So now im gona follow you step by step as i write out the letter to send them asking for verification and declaration of documents.. Then ill be able to have my own template to use for any other collectors that may come..

Now Lovell has bought the account and have written to me. I briefly wrote: We have no intention of entering into contract for any goods or services… Any further correspondence along these lines will be deemed as attempts for unlawful enrichment under the Goods and Services Act 1974. We consider this matter closed…etc All rights reserved etc I also made copies of the documents and returned theirs. This gave me two years of freedom before Hoist sold it to Lovell. Does their claim get weaker if it is passing from one company to another? Peter
I'm not familiar with laws in the UK, but here in the US I wouldn't say it gets weaker because none of the debt collector’s have a contract with you when it's sold to them. But unfortunately, those same steps would have to be taken each time the account is sold to a new company.
@@staceyownsnothing Thanks. We do have some so called laws that could help. Data protection laws limit what personal data can be shared (but this is what they do). As I overstand it, the Bills of Exchange act, section 23 limits what a third party can do. My own view is that I have no contract with Lowell and therefore no obligation. Keep strong. Peter
Hi @petermccarthy4525 would you mind forwarding me a copy of the letter you sent. Removing all your personal info. I’m a UK resident trying to get these debt collectors off my case. I’m just a bit lost on what to say! Most people give the advice to just ignore them but that hasn’t helped either.
@@Scorpiogodess Hi. I can’t give legal advice but feel free to mull over what I say. I don’t know your situation. Presumably you have debt collectors approaching you. Don’t ignore the letters. Look at them. Are there qr codes? Has the flyer been signed? Are they talking about taking you to court? Keep writing to them. Ask them questions. Don’t ignore letters. Ask them if the original agreement was insured. Ask if they have the original. If they bought your debt ask how much they paid. Explain to them that you only pay if you have a contract (you won’t with a third party). Remember, you can agree with them, on condition that they give evidence that you are liable; and this means that you are not in dispute and it is not a matter for the court. Best Peter
What if you called the debt collector in naively and admitted to owing the debt and tried to negotiate a payment but have not agreed to pay any amount?
Great video! I sent a dispute letter to Midland. When they responded some of the info they sent was incorrect. I never heard from them again. Now a year later I got a letter from a local law office ( that stated it was a debt collector). They sent a form with an option to pay or dispute. Is Midland just trying to scare me or should I send a dispute to this lawyer debt collection company? I’m thinking they are making another attempt because it’s tax refund time but I don’t want to fall for any of their tricks!
These companies will continue to sell the alleged debt to different companies so that's normal. Definitely send a letter asking for verification and proof of a contract between you and that company/law firm. If you don't respond to their notice they will 'assume' the alleged debt is valid and then they can attempt to pursue further collection. You want to handle it as soon as possible.
I don’t understand, if a bank has already charge off my debt , got a write off .. how are they still able to sell out debt to someone else .. how do we , even try and figure out , if the debt has been too old .. mines been since Covid 2020 .. but think California is 4 yrs .

They sell the debt, but there really isn't one. The debt collections are just after your money for a debt that doesn't exist anymore!
