ang pumirma at nag notaryo ng deed of absolute sale kasi ngawa po ung notarize na wla po ung presence ng seller sa lawfirm @@pinoybataschannel

    Sr sino ba ang my karapatan ang my transafer of title or dead of seal na hindi nman nka register?

      @@DemzAlcasid marami pong factors ang dapat isaalang alang sa tanong ninyo. Nakadepende po ksi ito sa validity ng Deed of Sale at kung sino ang Registered Owner sa title, need po muna ma check ang documents before masagot yung tanong ninyo.

    Hi Atty pwd po e cancellin ang deed of sale na nka rotary tapos gagawa ng panibago? Hindi ko kc alam na malaki pala ang penalties pag di maayos agad. Pag gagawa ng bago makaka iwas ako sa penalty kc ipa transfer ko agad ang titulo.

    Kung hindi po mag file nang execution yong plaintiff kasi may gusto pa sa ipaglaban kahit may finality na po anong mangyari?

      Usually may 5 years from date of judgement po na ibinibigay sa plaintiff para mag file ng writ of execution. After mag lapse ng period, then barred na po si plaintiff maghabol, as a general rule.

      Yung naibigay po na title is the same title po ba na naka entry sa deed of sale?
      or correct title naman ang naka entry pero maling physical copy ng title lang ang naibigay?

      pwede naman po kayo bumalik sa abogado na gumawa at nagnotaryo ng deed of sale para ma correct po ang error.

    Matagal na po tapos ang kaso pero hindi po na execute,valid pa rin po ba ang desisyon ng korte

      if may finality na po, dapat ma execute po ito
      a. within 5 years as a matter of right
      b. or after 5 years but before 10 years at the discretion of the court.
      c. after 10 years but only in very exceptional cases.

    Deed of absolute sale na walang pirma ng asawa ng nagbenta dahil yung titulo ay nakalagay marriage to. At kulang pa ang kanyang binayad .valid na ba yun at puede ng pa transfer ng bumili ng lupa

      Attorney same case po nito Ayaw pumirma nga asawa at Ayaw din ipa cancel ni seller ang lupa ano po ang dapat gawin para makuha ko po ang na gastos ko sa pgbili ng lupa?

      @@KenJo314 Basta may conformity po ng buyer. Pwedeng i-cancel or i-waive ng mga legal heirs ng Seller yung rights nila sa property if yun yung gusto nila.

    Atty. paano po kung patay na po ang seller tapos yung buyer po is yung isang anak na kung saan nakatira ang seller at walang pamilya nakakaalam ng naging bentahan nila pati mga kapatid dahil nilabas lang ni buyer yung deed of sale nung patay na yung seller na tatay nya at yung nakastate na date nung bentahan is nung nastroke na si seller at thumbmark ang nakalagay sa deed of sale kahit kaya pa pumirma that time.yung witness ding nakalagay is kumpare ni buyer.valid po kaya ito?

      if notarized po ito, then may presumption of validity po ito sa batas natin. If sa tingin niyo questionable yung authenticity ng deed of sale, then the person assailing its validity has the burden of proof to present evidence na may defect ito or it was obtained through fraud, deceit etc.

      Atty. Good afternoon may nabili Po kaming lote through installment tapos sa moa namin magbabayad kami from January 2024 to December 15, 2024 tapos pwde nasa moa namin na pwde na gamitin yong lupa January 2024 pa lang then nong pumunta na kami sa lote nong January pa para magsukat para gagawa ng tindahan d pumayag yong may Ari Sabi nya tsaka na daw gumawa ng tindahan pag may papel na tapos tsaka na daw kami magpabayad sa monthly pag lumabas na yong papel then umabot ng July nag demand na Ang may Ari na magpabayad na then dumating yong time na humina yong negosyo namin tapos may nabigay na Po kami mga 300k plus kasali na pd agent tapos Sabi ng may Ari e cancel daw yong application pra sa titulo na nakapangalan namin ano Po dapat Gawin namin atty.. salamat
