    He called the police, but they wouldn’t help him.
    Turns out, laws meant to protect tenants, also protect squatters.
    Shelton took matters into his own hands.

      The owner has a LIMITED TIME to drive out trespassers, so it don't become a nuisance to the community.
      But they REFUSE to provide security for their own property, in order to SKIMP; and it hurts the community; since they want to hold houses vacant until the price is right, and write off the losses. It's a SCAM!
      At least the squatter keeps OTHERS off of it.

      @@BlazinRiver1 You just paint the house walls with red paint and big letters reading "He comes at night", "Get out", "Ripped Guts", "His Place".
      You also leave a pair of giant shoes near the door and a pair of leather black gloves, a knife and a 16 year old's picture with the words "2 years left until you are mine, Hannah!" on the table in front of the main door.

      Not really.
      The problem is when those rights are strengthened beyond reason.
      It makes sense that if you find an abandoned property, move in, spend your time, money, and energy improving the property, pay for utilities, and spend years living there, the "owner" can't summarily evict you and steal the investments you made into the property they left abandoned for years.
      It doesn't make sense that a property you own and take care of should be taken from you because you were gone for a week.
      As with everything, there is nuance.

    So if you break into a home, pick up the television, and leave with it, you’re arrested for breaking and entering. But if you break into a home, sit down on the sofa, and watch the television and NEVER leave, you have tenant’s rights.

      The "squatters rights" stuff was originally meant to protect settlers so that their homesteads couldn't get claimed by railway companies/etc. It was NEVER supposed to protect thieves from stealing your house.
      The real issue is liberal elites who either don't care, OR WORSE see it as a good thing (in some sort of weird "justice" way, such as: "well your ancestors stole the land from natives so it's only fair it gets stolen from you", not realizing at least half the people's ancestors came over here after 1900).

      They can go get a job and have plenty of money for food and shelter.
      "Profit seeking" it's what built this incredible society we live in, where we enjoy luxuries people wouldn't dream of 100 years ago.
      I worked very hard my entire life to save money, for me and my family. If I chose to invest it all in a house, one of this rats doesn't have the right to steal it.
      This laws should be abolished. Tenants who paid rent for at least 6 months, should get 30 days to evacuate.
      People who break into homes, should get relocated to prison.

Several of the cases John noted were not of squatters in rental properties, but in people's actual homes, their primary residence. The squatters were depriving them of their "fundamental needs" along with their property.

    This very same thing happened to this old woman in the city I grew up in. The neighbours were well aware of what was happening and called the police but for different reasons. It turns out that when one of the neighbours confronted the squatter that squatter lunged at the lady who asked why she was still there. The husband came running out and the police were called. The police came and arrested the squatter because she assaulted the neighbour who would come to check on the elderly woman as a matter of care. The young lady that was attacked ( neighbour ) put a restraining order or protective order against her assailant while the homeowner started the legal process of keeping the squatter out. Because of the protective order and the fact that the squatter couldn’t be anywhere near the victim. She the squatter violated the terms and conditions of her release and was permanently dealt with! I say it was a pretty brilliant tactic! Beat them at their own game!

    I had to deal with a turn squatter tenant here in LA, CA during Covid lockdown and had to spend my last savings (at the time I was going through hard times) to fight that squatter, who was abusive and has been doing that for 34! Years! (As I later found out running an extensive background on her). I felt so let down by my local and state and federal government. I am moving out of California to a more landlord friendly state this summer.

    Never report a squatter. Wait for them to leave, change the locks, hire people to toss their shit out into the yard. When they try to get back in, call the cops and report an attempted break in/trespassing. Oh before all that, don’t forget to write up a lease for a buddy that will be “living” there and get it notarized.

      Thankfully, Gov. Ron DeSantis (R-FL) signed legislation to criminalize squatting. Florida is the first state to directly ban the practice.

      That's _exactly_ what this guy did. His mom wrote him a lease. He was the legal tenant. Waited for the squatter to leave for work, as a, get this, prison guard, then took possession, changed the locks, and hired a couple kids from across the street to empty the house onto the driveway. When the squatter came back, they were cordial, but it was essentially, get your crap and get out.

      @@FRN2013 CA SB602 became effective Jan 1 2024, calling them trespassers who are breaking the law. (Entering and occupying real property or structures of any kind without the consent of the owner, the owner’s agent, or the person in lawful possession.) About dang time.

      Anyone inside my home or my apartment is either a thief or muderer and will be promptly treated as such. Inside YOUR home or apartment Anyone can treat such criminals as criminals.     Florida just passed a law kicking out squatters. The law allows law enforcement to remove squatters who do not have a lease authorized by the property owner. It adds criminal penalties, intentionally presenting a fraudulent lease is a misdemeanor and a felony to intentionally sell or lease someone else's property. And a felony if intentionally cause $1000 or more in damage while squatting or trespassing. Now the rest of the states need to follow since squatting has become a normal national occurrence.

