Discharge of Accused u/s 63, 169 & 173(3) Cr.PC & Difference of ACQUITTAL & DISCHARGE Muneer Sadhana

In this video, Advocate Mr. Muneer Sadhana explains the concept of Discharge of Accused, in the light of sections 63,169 and 173(3) of Cr.PC when the Investigative Officer considers that there is not sufficient evidence, or reasonable ground or suspicion to justify the forwarding of the accused to a Magistrate. He also explains how Discharge of Accused is different from ACQUITTAL of Accused and the Court can summon accused discharged under S. 169 to stand trial if the evidence, in court's view, establishes a prima facie case against him.

Very informative and well organised and covers everything beautifully....
Sir i need some guidance if a accused which was not nominated in the case somehow police says he's the accused and then declare him innocent in the diary by himself
Later everything came on the table there was an involvement of a lot of people, bribery, rigging and what not .......and +point is that person not came in investigation once.....
just one thing that happened was he himself appeared for pre arrest bail and the complaint's advocate said he is not the actual culprit we haven't nominated him nor he's the actual culprit rather he is trying to screen out the real culprit
and at that time he confesses that i was not the one but that was my community born.....
and mashallah that judge was their advocates bestest friend he didn't write his statement in the papers
Sir, tell me like that person is proclaimed offender now .... how much punishment minimum to max he can get

I would like to disagree with you sir, with due respect and please guide me if I am wrong.. Section 173(3) of Cr.P.C is not related to discharge of accused. It is basically the discharge of sureties. an accused cannot be discharged u/s 173(3) at all. it is the sureties who have given bonds during investigation are discharged.
