22-year-old Ann Makena shares how she was sentenced for 3 years over a crime she did not commit

  • One month ago, 22-year-old Ann Makena embarked on her newfound freedom after she was released from prison. Makena who hails from Kiereni, Tharaka Nithi County was arrested in October last year for selling unlicensed products unknowingly at a Wines and Spirits shop in Chuka where she was employed.

    Heartless magistrate, heartless police, heartless prosecutor.... heartless Judiciary. Think about this girl's mom. Poor woman's son is sick and then they've so casually jailed her daughter. To make matters even worse, the young man dies while the sister is languishing in prison. This is injustice practiced beyond imagination. Poor family!!

      The owner of the wines and spirits did not bring illegal spirits to his premises. They were sneaked in by Makena. She used his premises to make money selling illegal spirits made and bottled in the Kariobangi light industry.

    How comes the owner of the pub was not taken to court?And why didnt the employer pay for her the fine?Even the Magistrate should have saked her if she was the owner of the pub.The prosecuter and KRA took the wrong person to court.A good lawyer should take this matter to court for this lady to be companseted.That is very unfair.Human writes NGOs should take up the matter with the government.

      @@ralph839 The poor girl was arrested on the 4th day of her 1st employment. She was arraigned in court at most a day later and probably sentenced the same day. During her time in the dungeon, her brother died and she only came to realise it after her release. In this clip, she is trying hard to explain the unfolding of events as best she can. For you to accuse her of criminality is quite heartbreaking to say the least. Kindly listen carefully to the young girl's sad story without prejudice and since you have a mother, sister or daughter, withdraw your statement. I leave it to your discretion to do that.

    The owner of that business should compensate her. There is no way you can let someone who you just employed suffer like this because of your wickedness and just walk away like nothing has happened. And everyone involved in this case should also pay a price. .

      What I'm wondering is who the hell sent her to jail. Why would you funga the attendant who's barely legal ata when the owner is just out there parambulating. Ata kama ni makosa, owner should serve a jail term and the girl a 3 month term or some kind of sensible fine. This justice system doesn't work for the poor

    This is really sad. We have a failed judiciary and a failed criminal justice system. Almost 3/4 of inmates in our prisons today are innocent people who are unable to pay fines and bails.

    So a jugde who studied law more than 7yrs n practised more than ten yrs would still make such decisions jailing a 3days employee coz of mistakes done by th employer, th jugde should hv asked th detectives is it her responsibility to out kebs stickers on products

    I simply can't listen to young girl's story to the end. How unfair could the judicial system be? Completely inhuman. Where is the Ombudsman of the Kenya's suffering masses? Women of Kenyan, please, asa Martha Karua & Raila are sworn in, please send a delegation to Martha & demand a re-look of the judicial system which is completely skewed against women.     The only problem we have in this country is judiciary, no justice at all, chitembwe is working freely yet he has huge cases behind him, thugs are in political class, yet the court has no capacity to jail. I admire Moi era. These judges would have been executed in the middle of nowwhere.

    Kenya should introduce sentencing that leans on whether you're a first-time offender or not. This lady served time when she shouldn't have.

      You're right... And although she's been released presumably after someone paid her fine, she will always remain in the records as having been convicted. That has lifelong repercussions. If, say, she wants to apply for a US or European visa, they will ask her if she has ever been convicted. Plus I guess no certificate of good conduct. etc etc

    This was such a young lady only trying to make ends meet. 19 years of age yes is legal adult age but she was so naive and innocent and spent 3 years for something she did not do. I hope someone or the government has compassion and takes her to university. She at least deserves that. It is so pains me so much yet I don't even know her.

    Kenya's judiciary system needs to be changed in tremendous ways. Many innocent citizens are or have been convicted and served for crimes they didn't commit!! It's traumatizing! It's unfair and brutal for those innocent tax payers! But corruption is the root cause for all of the injustices! Even the Bible says, do not accuse anyone falsely! Whoever takes the next government, kindly think twice. Think twice about where we are failing, think twice about the flaws.

    I am listening to your story while crying i went through this last week though i stayed in prison only one day but the tears i went through i can imagine am very sorry dear i saw the situation in their it's not good and i can not wish one to be there and if i would advise any young lady stay away from any liquor shop in court i saw many pple serving those case in court i was with one girl 25yrs old who worked in a liquor shop for just one month then when auditors came for their calculation she was reported for a short of 200k and in court she was to give out cash bail of 200k its not easy in court neither in prison.

    This is unfair. The law of tort says that in a case of master-servant relationship, the two should be charged as one. It's the master to be held responsible. The magistrate was dubious in their judgement. Seek justice mrembo.

    The prosecution, the defense and the judge can't altogether agree on this mistake unless she didn't go through the Court. If it's true as explains, then we don't have criminal justice system but butcher- Only - the - innocent paupers Justice system. What a pain!!

    Imagine umalize form 4 usake hustle ya kuuza kwa duka unalipwa 5k, KRA wakukamate na CID juu sigara unauza ni counterfeit.

    Kenya's sentencing guidelines do not make any sense. Three years for something that small amounts to cruelty. We urgently need sentencing reforms.

    Believe me no evil done under the sun goes scot-free, Vengeance is for God. Everyone that was involved 1year from now, They will loose more than the 3yrs a innocent girl passed through, We serve a God of Justice. Karma is real.
    I once treated someone bad, with arrogance, I never cared Even to apologize. A year later, my life started taking a turn of disappointments and closed doors. I put my pride and ego aside, I humbly went back to everyone I wronged and apologized. If his Excellency the DP President RUTO can say SORRY, Pride comes b4 a fall. Wise and God fearing people say SORRY..

    Pole sana binti. We have a broken justice system and a failed judiciary. Such cases should not happen at all. If her father or mother was a senior government official or a drug dealer, she could have, most probably, not have spent a night in jail.

    I remember I was also arrested in almost the same circumstances by the KRA officials. But my employer was good enough to bail me out. My experience though at the cell was so traumatizing. We need to change the laws, for us employee not just to be treated as bait.

    And also is slow moving thus lowering business speed.
    The fast moving is the 2nd generation Pombe. It moves very quickly thus moving business quickly too.
    All troubles are caused by the government. In all sectors.
