Which was designed to assist people in affordable ways of fighting their case. Instead people have taken to more theft crimes, using the new laws as a “get out of jail card.”

When my daughter was 10 she took a lipstick tester from a shop. She thought it was gratis you can take for free. The security of the shop called police, the officers came and drew up a report, the report was sent to juvenile court, I had police and case workers coming to my house to conduct interviews with me. After 6 months the court finally discontinued the proceedings but it was stressful as hell. We live in Poland.

I live and work in Asia. All the malls are like that still. Malls are packed with families, and teens hanging out and just being teens. No crime, no attitudes. It is exactly like America in the 80s and 90s.

Never been to NYC, I live in the Deep South..this was an amazing video to see how other people live and commute plus different types and levels of crime regarding retail theft. The architecture for both facilities is absolutely beautiful. I only can recognize from movies and videos such as this. I’m in awe of everything you went over. It’s like night vs day in the way I live and survive. I find it kinda scary and would feel like a fish out of water if I were to ever step into this world. My brother was in San Francisco a year or so ago. Stopped in a drug store to get something and noticed a security guard by the register. People were bringing items up to check out, but they never paid. Just walked right out the store. Apparently the Governor decreed that you can shoplift up to $999.99 and just get a misdemeanor. This is going on in a lot of the major cities. Businesses are closing down and are either moving or going out of business. The legal system is overwhelmed. Jails are filled to capacity. Not enough police. And the sheer stupidity of a city suing a store owner because they are closing down due to theft and lost profits/inventory.........I have no words to describe this shart show.

I lived in Manhattan from 1980-89, was (of course) a victim of crime (several crimes), and we were told that little (or nothing) could be done. Things changed radically in the 1990s. It could change again. This mall is pretty nice, really, and has a lot of potential but the city government has to prioritize fighting crime. Step one: stop making excuses for criminals.

It has nothing to do with homelessness or even crime. The crime is a byproduct of weak enforcement and horrendous criminal justice. If security guards were actually allowed to do their jobs and judges actually put shoplifters in jail, we would see a dramatic reduction in petty theft which is causing malls to close.

As a loss prevention manager, the problem is that businesses hire us the guard their merchandise and when it comes to doing our job, they don't want us to because they are afraid of lawsuits. They rather than just steal the merchandise and just write it off rather someone gets hurt or sued. So rather than complaining about the cops not helping with the crime let us as Loss prevention or Asset protection do our job the right way and I can bet you people will stop stealing. So what if the DA never prosecutes cases under a thousand dollars and often more. Stores can try locking merchandise up, they can install cameras, detain and call police. It won't work. Police are refunded and only respond to serious crimes. Often they don't respond to theft at all because they are instructed not to respond since the DA will drop all theft cases. Small businesses will close rapidly. Esp after Americans become homeless. A illegal who's homeless knows it's temporary. An American knows it's permanent. Liabilities and lack of punishments are the issue. It's gotten out of hand. Business should be able to protect themselves without fearing a lawsuit. The criminals should face some sort of punishment. Half the time, it does not even go to court. They just drop it. Kids can steal in NY and cops don't even want to engage. It goes through family court and same thing just gets dropped. It's a lot of paperwork they don't want to do. Thankfully I think the retail theft push they have been doing lately is causing them to be much more serious about larceny. They are actually following up with arrests etc... before you would never hear about it. The problem still remains. Is the court actually going to do anything about it.
If they are afraid of lawsuits there must be a reason. We need some landmark cases that side with businesses in those situations to set a precedent. THEN they let you do your job because they know the law is on their side. Essentially a judgement of yes people are gonna be physically harmed if they wanna have a go at destroying business owners' lives.
@@andersonentwistle The issue is and I have seen this happen. People who use force in the wrong situation. I have personally watched videos of someone pushing a compliant 70 year old male to the ground. With that Loss Prevention does not make enough money. You usually end up with people who do not really have the head for it. At minimum wage you get minimum care and minimum thought. The best prevention is teaching employees techniques to use and what to watch for but that also requires that they also care. Depending on the place your only recovering usually a small percentage. So I think they gamble on having no loss prevention more often than not. A single lawsuit can get rid of all the recoveries and then some. How we deal with shoplifters needs a modern solution. Not saying they need to be arrested but they should have some kind of punishment. I think community service is the way to go. Pay back the city you stole from. Wash the sidewalks. Pick up the streets. Something positive for everyone involved. Obviously giving tickets for larceny is not working. Why do we keep doing the same things.

That would mean that every exploitative illegal action that falls short of attracting criminal prosecution is completely legal as long as the victim is a convicted felon. And either way, federal case law has a history of valuing life and limb above property. Just read up on the famous supreme court case of the man who broke into an abandoned farmhouse and triggered a booby trap that blew his leg off with a shotgun shell when he opened a door and was awarded damages because the court reasoned that lethal / maiming automated traps are not a proportional response to break-ins when the absence of any occupants means the danger is solely financial, not physical. Also yes, ironically, the farmer who set the trap would have been off the hook if he shot the burglar himself instead of via a trap, including if it were lethal. America is an insane place.

It has been proven that tough enforcement on petty crimes actually reduce serious crime. The trouble with NY and CA not treating shop lifting as a serious crime just encourages the criminals to do more serious crimes. Then add in the fact NY and CA severely limit your right to protect yourself, you have exploding crime problems and smart people leaving the areas.

Most of it really comes down to the corp businesses and their rules; for example, I worked at Macy's and their Corp policy is that their staff and security are legally not allowed to apprehend thieves and instead call the police. As someone who is not from the US but visited NYC recently, can any US citizen help me understand why the law sympathizes with the criminals instead of the victims?
We have tough laws and high enforcement rate which is why where I lived is so safe and comfortable.
Many petty criminals are people of color. They are afraid of being called racist.

