Florida just passed a law that makes it a crime to squat or to offer a property you don't own for rent or sale. It also makes it a crime for a property owner to falsely accuse someone they rented to of squatting, to protect legitimate tenants. Squatters can be removed by the police pretty much immediately.
@@tizodd6 Technically it is breaking and entering, if you can prove they broke into the home in the first place. If you put up a no trespassing sign, you can get them for that too. The problem comes when you don't catch them for a long time.

I was reading about a house a foreigner bought in CA for $42 million. He had to hustle out of the country when he got caught scamming people. The bank put the house up for sale to recover money for those he scammed. Squatters moved in within a week and the bank could not get them out for months! By the time the recovered the house, so much damage had been done to the house it was valued at $4 million!

The sad thing is that poor woman will go through the court system for months, pay a lawyer, take time from work, and even if she wins, those squatters ,guaranteed ,will destroy her property, since there was no lease, how is she to collect for damages?

Florida just signed into law protecting homeowners from squatters. As of July 1, police can immediately remove a squatter from the property if he can’t show proof he rents there or the house is his. It’s also a felony if squatter causes more than $1000 in damage to property. All states need to enact this law.

Squatters are not tenants, so why does the NYC legal system protect squatters as if they are tenants. Even if the squatter lives in a property for more than 30 days, their mere entry is breaking and entering which demands punishment. The police must enforce breaking and entering laws as vigorously as squatters rights, if not more so, since squatter are not tenants.
My brother owns multiple rentals in New York. He's a great landlord and doesn't gouge people on the rent so he had little turnover. But what he does is when someone moves out his handyman moves in until it is rented. It's a new world out there.

I used to own eight buildings in New York City. I sold them in 2003.I never had problems squatters. I know my temper and I wouldn't tolerate squatters. I am so glad that I left New York State and the United States.
I sold all my rentals - they were nice places and I spent alot of time picking good people. I WOULD STILL have issues. Renting a basement when you also live there is a great way as a young person to build wealth, but once you move out, sell.
So true I live in Atlanta and they have been breaking into homes for sale with a fake lease they printed out and a single mailed letter and the police say it's a civil matter that takes MONTHS so the owners can't sell, can't rent, and when the court date comes the squatter trashes the place cause thousands in damage and leaves. Because of slumlords. One way tenants ensure that quality of life issues get fixed (ie plumbing, pests, ECT) is by refusing to pay rent until it's fixed. Slumlords use to lock tenants out of their apartments for nonpayment, saying that they're a squatter, meanwhile, have rats and roaches crawling all over the place. This happened a lot in the 1980s when NYC was controlled by the mafia and other crime lords.

I lived in NY in the 80's and 90's. I heard stories that people would find an empty apartment and make a lot of fake leases. They would hold an open house and "rent" the place, taking a 1 1/2 mo security deposit from several people. Terrible when they all showed up on the 1st :/

There's a guy in Southern California you can hire, who you give a lease to, and he will move in with the squatters. The theory is that both the squatter and the anti-squatter have rights that need to be sorted out in court, but that takes months. He makes life so miserable for the squatters (he stops bathing, he stays up all night, he invites friends over, he eats their food) that they decide to move out.

@@jashanestone NYC has some of the most relaxed squatter's rights laws in the country, it isn't the same everywhere, most places you just give them 30 days notice and they have to leave, whereas NYC evicting a squatter can take years.
I was a landlord in RI. I said was….this happened to me. Unfortunately the squatter died of an OD in the back bedroom two weeks before eviction court. He talked my son on the spectrum into getting in there. When my son wanted him out, he called the police. My son went into a meltdown and all of a sudden, there is a restraining order against my son and his “friend” lived therefore 4 months. I had to pay all the utilities. I’m selling. It’s not worth it anymore.
Florida just ended squatters rights. The rest of the country needs to follow suit. But IMO, if the squatters are here illegally, then that in itself should be a whole other charge.

