"How long does the USCIS look back at your financial income
if you're able to
sponsor your spouse?"
Well, you have to submit three years worth of tax return
information, that's how
you basically do it.
But they're looking
at financial history,
they're primarily looking at your income right now and how
likely it is that you're going to
make income in the future
to support your spouse and your marriage case.
So I have cases where people
have not made money,
they have been going to school and they just graduated, got their
first job
And that's been okay.
Now I have colleagues who say that's not okay,
I've never had a problem showing people who just got,
recently got a job if they could show their pay stubs, their employee letter,
that they're gonna have this job. But it's a case-by-case basis.
So you can't just think
about this one issue.
It's one aspect
of the financial income,
we got to look at the totality
of the circumstances because
as I talked about earlier, it's a discretion thing and they are
going to judge you and say
"Well is this person going to be able to
support their family or not?"
And so they want to see a
large number of things
to be able to judge whether you're appropriate for the Affidavit of Support
and also, new public
charge rule will as well.
