Israel defends itself against genocide case brought to ICJ by South Africa

  • Israel will present its arguments during a public hearing at the International Court of Justice (ICJ) initiated by South Africa. South Africa accuses Israel of committing actions in Gaza that are "genocidal in character". South Africa is urging the court to declare that Israel “has breached and continues to breach its obligations under the Genocide Convention", to order Israel to cease hostilities in Gaza, to offer reparations, and to provide for reconstruction of what it has destroyed in Gaza.

Where were they when there was genocide in Syria, Yemen, and in every country where the religion of Islam rules, including South Africa??? No one has said a word so far! Just shocking.     Both yesterday's and today's arguments were each 3 hours long and it's clear the vast majority of commenters haven't listened to them, at least in their entirety. It is a time commitment, but essential to understanding this case.

      Don't forget reading the South African written statements submitted. I haven't been able to find the Israeli ones (if there are any).
      What I can say is that South Africa's arguments are pretty.... bad. They don't make sense in terms of the law, prima facie they have not disclosed the requirements for finding genocide (frankly, I don't think they disclosed a reasonable cause of action to go with their claim), and it was not well argued.
      It's pretty laughable

    This should have been decided on Syria, Sudan, Rwanda and other countries that witnessed such atrocities as a lead example on the court ruling, otherwise the outcome may not impact decisions taken by aligned members.

      The Israelis making a mistake with friendly fire and unintentionally killing hostages will not strengthen this case. Battles in a war are unlike most people can imagine. There is "The Fog of War"! When you are fighting there is a level of chaos, confusion, emotion and often one's values and being are challenged to the core. Mistakes can happen due to plenty of factors like poor visibility, momentary panic or a host of other factors.

    The resources used by SA was all from the UN agencies and independent journalism whereas IL presented only their own resources or the genocide supported the USA. So who should one trust: Those presenting UN evidences? Or those who brought their own made evidences?

      We've (our governments at least) not questioned much of what Israel does before. Not really. They've never had to have a strong argument, up till now, so it's unsurprising they don't have one here.
      Since it can't plausibly be argued that they (Israel) won on merit,, I'm interested to see how the court will rule on the matter.

      I'm not really expecting it to get any better, but at the same time I am quite _genuinely_ shocked at how bad Israel's defense is thus far. I'm not saying that for rhetorical effect, I literally mean that what I've heard thus far vividly confounds my very real expectation that I'd at least hear something that rises to the level of the superficially specious.
      I was _not_ expecting what could be described - without the slightest hyperbole - as the complete and utter absence of any argument whatsoever.

      They've out and out said they'll ignore the verdict at the ICJ, so one has to question just how much effort they're putting into their defence.

    The Court cant enforce any orders, however there are reasons why Israel is frightened about the outcome. Apart from the impact on global opinion, any provisional orders against Israel that they choose to ignore could result in legal action in countries that support Israel. A country that has a prima facie judgement against them that they are committing genocide will almost certainly run into trade restrictions on arms supplies and other material support.

      Yeah, but I think they'll have a good case to ignore the ruling based on Article 51 of the UN Charter, and that the ICJ ruling is just outrageously biased and therefore not something to be followed. The ICJ would undermine their legitimacy here, if they just rule how they want instead of according to their own laws. Any Court that acted in such a way would not be seen as fair or acting in a manner that is codified by law. That the judges might just rule however according to the politics of themselves and their home states is what made the ICJ so friggen controversial in the first place.
      This Application should have been dismissed on the grounds of disclosing no actionable grounds. On its face, there was nothing lending to the charge of genocide

      For the West Bank nothing will change (Israel already lifted even the restrictions to work in Israeli territories for them). In Gaza Palestinians will return and rebuild with a lot of international aid, elect a new government obsessed with elimination of Israel and the cycle will repeat. This happened many times and this will repeat as long as Israel and both Palestinian governments will become interested in the long-term peace which now couldn't be said about any of them.

      Jesus Christ- one of the cornerstones to their argument is that they have the right to defend themselves. Hamas has said they will do it again - HAMAS are using their own people as human shields. The question is of proportionality and whether Israel crossed the threshold into genocide.
