As a single black mom I’ve had to take money out of my 401K yearly since the pandemic. Was let go from my job and inflation- I get triple taxed for withdrawing early (20% from the investment company, an addl 10% when I file taxes and I have to claim as income when filing taxes. Where is the crime? Why is this not shut down already?

She kept changing her reason for withdrawing the money and even transferred money into her daughter’s account and had her husband transfer it back to her. Only if she repents before God. You’re hearing a partial truth. She did not get convicted for taking her own money out of retirement... she was convicted on 1 count of perjury for Lying!! She abused the terms of the federal CARES act during the pandemic by claiming that she was under undue hardship while making $265,000 a year for her salary as state's attorney here in Baltimore city. She was also convicted on 1 count of mortgage fraud for lying on the application. She lied about being under financial hardship, took her $80K in retirement without facing the 10% early withdrawal penalty fee and then went and BOUGHT two million dollar condo's in Florida. It has nothing to do with her work against police brutality, rather, her own greed.

Martha Stewart was involved in insider trading, lied about it and was eventually convicted, yet she was released after spending only 5 months in prison.

When you get a mortgage there are specific rules where you can get money from. My mortgage broker was very intentional about us being able to track the money and verifying seasoning so that we did not get into trouble. As an attorney she should have known better. When you try and be sneaky you get yourself into trouble. When you have enemies and a high profile you have to be above board in all things. But I guess she really wanted that vacation home.

She lied not to pay the 10% penalty. I don’t agree with the times she’s facing but she did appeared to have lied. These stance was already litigated twice.
Usually a hardship is someone that needs the money because of a situation that has a negative financial hardship. Loss of Income, sickness, death, etc. She should just have to pay the penalty not 40 years. You can gift money up to a certain amount per year; but, I don't know if you can do that for a mortgage or purchase of real estate, I must be missing something.
One thing I always can't shake is the entire picture of a situation and her part in what's going on is her version of part of the matter that we are hearing,it's only a part. Only God really knows the real truths from beginning to end. Lord God if this lady is 100%true, let not these formed weapons prosper,let them fail and if this is a reaping of seeds sown, have mercy ,grace, and favor on this lady. 401(k) Withdrawals: Penalties & Rules for Cashing Out a 401(k)
You can make a 401(k) withdrawal at any age, but doing so before age 59½ could trigger a 10% early distribution tax, on top of ordinary income taxes.
Some reasons for taking an early 401(k) distribution are penalty-free, such as a hardship withdrawal or if you leave your job.
Converting a 401(k) to an IRA could be a way to keep your funds and avoid the early distribution penalty.
And jail time is no where in there!!!

She may not get the maximum sentence, but as a lawyer, lying about being under financial hardship, as a jury of her peers found her to be, is a big no no and she should/does know better.

She applied to withdraw from a federal program TAX FREE, signing that it was due to a hardship, when her pay hadn't decreased at all, actually it increased during that time. And, she also lied that the properties she purchased were for her personal residence, when they were investment properties. And, she lied on mortgage applications about her finances and not being truthful about taxes owed to the IRS. 40 years is excessive punishment, but she has to take accountability. She overcharged people she prosecuted, and she should have known to watch her step because of it. This is karma. She got greedy when she thought nobody was watching. If I were Biden, I'd wait to see the length of her sentence, wait until she serves a small part of it, and then pardon her after she does a little time. She is still in denial about whether she did anything wrong.

I feel horrible for what she has gone through. I wonder if it is possible that she couldve created her own entity& transferred her 401K into a ROTH under her own corp? Or borrowed against her 401k to invest in massive commercial assets or a significant asset syndication?
The story of our people being targeted for doing the right thing is ancient. Prior to choosing this, one should always hope for the best but STAY ready for the worst, so one doesn't have to get ready.
I will NEVER understand why our people have no clue that they will be targeted(or even worse)when they do the right thing... especially when it involves stepping on the toes of the "old boys network". We all know they're going to come for them like MLK, NIPSEY, JOHN LEWIS,

Just watched this video and googled the case. I’m so glad she was not sentenced to prison but this whole case is a disgrace. I pray the Lord restores EVERYTHING the Enemy stole from her! So let’s be clear. We know the law as it relates to real estate. you cannot use money from your retirement for the purpose of buying real estate, it’s against the law and you can be prosecuted and found guilty now I don’t want her to go to jail, no but if you do wrong, just know it can come back to the bite you and they may not get 50 other people, but they can get you. so you have to do l the right things all the time as much as you can
This is how I understood the charges against her, which explains why she was found guilty. That said, to sentence her to forty years would be a miscarriage of justice.
It’s more to it. She also transferred money to her daughter’s account and asked her husband to transfer it back to her. All the while having a 45k lien on her house. Many Baltimore city residents are happy to see her gone. Judge Joe Brown reviewed her case. You’ll get the truth from him not this one sided mess.
FYI, I cashed in an old 401k account from a previous employer to purchase my primary residence. Because I was not 59 1/2 , I had to pay a penalty on my tax return that year, but my childcare and other deductions broke even that year. I understand Marylin was trying to get ahead/generational wealth, but she have to do things the RIGHT way…

@@THEREALSOURCE That’s not what happened. This TH-camr needs to take this video down because it is inaccurate. She did not get convicted for taking her own money out of retirement... she was convicted on 1 count of perjury for Lying!! She abused the terms of the federal CARES act during the pandemic by claiming that she was under undue hardship while making $265,000 a year for her salary as state's attorney here in Baltimore city. She was also convicted on 1 count of mortgage fraud for lying on the application. She lied about being under financial hardship, took her $80K in retirement without facing the 10% early withdrawal penalty fee and then went and BOUGHT two million dollar condo's in Florida. It has nothing to do with her work against police brutality, rather, her own greed and impatience.
Ms, Mosby is a lioness. Smart and courageous and deserving of our love and support. I'm from Baltimore and can vouch for her as a beautiful person.
