I'm not negotiating. They are not the original creditor, therefore, I owe them nothing. I am working on my defense now. This debt has been sold THREE times! I want all the contracts and full accounting on EVERYTHING, as I have no Personal Knowledge of these people and their practices. Those are Reasonable Requests. Had a court appt. yesterday and told them I do not agree and we need a trial. Date set for Nov. 4.
I had a cc debt that went on my credit report. I disputed the debt with a credit repair agency and the debt was removed (Jun/July 2023). I just received a court summons to appear for this same debt. If I can obtain proof from the credit repair agency that the debt was settled can I use that in court and present to the judge?
If you settled the debt, then yes. But just getting it removed from your credit report isn't a settlement unless you've got something in writing saying that you are no longer responsible for the debt. If you've been sued, it's best to speak to a lawyer in your state about your options.
I know someone dealing with this in Oregon. I think their 30 days to respond after being served papers ends next week, wow it’s so stressful! Can’t afford an attorney hope they still respond in time. Will show them this vid, thank you!
Got summoned by LVNV, I responded to court and the debt collector that the debt is not mine, i don’t have any knowledge of this and this is passed statute of limitations in MS (3 years for a credit card) Now they’ve sent a summary judgement and my credit report says they are now the original creditor starting January 2022…. How do i fairly get to fight in court?
If yo don't have detailed knowledge about how to fight a summary judgment motion you need to talk to a lawyer right away. These are procedural traps that will snare 99% of non-lawyers, resulting in a judgment against you and eventual garnishment.
I have a question; I am getting sued for a debt that is 5.5 years. In my state, the statue of limitation is 4 years. The debt collectors files the lawsuit when the debt was 3.5 years. I responded immediately to the lawsuit and I didn’t hear anything from them until recently. So, now the debt is 5.5 years. Does a lawsuit stop the time in a statue of limitation or has my debt exceeded the statue of limitation?
In Florida (and probably most states) if they filed the lawsuit before the SOL ran, that won't be a defense. So here, you're probably out of luck. You may have other defenses, though, and you're best off talking to a lawyer in your state to find out what those are.
I've been to first court , then mediation, pre trial, and now im scheduled for court on October 9th. Just got home today and saw a summary judgment motion . What should i do? Help me.
If you've got ID theft, I'd definitely talk to a lawyer in your state ASAP. They might be able to turn that completely around for you, and you might paid when it's all said and done.
What if its not old or credit card debt i was in a jetski accident didnt have insurance and the other partys insurance paid them out 10k and now i have debt collectors saying i owe 10k even though the cop had said everybody is liable for their own damages
I was served a summons informing me i was being sued for $7k in credit card debt by a big bank. I e-filed an answer denying everything, next day a judge transferred the case to arbitration, now what???
That’s one of the biggest problems with arbitration. Most people have no idea how to handle it. I’d recommend speaking to a lawyer in your state right away.

Sounds like a violation.
Why would I admit it if I dont know who's sueing me?
I don't know why YOU would, but lots of other people do for some reason.
I was not notified that i was being sued. Now they've garnished my wages. How can i stop this?
If you're in Florida, call us.
A garnishment where there's been no service of process violates Florida law.

Would you recommend this if it’s with the original debtor or should another move be taken?
Ever creditor is different, but it’s rarely a good idea to surrender the booty on day one.

Remember that every state is different, and what works in Florida might not work in Oregon.

How should I go upon bringing up the binding arbitration clause agreed upon during sign up for the credit card ?
We don’t generally recommend that. We use tools to get better results.

Once a judgement has been entered against you, will a person have a day in court to defend themselves against the creditors?
Your day in court comes BEFORE judgment. Once judgment is entered, you've lost the right to defend any further.

That’s interesting. So, in theory, you can have a debt removed from your credit report (7 years) and still be in court contesting a debt?
Yes.

I have a trail in maryalnd for $6400 in 3 weeks midland sued me can I still say that ?
You need to speak with a Maryland lawyer who specializes in debt defense and FDCPA claims.
What if you disputed and it was identity theft what should I do at court

what is the creditor working with an in house law firm?
Sounds like AmEx. They can be tough to deal with.
Do you know a good attorney in Wisconsin ?
I think, but I'm not sure, that James Vlahakis covers WI: www.atlasconsumerlaw.com/attorney-leadership-profiles/james-c-vlahakis/
How do I find an attorney like you in TN
Call John Watts. He's an Alabama attorney but he has lawyers on staff who can handle TN cases.
Thanks!

I didn't get to see a judge they sent the summons to my old address. No answer sheet.i was told to just pay it .savings account frozen$ 47.27
In Florida, if they sent the summons to the wrong address, you'd probably be able to "quash" service and get the judgment thrown out.
What about if I get sue about a loan ?
Talk to a lawyer in your state.

what will happen to your credit card debt when/after you get deported in US?
They’re going to have a hard time collecting it from you.
You are not practicing in kangaroo court in It Indiana.
I can't give advice about Indiana law, but I doubt it makes sense in any state to admit the debt.
😂 counter sue