During the pandemic you weren't allowed to evict tenants if they couldn't pay. I had a guy in my basement and he moved in a couple of months prior to the pandemic and the majority of the year he didn't pay and we couldn't legally kick him out. Turned out he was a pathetic drunk and would forget his keys and then forget his lock code after the lock was changed out due to him constantly forgetting his key and would pee literally right outside the door when he couldn't get in. The pandemic and shutdowns caused a lot of problems for a lot of people and squatting became too legal at that point so, don't judge anyone that has had to deal with horrible people like that.
unfortunately Texas has squatters right laws too. My family member lives in a low income apt complex. A squatter broken into apt, sent himself a letter immediately. He rents floorspace to friends so he can buy drugs. It's been a year bc eviction courts are backed up. Apartment complex can do nothing while they watch them tear the place up.

If you find SQUATTERS living IN YOUR HOME, what you have to do is: Wait till they’re not at your home. Write your friend a lease. Get your friend to go break into your house and move in. Then when the squatter tries to come back into your home, they will be breaking in. Your friend can then call the police and have the squatter arrested for breaking and entering. Your friend, as a tenant, will have more rights to your home than you will, as an owner.
I know of a guy that did that with 5 of his ol' Army buddies. These guys came in ate some food, drank some beer, put their feet up until the squatters had enough and finally moved out.
This has started happening in Atlanta as well because of TikTok people telling them how to show up print a fake lease so when you call the police saying someone broke into their house the police say it's a civil matter! And the legal process takes more than 30 days and now they have rights!! INSANE

My wife (the smart one in our house): "Why doesn't New York just require that a tenant/landlord agreements be registered with the city, with a start and end date? This removes the guesswork on the part of law enforcement, and could generate a little bit of revenue for the city. No matter how long the squatter has been there, if they are not recognized by the city as a "registered" tenant, they have to leave. There, problem solved!"

It is a good point that yet another bureaucracy is likely not a good idea in NYC. (One of the costs of too much government is the inability to convince the populace you need more government even if you actually do). Cash is correct, it’s complicated. In the meantime, don’t leave property unattended. That’s one of the reasons these laws exist in the first place.
Same story in Spain, there have been cases of old people who were at the hospital for surgery, and after only 2 weeks away they found out that their home was squatted. Squatters have more legal rights than owners. It's nuts!

Most people in New York are making $200,000 or more it's like I tell people it's not about how much you make it's how much your money buys. Making 20 bucks an hour in New York is poverty but making $20 an hour in some places is wealthy. But since federal tax laws are a blanket policy it doesn't take into account cost of living the federal tax brackets are across the board so the people making 200,000 which would be the equivalent of making 70 to 80,000 in other places are taxed much higher because of the federal tax brackets.

Former rental property manager here. In most states there are specific laws protecting both renters and landowners. What the hell is New York doing? Wow.
Im from Germany, we have clear documentation on such things. Both parties have documents, if someone claims they own a place or living at a place, that can be clarified with a call and your ID. So this whole squatter thing looks crazy to me.

We have been dealing with this situation in Spain for years. Actually in my country, if you decide to cut the electricity and water supply from the apartment it's considered coercion and you get arrested and 2 years of prison, same happens if you go into your home and change locks. But the worst thing it's in Spain trials to kick squatters out take between 5 to 8 years to happen, so you need to pay mortgage, taxes and bills during all these years. A complete nightmare!

About 7 years ago I owned a condo in Brooklyn. My neighbor had a relationship with a guy who lived with him for a year and when the relationship ended the guy moved out but then returned a week later and camped out in our basement. When I told him to leave he refused so I called NYPD and they arrived within minutes, arrested the guy and I never saw him again.
thats crazy. In my country if you dont have a legal written contract the owner of the building can simply call the police - who will then evict the squatters with as much force as needed.

