Differentiate the statement of an accused under section 342 and 340(2), CR.P.C Also indicate effect of not offering the question by court to an accused to appear under 340(2) , CR.P.C. While recording his statement under Section 342, CR.P.C.??

The statement 342 of cr.PC is compulsory.
The statement of 340(2) is optional.
The statement of 342 can be recorded at any stage of inquiry or trial,but generally it is recorded after the completion of prosecution evidence.
The accused is asked in the statement of 342 that he want to give the statement of 340(2).
The statement of 342 is recorded without oath.
The statement of 340(2) is recorded with oath.
The statement of 342 is without cross - examination
The statement of 340(2) is cross examined
The whole prosecution evidence is put on the accused in a small portion in the statement of 342.
The statement 340(2) it is recorded in the whole.
it is mandatory under the provision of section 364 that every question put to him (accused) and every answer given by him shall be recorded in full....
"it is the requirement of law that statement of accused record u/s 342 Crpc should be got signed/thumb marked by the accused.this mandatory provision of section 364 if not complied with amounts to an illegality and not irregularity curable u/s 537 Crpc...

Examination of accused under section 342 Cr.P.C. is not a mere formality but a mandate to enable the accused to explain any circumstances appearing against him in the prosecution evidence
PLD 2001 SC 568
law requires that every part of incriminative evidence, circumstances, fact, weapon of crime, motive, plea of self defense etc, sought to be used against him (accused), should be put to the accused u/s 342 Cr.p.c. for having his explanation

Unless a circumstance sought to be used an accused is put to him under this section, it cannot be used against him.
