    so let's say I have a bank account that was started way before my marriage and never did I put anything on my spouse name with that bank account. Now, as I'm married I continue to save money in that same bank account but again my spouse has nothing in it or deposited anything on it.
    will that be separate or community ?

      if the money was earned during the marriage it would be community, anything earned and deposited before marriage is separate.

    So lets say..
    Iam married and living in a non prenuptial country and now i am moving to country that have prenuptial agreement.
    So if we got a divorce do my property would get separate or not with my spouse even though all things I earned was before marriage
    And do I need to sign a prenup after moving to this country even though I was married before moving to this country
    And I also have some offshore companies with bank accounts but this is hidin because my companies is in country which don't show my name on company..
    So do my secret offshore companies would also be separate
    (Sorry if I write wrong English)

      The laws of one country concerning marriage are not specifically connected. To be recognized, must register in your country that you are married in another country, but even then the laws concerning divorce proceedings from a foreign marriage are very difficult. If you get your prenup here, the assets that you can prove exist, and want to claim, will be protected if you get a divorce here.

    Can you help with providing information on putting a business in a trust. I have a friend that in the process of starting a business discovered that thier spouse was stealing from them buy taking money from the 401k and opening credit under her name. Unfortunately she learned this after she started her LLC and has paused the process in building this business. She's not sure if he'll be entitled to earnings from the business wants income has started. It was suggested to put the business in a trust before starting the divorce to protect it.

    You spoke at length about assets that someone has before they enter a marriage and assets that is accumulated during the marriage. You gave an example of a guy who had cash before the marriage, and then day traded and increased his assets. You mentioned that you argued that the increase should be shared as it is community assets. I am just curious to know how you came to this conclusion. Did the spouse have any input in the increase of the asset.

      Good question. This concept of community property is that any efforts made during the marriage create community property. So if my job is trading or investing then those efforts could create a community lien.