I refuse to be acting like a criminal regardless of what the laws are. I live an hour north of Albany, NY and got hit by a car and couldn’t work. I was disgusted that my county told me to use squatters rights instead of giving me any needed assistance to keep my apartment and have food. There’s something wrong with the system and process if taking advantage of a landlord if the best option that an official COUNTY WORKER could give me. I’m fortunate that my job starts back up soon and can support myself again regardless of my injuries.

Mind you I had doctors notes that I couldnt work as well. My main concern about it, is that it is a primary option to use that was told to me by a case worker in my county. I don’t think taking advantage of anybody should be an option, let alone one brought forth by county workers.

Tip: Burglar Alarm will prevent squatters. Florida just passed a law that gives police the right to immediately arrest squatters and criminally charge any trespasser with a felony for any intentional damage and issues a misdemeanor charge for falsifying a lease.
The laws were terrible here in Florida until DeSantis just changed them I had a terrible experience years ago, I had no rights, squatters had all the rights could even turn in utilities in my name. There was no help from the police or the county yet I was held responsible for anything they did and they were drug addict losers. I gave up rentals after that.
I remember another landowners soultion was to squatting the squatters by leasing the place to her son, moving in when squatter left and claiming tenant rights when they got back. Squatter couldn't prove anything, so they left.

I found this guy in L.A. who squats on squatters. He gets the landlord or owner to write him a lease, then he just moves in and puts up cameras and live streams until they leave or wanna go to court and prove their a legal tenant. This way its not a landlord tenant issue, instead it becomes a tenant on tenant issue and the real tenant gets to use all the resources available to tenants on the squatter. The law does need to change but this works pretty good. As the squatter squatting on the squatter he can even change the locks to access the property if the squatter changes them where a landlord cannot. You definitely want security cams, then they can be arrested when they access the property to begin with

@@AckzaTV I believe there was a recent incident at the end of March of a woman who was found stuffed in a duffel bag after she discovered 2 people squatting in her late mother's apartment while she was out of country for about 3 - 4 months. Sad part is that the building technically doesn't have a front door. You key yourself in via the elevator. Cash should have mentioned this story too.
Squatters includes relatives of a tenant who visit and stay. It took me over a year going to court with a lawyer to “evict” the squatters of my senior tenant who passed soon after they came. I could not turn off any utilities or change the locks! They lived for free during that entire time. I still had to pay the mortgage and all utilities which put me into debt. They moved when they felt like it and I still had to wait 30 days more because they did not give me the keys. Of course the lawyer and the police had to be called for my evidence just in case they returned in the future. Squatters also include friends or family who stay and visit for 30 days or more and refuse to leave. Owning a home makes you a landlord which is considered a business!
I'm not calling anyone but some close friends to take care of me and my home. This truly enrages me the gall of someone coming in your home and trying to take it from people!

In this actually you don't own the property you are renting it, and would be charged as the property owner the complex has clearly evicted you illegally, and moved a new tenant in without informing you. My aunt and uncle squatted in a house that belonged to my mother. I’d already lived in it and paid her rent for 10 years but we had to leave for a bit. I had POA because mom had dementia. They then kidnapped her and held her in the house. Wouldn’t let her see a doctor or senior services workers. Wouldn’t let her use the phone or leave her room. Cops were like 🤷🏽. Took me five years to finally get all the right people to listen and by then my mom was dead. I took them to court. Jury awarded me 420k. I knew I’d never see it. Then the judge made ME pay THEM 30 thousand dollars to gtfo of the house. I should have taken care of it myself.
I would have but in a very private way after taking mother, as they would never be around to do anything because they would not know who did anything to them. You went with today's legal system that no longer sane or just as it costs too much in money and time to just be screwed in the end!
My uncle, here in TN, was recently targeted by squatters, also. They won’t leave and the only way for police to evict them is to file a claim in court ….he is still liable for their water and electricity bills ….. Crazy world we live in

In LA I had a squatter changed locks, waited for him to come out, a baseball bat, and a friend to throw all his crap out on the street while I dealt with him one blow to legs "when he came at me, of course" finished him off he tried to call the cops while his shit was in the street I said he tried to burglarize my house, I showed tax bill I had with with my name on it, he got arrested for burglary probably was out in 24hrs but end of story no attorney's involved!