      It's not "immediately." The homeowner has to go to court to sign an affidavit stating that they own the property and did not lease it to the squatter. That still takes time and lawyers from the homeowner. Then, the cops can come back and try to evict the squatter. Its a good start, but not good enough.

      @@TEverettReynolds the problem with the “squatter’s rights” laws is that too much power is given to the squatter or tenant. What you’re advocating for is too much power on the flip side, which will inevitably cause a different set of problems. What Florida did is a good medium. If you want something done immediately then grab a gun and handle the home invader like a home invader should be handled and stop thinking daddy government will always be there to save you

If a squatter can "claim" to have a valid lease why can't the owner just "claim" to have an affidavit or sign an affidavit on the spot and then the squatter has to go to court to get back in.... just seems govt can't do much right and all common sense is thrown out. @@TEverettReynolds

      Newsom lives in STATE PROPERTY.
      Anyone trying to squat on State Property can be arrested for trespassing. Granted, the different cities in Cali don't always push that law but you can bet if squatters tried to move into ANY city or state govt. building, they would be immediately removed for trespassing.

They don't even have to pay property taxes on it if they have that sort of thing in their state. It wouldn't surprise me if this was done just to make sure squatters don't have any rights if they got in LOL.
      It's like with the President of the United States. Wherever he is staying, whether it is one night or all year, it is considered US Govt. Property even if it is in another country and thus, "American Soil". It's like an embassy in another country. That land is considered the "soil" of that nation for as long as they are there.
      Or like whatever Air Force Air Craft the President is on is called Air Force One whether it is a plane or helicopter or a Space Craft (Space Force is under the Air Force like the Marines are under the Navy)

    In Ohio, if you change the locks on someone considered a “legal tenant”. They can kick a door down or break a window to get in. I’ve stood by on calls while this happens.
    Now, I will say if the owner never gave permission for them to live there, like the vacationers gone for a few weeks, I’d call that a burglary in progress and arrest the “squatters”. I haven’t run into that situation yet in about 20 years on the job.
    Saying all that, there is no doubt the landlord/tenant laws definitely need amended.

    Have a load of cameras that you can monitor remotely. It’s easy enough to set up and will potentially save you a ton of trouble.
    One of my friends’ parents had this almost happen when they were out of town. They called the police the moment these folks came onto the property with suitcases and luggage. They called it in as trespassing.

      It's not "immediately." The homeowner has to go to court to sign an affidavit stating that they own the property and did not lease it to the squatter. That still takes time and lawyers from the homeowner.
      It is a good start.

    I am currently living in a van. I could not imagine breaking into someone's home and living there without paying rent. I used to own a home, nice home in CA. Circumstances changed, I began disables and could no longer work due to chronic pain. It's hard to live in a van. It's hard on my body, but, I own the van, it's mine. I was fortunate enough to have two young men build it out into a small RV - B. Nice inside. Eastern red cedar on the ceiling and birch paneling walls, vinyl flooring, kitchenette.. Composting toilet, cube storage for some of my clothing, solar for my CPAP machine that helps me to breathe. My 12volt fridge doesn't work anymore, but that will take time to replace. Again, it's mine, I could NEVER invade someone's private home and I don't believe anyone else should.

    Mr. Shelton is a hero among heroes! I love his methodology. I lost thousands of dollars during covid when my tenant refused to pay rent for 10 months and couldn't be evicted. She then stiffed me for a $1,000 water bill when she finally left. The laws are a joke.

You are also forgetting to factor that if said tenant lost their job during the pandemic which many did ,you also don't know if this landlord who you are bootlicking for maintains their property properly or if they are a slumlord. You also are not factoring that there is a possibility that this landlord might have received rent relief for a majority of the months of rent owed . It's always easy to defend a landlord until one day you have an injury or unexpected tragedy that makes you go behind on rent or a mortgage and then have to face the same predicament .

Do you live in NY? Because that's super relevant. If you live in NY and you take 30+ day long vacations where your house is completely vacant the entire time, it's possible someone could steal your home. But, 1.) I don't know anyone who does that, and 2). every state law of concern is different and they have terms A LOT longer than NY. For example, in NJ, you can't claim possession of a property as a squatter unless you've squatted there continuously for 30 YEARS. Big difference between states.

      Let's do it and see how they like it. This is trespassing and thievery. I think rental agreements need to be notarized with both parties present, IDs must be shown, and a public record on file. It's be as easy as the cops looking that up in their system. If it turns out to be a verbal one they have 30 days maximum to file or present evidence of tenancy. Then after that they get kicked out.

