Sir mera ek question tha kay final decree k against koi appeal lie nehi hoga.. I mean suppose agar bacche ki custody ko lekar koi suit hai or custody mother ko milti hai. To yeha mother decree holder hai so kay iss case main father higher court main appeal kar sakta hai decree k against?sir please reply

Ji decree ke against appeal me ja sakte hai but uska time limited hota hai agar us time ke bad jate ho to appeal reject ho jaegi.

Jo decree ki definition main likha hua hai ki an adjudication from which an appeal lies as an appeal from an order is not an decree iss clause ko kay section 104 of cpc se relate karke padna padega keuki section 104 main bhi likha hua hai orders from which appeal lies.. And sec2(2) ki first exception main kay section 104 ki hi bat ki ja raha hai?

@@RohitSaha-i7w Dekhiye ap section 2(2) or 104 dubara padhiye 2(2) me likha hai decree shall not include any adjudication from which an appeal lies (Kyunki agr kisi decree ke against appeal me jate hai to wo decre na ho kar order reh jati hai)
Or section 104 bhi order from which appeal lies (isme dcree from which appeal lies nhi likha) kyunki decree ke khilaf agar ap appeal me gae ho to wo dercee nahi reh jati wo order ho jati hai.