I've heard alot of crazy squatter stories. A few years ago squatters moved into a very expensive house, something like $2 million dollar house, that was still on the market. It took 2 years to get them out. When the owner was finally able to get them out and gain re-entry back into the home, the squatters had poured concrete into every toilet, down every tub and shower drain. The house was built on a concrete slab. The owner had to dig up the concrete floor to gain access to the drainage pipes, some of it even getting into the septic system. It cost them almost a half a million dollars just to repair the damages. When it was finally sellable again, the owner was only able to get back a small portion of what he had to pay to repair the place, he couldn't raise the price of the property to get back what he invested in the property because of the comps. This all is a nightmare indeed!!

Property taxes has to paid no matter what, but if a landlord isn't getting rent then they aren't paying taxes on that income so you'd think that if a landlord isn't getting rent from a renter, the government would be more motivated to get those renters out so that the landlord can get renters in there that will start paying rent again so the government can start getting those taxes again.
I'm in GA and manage apartments. I don't even know if it is 30-days, because residents have called the police to get someone out of their apartment and the police will do nothing if they claim to live there. I got into it with the police when I was called on a Saturday night while on vacation, because they refused to arrest someone in a unit. I told them the rightful leaseholders are not home owners, that the building belongs to the investors, and we are required to do a background check on each leaseholder prior to move-in to protect our residents. Still they did nothing. Good thing we have smart locks, because when the person left for the day, the leaseholder changed the door code, and the 'squatter' could not gain access again. The leaseholder moved out, but the unauthorized occupant still tried to gain access on the move-out day. At that point we took possession of the unit, but it has been a struggle regardless of the county I've worked in over the past 20 years. "Squatters rights" is an absolutely obscene law that has no place anywhere! The police will arrest you for setting up a tent in the woods, bothering nobody. But allow you to steal someone's home!
Florida just passed a law that makes it a crime to squat or to offer a property you don't own for rent or sale. It also makes it a crime for a property owner to falsely accuse someone they rented to of squatting, to protect legitimate tenants. Squatters can be removed by the police pretty much immediately.

@@tizodd6 Technically it is breaking and entering, if you can prove they broke into the home in the first place. If you put up a no trespassing sign, you can get them for that too. The problem comes when you don't catch them for a long time.

I was reading about a house a foreigner bought in CA for $42 million. He had to hustle out of the country when he got caught scamming people. The bank put the house up for sale to recover money for those he scammed. Squatters moved in within a week and the bank could not get them out for months! By the time the recovered the house, so much damage had been done to the house it was valued at $4 million!

Florida just signed into law protecting homeowners from squatters. As of July 1, police can immediately remove a squatter from the property if he can’t show proof he rents there or the house is his. It’s also a felony if squatter causes more than $1000 in damage to property. All states need to enact this law.

Squatters are not tenants, so why does the NYC legal system protect squatters as if they are tenants. Even if the squatter lives in a property for more than 30 days, their mere entry is breaking and entering which demands punishment. The police must enforce breaking and entering laws as vigorously as squatters rights, if not more so, since squatter are not tenants.

My brother owns multiple rentals in New York. He's a great landlord and doesn't gouge people on the rent so he had little turnover. But what he does is when someone moves out his handyman moves in until it is rented. It's a new world out there.

I used to own eight buildings in New York City. I sold them in 2003.I never had problems squatters. I know my temper and I wouldn't tolerate squatters. I am so glad that I left New York State and the United States.
I sold all my rentals - they were nice places and I spent alot of time picking good people. I WOULD STILL have issues. Renting a basement when you also live there is a great way as a young person to build wealth, but once you move out, sell.

The theory is that both the squatter and the anti-squatter have rights that need to be sorted out in court, but that takes months. He makes life so miserable for the squatters (he stops bathing, he stays up all night, he invites friends over, he eats their food) that they decide to move out.