    I would need to abandon my home altogether. This means the bank would also lose out, because I can't pay for a house I can't live in. I would think banks would want this type of issue resolved in a better way.
    The best thing to do would be call the police immediately, do not talk to the person, have them arrested for breaking and entering and possible theft. Deny any other possibility and you might have a chance depending on the laws.

      As a landlord myself, I can assure anyone who asks that being a landlord is free easy money ...
      ... until it's time to pay the taxes, the mortgage, the insurance, the repair costs, the maintence costs, the eviction costs, etc ...
      A bad tenet in place for even as little as a month, can easily put a landlord in the red for 5 years.
      Years ago, I rented to a young couple with a newborn. In the few short months there were there they never once paid rent, but they did manage to punch a hole in every wall (literally ever wall). They kicked holes in all the doors (every single inside door), most were off the hinges. A good deal of the trim was destroyed, as well as varius fixtures and appliances. All in all, they practically destroyed the place. I had to pay to fix all that as well as all the costs associated with evicting them, and all I ever got from them was the first and last month's rent, which they paid when they signed the lease, and which represented maybe 5% of the total cost of repairing the damage they had done.
      If being a landlord was such easy free money, everyone would be doing it and we'd have housing out the wazoo. We don't, because it isn't.

When I see one of those "In this house..." signs in the yard on the estimate I know my time has been wasted. Sometimes I might just bid triple the normal price and see if they bite. LOL It's more fun to send them an email explaining how their sign made we want to let them hire a more diverse company and I can assuage my white guilt

    I can’t believe I’m saying this, but maybe what we have to do is keep a copy of EVERYTHING that proves your the owner, someplace off property so if it happens you can prove it’s yours. If it’s happening this easy, we have to HIRE a squatter, yes, give them money, to go squatter on a township, city, official, then watch the tables turn.

      I agree, but as soon as you have been illegally occupying that property for the minimum amount of time (30 days in NYC), then "squatter's rights' laws go into effect and you are now living there legally as a "tenant", even without a lease agreement/contract. It's sick how some states and cities allow this. But, it's usually the liberal states/cities that are allowing this after just a month or two. Historically conservative states like AZ, TX and FL require a squatter to live in a house/property for years before they are able to claim squatter's rights.

    Claiming that police are not able to decipher a lease from a fake is like saying the police cannot determine whether a drivers license/car tag is valid or not. Court records on who owns the home are just a radio call to dispatch away. I guess if a car is left vacant for a few hours or even days a car thief can steal your car by claiming you abandoned it?

      I actually had that happen with motor vehicles. My brother, who lived in Florida, died and I became executor for his estate. Since I lived in another state, it took me time to get everything together with getting a lawyer, etc. Someone we knew had stolen all his things including two four-wheelers for which I was able to get the titles. She sold them but I was able to locate who she sold them to. I let my lawyer know who had them and she attempted to get them returned through letters but with no success. So I reported them to the police and after an investigation, the detective said there wasn't anything they could do. Apparently vehicle titles are worthless in Florida. I finally dropped it when the legal fees exceeded the value of the four-wheelers. Be aware if you live in Florida!

    This is the reason my parents sold their rental house and invested in asia. I also gave up buying an additional house for rental purposes. When it happened to us, we spoke to a lawyer and he basically said: if you are in the rental business it is a matter of WHEN and not IF it is going to happen to you.

    Move to Florida. Squatting is a felony and they will be dragged out and arrested by police and charged with home invasion. I love Florida for this!❤

    If someone breaks in when I’m sleeping in my house when I’m there, I have right to use deadly force. But when I’m not there, they break in, have phony paperwork, they steal your home, and I can’t do anything? That makes absolutely no sense. Whatever happened to “My house my castle”?

    A friend of mine in Seattle found squatters living in his vacant home and they refused to leave.
    When the squatters were not home, he put 3 hives of bees inside.
    The squatters left.

      yeah, my friends in Silverdale went on leave for a month. they put one large Rotwiler in the back and one in the front. When they barked the ground shook. Yup no problems at all.

    When my mum's ex-boyfriend didn't want to leave her flat after the break-up, I moved in with some friends. We had a party in his bedroom for a weekend and also brought dogs with us, which he was afraid of. We ate his food out of the fridge and his belongings were regularly affected by mishaps. He was happy to move out and we only had to clean the flat once after the party.The only thing that helps against shameless people is greater shamelessness.

      All well and good, but remember, and most importantly, accept that when used against you. Of course, you will rationalize your situation as "different."
      Since your actions reflect you didn't seek alternative ways to deal with the problem, I doubt you will.
