If you have money/power or both all courts are under your pocket. But a poor innocent charged under a false case may die inside the jail without any hearing. Hence corruption is spreading like a cancer in democracy.
It is very simple. The Law as it stands today says, the accused has to show his innocence. Now, the accused gives some justification, hereafter, it should be for the ED to provide incontrovertible evidence to disprove the accused. Unless it does the same within a prescribed time, the case should be dismissed and the prosecuting officer should be charged for illegally curtailing the fundamental rights of a person and also for maligning his image in the society. This is a very harsh statement, but it is necessary because ED is working as a department of the ruling Political party and not as a Constitutional authority. Similar action may also be considered for other Constitutional authorities, irrespective of who they are, because at the end of the day, no one should have a right to trample the Constituion and walk away as if nothing has happened.
Then what about judges wantonly giving long adjournments and delaying case .Shoukd they not be punished .Can they issue bail with out expiry date .There are criminals like Sonia and Rahul Gandhi who are on bail for the last 15;years .if they are put in jail in their own interest they will seek quick hearing of the cases .If they are on bail they will not bother