@@jashanestone NYC has some of the most relaxed squatter's rights laws in the country, it isn't the same everywhere, most places you just give them 30 days notice and they have to leave, whereas NYC evicting a squatter can take years.
I was a landlord in RI. I said was….this happened to me. Unfortunately the squatter died of an OD in the back bedroom two weeks before eviction court. He talked my son on the spectrum into getting in there. When my son wanted him out, he called the police. My son went into a meltdown and all of a sudden, there is a restraining order against my son and his “friend” lived therefore 4 months. I had to pay all the utilities. I’m selling. It’s not worth it anymore.

During the pandemic you weren't allowed to evict tenants if they couldn't pay. I had a guy in my basement and he moved in a couple of months prior to the pandemic and the majority of the year he didn't pay and we couldn't legally kick him out. Turned out he was a pathetic drunk and would forget his keys and then forget his lock code after the lock was changed out due to him constantly forgetting his key and would pee literally right outside the door when he couldn't get in. The pandemic and shutdowns caused a lot of problems for a lot of people and squatting became too legal at that point so, don't judge anyone that has had to deal with horrible people like that.

If you find SQUATTERS living IN YOUR HOME, what you have to do is:
Wait till they’re not at your home. Write your friend a lease. Get your friend to go break into your house and move in. Then when the squatter tries to come back into your home, they will be breaking in. Your friend can then call the police and have the squatter arrested for breaking and entering. Your friend, as a tenant, will have more rights to your home than you will, as an owner.

It is a good point that yet another bureaucracy is likely not a good idea in NYC. (One of the costs of too much government is the inability to convince the populace you need more government even if you actually do).

Most people in New York are making $200,000 or more it's like I tell people it's not about how much you make it's how much your money buys. Making 20 bucks an hour in New York is poverty but making $20 an hour in some places is wealthy. But since federal tax laws are a blanket policy it doesn't take into account cost of living the federal tax brackets are across the board so the people making 200,000 which would be the equivalent of making 70 to 80,000 in other places are taxed much higher because of the federal tax brackets.

We have been dealing with this situation in Spain for years. Actually in my country, if you decide to cut the electricity and water supply from the apartment it's considered coercion and you get arrested and 2 years of prison, same happens if you go into your home and change locks. But the worst thing it's in Spain trials to kick squatters out take between 5 to 8 years to happen, so you need to pay mortgage, taxes and bills during all these years. A complete nightmare!

About 7 years ago I owned a condo in Brooklyn. My neighbor had a relationship with a guy who lived with him for a year and when the relationship ended the guy moved out but then returned a week later and camped out in our basement. When I told him to leave he refused so I called NYPD and they arrived within minutes, arrested the guy and I never saw him again.

I live an hour north of Albany, NY and got hit by a car and couldn’t work. I was disgusted that my county told me to use squatters rights instead of giving me any needed assistance to keep my apartment and have food. There’s something wrong with the system and process if taking advantage of a landlord if the best option that an official COUNTY WORKER could give me. I’m fortunate that my job starts back up soon and can support myself again regardless of my injuries.

Mind you I had doctors notes that I couldnt work as well. My main concern about it, is that it is a primary option to use that was told to me by a case worker in my county. The laws were terrible here in Florida until DeSantis just changed them I had a terrible experience years ago, I had no rights, squatters had all the rights could even turn in utilities in my name. I found this guy in L.A. who squats on squatters. He gets the landlord or owner to write him a lease, then he just moves in and puts up cameras and live streams until they leave or wanna go to court and prove their a legal tenant. This way its not a landlord tenant issue, instead it becomes a tenant on tenant issue and the real tenant gets to use all the resources available to tenants on the squatter. The law does need to change but this works pretty good. As the squatter squatting on the squatter he can even change the locks to access the property if the squatter changes them where a landlord cannot. You definitely want security cams, then they can be arrested when they access the property to begin with

