    I'm Ghanaian and very interested in this case that the sitting government lost because we've had our own election petitions.
    How did the attorney General intimate in the beginning of his submission that the right to vote I'd not a fundamental right by saying that that electoral commission may not provide access to voting because of many reasons.
    I thought it is a fundamental right all over the world which even the highest court in any country cannot take away.

    Haaa I don't know why some guys are upset.
    If one was to reason without an interference of the political spirit, then you shall realize that the AG is doing even better by setting up a clear way in matters with contravention...
    However nothing can be futher from the truth - if the said iebc memos and few other petty grievances then then the Diminimist nonculate lex rule shall apply...
    Of small things the Law knows no cure..
    This petition is therefore destitute of merits and as of what fate shall follow it, your guess is as true as mine.

      "Di minimis non curat lex" rule! Of the smaller things such as petty grievances,administrative errors etc coins non! If and only if the "most or the maximus curat lex" as the exception of the do minimis rule!

      Is this guy Githu here as the AG of the Republic of Kenya or as the Advocate of the IEBC,and along the way, a kind of Court jester?!. He's entertaining though,but the issues before the SCOK are matters of life and death,and cheap talk like this is an abuse of th office he holds.

    First, AG Githu Muigai has again shown that he is a Jubilee lawyer. His partiality - towards the President’s interest - is clearly demonstrated; no ifs. According to Muigai, a unarmed voter protesting in the streets and refusing to go and vote is deemed violent. However, the same AG Muigai wants us to believe that government security forces armed with guns are not violent, even when there is clear evidence in form of publicly available video, clips which show conclusively that they intimidated and shot peaceful people without cause or provocation (Migori incident, body bugs in Kisumu, police vehicle running over lawful protesters in Nairobi, Nairobi CBD “business people, including some in police uniform come to mind). AG Muigai is entitled to his opinion; he is not entitled to his own facts.
