      You are so right, and I agree, but the taxpayers, as members of the voting public in this jurisdiction, are responsible for allowing police and elected officials to behave this way. They could remedy their legal liability by voting the corruption out and demanding law enforcement act within the confines of the Constitution. They could further vote to remove qualified immunity for law enforcement officers and not indemnify officers if sued. That could force law enforcement officers or their unions to pay for malpractice insurance.

      I can think of another radical yet *far more effective* solution.
      It is a conflict of interest to allow “net tax consumers” (those either *paid* with tax revenue or receiving any form of government funds greater than they pay in tax revenue) to vote.
      Therefore, allowing *only* net tax *producers* the right to vote, this type behavior would stop almost *overnight*

      I was arrested for a traffic stop, which resulted in a traffic warning. I submitted a FOIA request 3 days after the original traffic warning and never received a response. 22 days after the traffic warning I submitted a second FOIA request along with an officer complaint form. It was then that I was informed of a warrant for interference stemming from the original traffic stop. Fighting criminal charges now.

      It is hard to find local or state attorneys to take cases that affect the government officials that they may deal with in their practices. That was my experience when I tried to enforce a foia violation.

      It can be very costly to NOT take a settlement. There is a federal rule regarding the refusal to accept a a settlement offer. If a plaintiff refuses a settlement and later wins at trial, but the trial award is less than the refused settlement offer, the plaintiff becomes liable for all costs that the defendant incurred after the settlement offer. Consider that a gov't agency can throw tens or hundreds of thousands of dollars to defend against a lawsuit. All they would have to do is get a judgement $1 less than their settlement offer and then he would have to pay all of their costs.

    I grew up in Erie County and Chautauqua County, and I can say in my experience this is exactly what you can expect in 90 percent of the encounters with law enforcement. There are great officers ( Had a state trooper as a teacher in college and he was amazing! Easy going and kind.) But the majority are completely ego driven and unable to admit to their mistakes. In fact doubling down or trying to lie to make whatever fit. Truly sad and it's just another divide between the police and the people they are supposed to protect.

      That doesn't matter as much due to being able to appeal the decision. It does waste the civilians time and money though. I find local level judges tend to rule against civilians as they seem to think qualified immunity is a bulletproof defense. Many lawsuits against police, government, etc, tend to be appealed to get the district level judge to follow the correct laws.
