NDAs can’t be used to cover up a crime. Even if Quinn is under NDA to not talk about stuff that happened an Niji that’s unenforceable because he talking about illegal activities that took place. These are things that NDAs are unenforceable against; Reporting a crime: It is illegal to prevent someone from reporting a crime to the police. Whistleblowing: NDAs cannot prevent whistleblowing. Public interest: NDAs cannot prevent the disclosure of information that is in the public interest, such as illegal activity.
Easy, because Japanese law enforcement will only look into it if they can find a way to make it a 100% conviction. Going back to mujin's earlier video A cosplayer woman was being stalked by a pest in Japan, she repeatedly went over to the police to get help but the police basically said "okay he technically hasn't done anything so we can't do anything ourselves"
I write this for those with the same questions as Kip, who may be interested in why it wasn't raised to police. Japan is a great country, but their law and law enforcement have got to be one of the worst I've seen. They don't do anything until evidence has already been presented or criminals have been caught in the act, and an investigation for said evidence would not start without the issue being large enough. Simply put, they don't look for a fire until they see smoke large enough. And they don't put out the fire until they see its not supposed to be there. To be fair, once you do get someone arrested, even before trial, they can put them on a holding cell for months up until a certain limit specified by law, and then release them for a few moments before putting you back in a cell since they do not have laws stating against it, so they literally just let you out because they need to reset the limit. They don't usually do this of course, but it is within their power to indefinitely hold someone in custody even without trial. Which is why foreigners are usually told to just plead guilty. Next is they have weird defamation lawsuits. Japanese law does not care if its true or not, but if it is not within the national public interests, then it might as well be silenced with a cease and desist, whether it be true or not does not matter. They also have weird honor codes and unwritten rules to this defamation stuff that can be traced back to bushido. Not sure if its an accurate summarization, but thats what I got from months of legal mindset streams on the neverending issues of Niji. Something Kip might not even look at or read this comment because he's disinterested on the issue and just wants the facts, wherever that may be in the depths of Niji red tape. I respect Kip for his neutral takes but I get irritated at him playing devil's advocate too much, even as much as he claims missing context. Sometimes he comes across more corporate than person. Kip, I'll tell you exactly why there are no authorities meant to handle things like this invloved. It's because the modern view of these aurhorities is extremely negative in the eyes of the majority. Many people these days simply do not trust those who are meant to protect and help them and fully expect them to botch the job or simply not even bother entirely. Why would they contact people that they already have a preconcieved belief of inability to do their jobs properly? To many, investigators on social media platforms are more trustworthy than the Police, HR, the FBI, or whatever group you want to name. So that is where they will go to, the people that they feel they can trust.
On the "why isn't the police involved" question, we have to take in consideration this: as a NijiEn liver who wants to report such issues to authorities, which ones do you contact? Your country's or Japan's? What can your country's authorities do, and what will Japan's authorities do? They're not exactly known to take side with whistleblowers, especially foreign ones...
Why authorities didn't involved? Same way as selen case. Case regarding EN or internationally seem abit wonky even legally speaking in that case alone seem to be a lot of miscommunication etc between the lawyer and the legal ground they work on. It's easy to say "just call the police" etc or doing it legally but in reality cases between two different nation etc is very complicated it's not as easy as "just involved authorities" the same way if this case indeed illegal or something because on what grounds you say it's illegal or criminal or something? Nothing you can say definitely that s*x pesting is definitely illegal only we can universally judge it as morally wrong. The other case would be the Yab incident, in that case most victim were JP livers and although no update seen yet (at least as far as i know) Niji did say they will legally pursue it to protect their talents privacy. It's easier and more simpler because they are in JP land and they're JP citizens they understand their own legality because they didn't have to involve possibly multiple legal groundwork of multiple countries.

A lot of the difficulties in these situations are from the contracts and inexperience with these things. The contracts can and are very exploitative many times which leave some with financial difficulties and if they want to fight back they will have to deal with Japanese laws vs their countries laws. Many people also don’t know what to do in these situations as they aren’t informed on what recourses they have. Also as somebody else mentioned there is a lot of distrust with police handling things like this as even if it’s not all there are plenty of stories of them ignoring or failing to follow up on issues TH-camrs bring up(ex. repeated swatting, with the same police at times, even after informing them about the possibility).

What's most troubling to me is that... Im not sure how coming out with this story is helping. Or rather I have a hard time being optimistic about it. From Dokibird/Selen example we know Any Colour does not handle things properly. We have not seen examples of them improving or showing intent to improve. I'd hope personal boundaries would be properly enforced & necessary consequences given. Unfortunately, we have no indication of that being the case besides 1 post about "ongoing 3rd party investigation" from the agency. No idea how that will be dealt with too 😮💨
