Didn't orochimaru joined the Akatsuki 3 years after the nine tails incident. Kimimaro didn't side with him while orochimaru was in the Akatsuki organization.
Because the song was also used for Sasuke during his first fight with Naruto at the Final Valley. He's also a favorite, so I chose to use a cool photo. :)
Sorry for the late reply. This theme was also used when Naruto had encountered Sasuke at the Final Valley (Pre-Shippuden). That was the reason I used Sasuke. It was more impactful to me in that moment.

This was actually quite an emotional episode even though he was fighting on the side of orachimaru. You could see why he sided with him.
i actually didn't like him because he was fighting for orochimaru, until you could see the reason why he was.
