    Broseph, I've been to Memphis and my buddy went to medical school there. So, the southern food is probably decent there but the only tradeoff is to personal safety. No joke.

    Hi Vince, I’m wondering how to have a frank conversation with my attorney about settlement offers w/o being an asshole? He wants me to settle for a number that would put less $$ in my pocket than what I’ve accumulated in lost wages-and would completely ignore the extreme pain & suffering (which includes ptsd with physical manifestations, severe depression, anxiety, etc.) I’ve endured. I don’t think he’s gone through the evidence I provided him-and organized with a beautiful spreadsheet-post-mediation to prove the employers arguments are lies. Plus, the office secretary told me the law office may be closing soon adding, “there’s a lot going on right now.” I fear he wants a quick pay day, but I want to give benefit of the doubt and not be rude or unreasonable when he’s advising me to settle. What are some ways to engage in a productive convo about settlement offers? What are ways to politely push back?

    Hi Vince, could you talk about Civil RICO in employment cases? My employer committed 4 criminal offenses against me (from the exhaustive list in RICO) and I would like to pursue both civil RICO based on that plus discrimination and retaliation according to my ongoing EEOC process. I don’t have representation yet.

    My evidence is text too. In mediation we offered 200k plus my job back. They countered 1800 and my job back. My lawyer rejected it. Going into investigation phase. They have 30 days to provide an answer. What does the answer contain?

      The answer will basically be the reasons the employer thinks that they are not liable for the allegations contained in the original complaint.

    What jurisdiction should I file if the corporate headquarters are in Minnesota, the manufacturing facility is across the Red river in North Dakota. I was living in Minnesota when I was wrongfully terminated from the plant in North Dakota. After I lost my job I had to find the cheaper apartment across the river in North Dakota and changed my driver's license to North Dakota. So, the unlawful event happened in ND, while I was citizen of MN and worked on the plant located in ND, with official headquarters located in Minnesota. Now I'm citizen of North Dakota. The controversy is less than $75,000. I don't want to file in Federal Court.

      I believe it would be the court which has jurisdiction over the plant in ND where you were terminated.

      Make sure a defense attorney team cannot connect your details to you and read along. If they know you don't want to file in Federal Court, your settlement just got way lower, or worse, down to zero. Wishing you well.

    I was harassed mercilessly in the 80s. Even wrote a letter to my boss - but no help. Things were different then.

    Hey it’s me again I have one more question for you I just received an email from the mediator telling me what my mediation date will be and he ended his email with I am more than willing to relay a demand to settle this charge in advance of the mediation date And my question to you is that a good idea? Because I believe it gives the other part a chance to run after hearing the demand before I can speak with them what do you think?

    The last part of this video is very helpful on what the defense attorneys see when they see a pro se. There's a lot of reasons that I didn't know about that having an would attorney help with. Or be extremely well prepared and follow up on each step. Thank you Vince!

    Is it good for the mediator to tell you to stay with in range of 30k-75k when the employer is 100-500 plus employees there cap is 300k

    You should’ve went to lock heart , tx , for bbq . Plus you should’ve gotten round rock donuts . The best donuts in the world . Back to bbq Weimar , tx , there sausages people come out of state to buy . You bbq them at home best sausages you will ever buy . Ask a Texan where to go for the best food .

      I raise my own 🐖 for sausage, so I'm skeptical that theirs are better but I'm down to give it a try. I'll make the trip next time I'm in Texas. It is a great State, just didn't think the Austin food scene was very tasty.

    If an attorney says he wants 40% because said he filed suit, before the increase to 40% should you ask to see the suit filed?

    Do large corporations shy away from mediation? I mean if they are in the right, you'd think they'd want to go this way.