@@AckzaTV I believe there was a recent incident at the end of March of a woman who was found stuffed in a duffel bag after she discovered 2 people squatting in her late mother's apartment while she was out of country for about 3 - 4 months. Sad part is that the building technically doesn't have a front door. You key yourself in via the elevator. Cash should have mentioned this story too.
Squatters includes relatives of a tenant who visit and stay. It took me over a year going to court with a lawyer to “evict” the squatters of my senior tenant who passed soon after they came. I could not turn off any utilities or change the locks! They lived for free during that entire time. I still had to pay the mortgage and all utilities which put me into debt. They moved when they felt like it and I still had to wait 30 days more because they did not give me the keys. Of course the lawyer and the police had to be called for my evidence just in case they returned in the future. Squatters also include friends or family who stay and visit for 30 days or more and refuse to leave. Owning a home makes you a landlord which is considered a business!
I'm not calling anyone but some close friends to take care of me and my home. This truly enrages me the gall of someone coming in your home and trying to take it from people!

My aunt and uncle squatted in a house that belonged to my mother. I’d already lived in it and paid her rent for 10 years but we had to leave for a bit. I had POA because mom had dementia. They then kidnapped her and held her in the house. Wouldn’t let her see a doctor or senior services workers. Wouldn’t let her use the phone or leave her room. Cops were like 🤷🏽. Took me five years to finally get all the right people to listen and by then my mom was dead. I took them to court. Jury awarded me 420k. I knew I’d never see it. Then the judge made ME pay THEM 30 thousand dollars to gtfo of the house.

In LA I had a squatter changed locks, waited for him to come out, a baseball bat, and a friend to throw all his crap out on the street while I dealt with him one blow to legs "when he came at me, of course" finished him off he tried to call the cops while his shit was in the street I said he tried to burglarize my house, I showed tax bill I had with with my name on it, he got arrested for burglary probably was out in 24hrs but end of story no attorney's involved!

I’m so happy I sold my house 3 yrs ago and made $$$. The house is located in an area where squatters (and some local cops) are carrying out illegal activities.
I've heard alot of crazy squatter stories. A few years ago squatters moved into a very expensive house, something like $2 million dollar house, that was still on the market. It took 2 years to get them out. When the owner was finally able to get them out and gain re-entry back into the home, the squatters had poured concrete into every toilet, down every tub and shower drain. The house was built on a concrete slab. The owner had to dig up the concrete floor to gain access to the drainage pipes, some of it even getting into the septic system. It cost them almost a half a million dollars just to repair the damages. When it was finally sellable again, the owner was only able to get back a small portion of what he had to pay to repair the place, he couldn't raise the price of the property to get back what he invested in the property because of the comps. This all is a nightmare indeed!!

Property taxes has to paid no matter what, but if a landlord isn't getting rent then they aren't paying taxes on that income so you'd think that if a landlord isn't getting rent from a renter, the government would be more motivated to get those renters out so that the landlord can get renters in there that will start paying rent again so the government can start getting those taxes again.

I'm in GA and manage apartments. I don't even know if it is 30-days, because residents have called the police to get someone out of their apartment and the police will do nothing if they claim to live there. I got into it with the police when I was called on a Saturday night while on vacation, because they refused to arrest someone in a unit. I told them the rightful leaseholders are not home owners, that the building belongs to the investors, and we are required to do a background check on each leaseholder prior to move-in to protect our residents. Still they did nothing. Good thing we have smart locks, because when the person left for the day, the leaseholder changed the door code, and the 'squatter' could not gain access again. The leaseholder moved out, but the unauthorized occupant still tried to gain access on the move-out day. At that point we took possession of the unit, but it has been a struggle regardless of the county I've worked in over the past 20 years. "Squatters rights" is an absolutely obscene law that has no place anywhere! The police will arrest you for setting up a tent in the woods, bothering nobody. But allow you to steal someone's home!