When my daughter was 10 she took a lipstick tester from a shop. She thought it was gratis you can take for free. The security of the shop called police, the officers came and drew up a report, the report was sent to juvenile court, I had police and case workers coming to my house to conduct interviews with me. After 6 months the court finally discontinued the proceedings but it was stressful as hell. We live in Poland.

I live in the Deep South..this was an amazing video to see how other people live and commute plus different types and levels of crime regarding retail theft. The architecture for both facilities is absolutely beautiful. I only can recognize from movies and videos such as this. I’m in awe of everything you went over. It’s like night vs day in the way I live and survive. I find it kinda scary and would feel like a fish out of water if I were to ever step into this world. I know it exists lol yet can’t help but think our world is spiraling out of control. When the nation shuts down I’m so glad I’m where I’m at. Better start prepping and preparing. There was a time in NYC if a criminal was being arrested multiple times before their hearing they would not be offered an immediate catch and release or citation and court date. Imagine if criminals were in jail until their court date for multiple arrests before their court date and actual punishment when they are guilty

Westfield is one of Australia's biggest companies and the biggest mall operator in the world. They have heaps of malls across Australia, Europe and Asia. They know a lot about running malls and clearly know when to pull out of a contract when there's no hope of getting a mall working.

I lived in Manhattan from 1980-89, was (of course) a victim of crime (several crimes), and we were told that little (or nothing) could be done. Things changed radically in the 1990s. It could change again. This mall is pretty nice, really, and has a lot of potential but the city government has to prioritize fighting crime. Step one: stop making excuses for criminals.

It has nothing to do with homelessness or even crime. The crime is a byproduct of weak enforcement and horrendous criminal justice. If security guards were actually allowed to do their jobs and judges actually put shoplifters in jail, we would see a dramatic reduction in petty theft which is causing malls to close.
As someone who's worked in malls and retail for almost 15 years, we had long been seeing a decline in customers shopping. At multiple companies I witnessed brick and mortar's shutting down

What's stopping these same criminals hitting homes and getting away with it.
As a loss prevention manager, the problem is that businesses hire us the guard their merchandise and when it comes to doing our job, they don't want us to because they are afraid of lawsuits. They rather than just steal the merchandise and just write it off rather someone gets hurt or sued. So rather than complaining about the cops not helping with the crime let us as Loss prevention or Asset protection do our job the right way and I can bet you people will stop stealing. It needs to start from the bottom and go up from there.
So what if the DA never prosecutes cases under a thousand dollars and often more. Stores can try locking merchandise up, they can install cameras, detain and call police. It won't work. Police are refunded and only respond to serious crimes. Often they don't respond to theft at all because they are instructed not to respond since the DA will drop all theft cases. Small businesses will close rapidly. Esp after Americans become homeless. A illegal who's homeless knows it's temporary. An American knows it's permanent. Liabilities and lack of punishments are the issue. It's gotten out of hand. Business should be able to protect themselves without fearing a lawsuit. The criminals should face some sort of punishment. Half the time, it does not even go to court. They just drop it. Kids can steal in NY and cops don't even want to engage. It goes through family court and same thing just gets dropped. It's a lot of paperwork they don't want to do. Thankfully I think the retail theft push they have been doing lately is causing them to be much more serious about larceny. They are actually following up with arrests etc... before you would never hear about it. The problem still remains. Is the court actually going to do anything about it.
If they are afraid of lawsuits there must be a reason. We need some landmark cases that side with businesses in those situations to set a precedent. THEN they let you do your job because they know the law is on their side. Essentially a judgement of yes people are gonna be physically harmed if they wanna have a go at destroying business owners' lives.
@@andersonentwistle The issue is and I have seen this happen. People who use force in the wrong situation. I have personally watched videos of someone pushing a compliant 70 year old male to the ground. With that Loss Prevention does not make enough money. You usually end up with people who do not really have the head for it. At minimum wage you get minimum care and minimum thought. The best prevention is teaching employees techniques to use and what to watch for but that also requires that they also care. Depending on the place your only recovering usually a small percentage. So I think they gamble on having no loss prevention more often than not. A single lawsuit can get rid of all the recoveries and then some. How we deal with shoplifters needs a modern solution. Not saying they need to be arrested but they should have some kind of punishment. I think community service is the way to go. Pay back the city you stole from. Wash the sidewalks. Pick up the streets. Something positive for everyone involved. Obviously giving tickets for larceny is not working. Why do we keep doing the same things.

That would mean that every exploitative illegal action that falls short of attracting criminal prosecution is completely legal as long as the victim is a convicted felon.
And either way, federal case law has a history of valuing life and limb above property. Just read up on the famous supreme court case of the man who broke into an abandoned farmhouse and triggered a booby trap that blew his leg off with a shotgun shell when he opened a door and was awarded damages because the court reasoned that lethal / maiming automated traps are not a proportional response to break-ins when the absence of any occupants means the danger is solely financial, not physical.
Also yes, ironically, the farmer who set the trap would have been off the hook if he shot the burglar himself instead of via a trap, including if it were lethal. America is an insane place.

It has been proven that tough enforcement on petty crimes actually reduce serious crime. The trouble with NY and CA not treating shop lifting as a serious crime just encourages the criminals to do more serious crimes. oh man, cant believe it. between 2014-2018 I was a student in the States. I lived in the NYC mainly in 2014-2015. And I remember the Fulton street station was one of the best and cleanest stations in the city. there were many crimes going on at that time but nothing like what happens nowadays there. damn.
