    Anyone notice local councils now make their vehicles and wardens look more police style to give them a false image of supposed authority I always thought it was illegal to mimic the image of an emergency services vehicle
    Councils should quit wasting taxpayers money on image of council workers the council is just a business and as such has zero authority government service wise they should just stick with what they are supposed to do serve the people of respective towns cities etc instead of just themselves

      It all boils.down in the end.to who has the physical power. If u can beat the shit out of them u clear. They only pray on the weak. I understand upto some point there needs to be law and order. But this van didnt cause any hinder to the trafic so let it be man. Now if u cause hinder or an.dangerous situation I can agree with a ticket and so on. But this is just revenue collection.

    A few years ago there was a spate of Northumbria Police vehicles being issued with tickets for parking on footpaths and double yellow lines and an Inspector made it quite clear that Police vehicles WERE NOT exempt from such penalties like every other driver they have to comply with parking restrictions

    Unless I'm mistaken, if driving or riding a vehicle is an essential part of your line of duty, then you must not be using the red L.
    Furthermore, after passing the test, as a fully qualified driver, you can no longer display the L plates.

      Nowhere is there a stipulation that provisional licence holders can't drive for a living.. I have full car hgv and psv licences and no bike licence. That doesn't mean I couldn't be a bike courier on a 125 with L plates. As long as a person is legal to operate the vehicle in question anyone can drive anything for their job

    Should have asked if it was his own bike or supplied by the Council, if his own should have asked him to confirm he had business use insurance cover if not he is using the bike while uninsured, a more serious offence than parking on yellow lines.

    i'v worked for two councils and would like to point out that a council vehicle thats being used for work is exempt from many traffic rules. i used to drive my van on the pavement and over park land all the time. something that would have got any other road user a ticket. the rules are different council to council. so it may be that this guy is exempt. what i don't get is why he has "L" plats on. you can't use a vehicle for work if you don't have the full license for the vehicle. so how is he lawfully insured?

      @@BedsitBob we are disusing a person working as a subcontractor of the crown. so you are wrong mate. because the home office decided thats the insurance restriction that are imposing. the law is that you my not drive a vehicle if improperly insured. so you see its unlawful to drive under the home office rules for the insurance. so for the given situation the statement is true.
      if the guy was delivering pizza and the pizza company allowed a "L" plate driver to drive for them. then it would be lawful. but ass with the governments home office. if they did not allow a "L" plate driver to drive for them. then it would be unlawful. as the insurance would be invalided.
      its a complex point at law. but if like me you have worked for a council you would get the point. its to do with the way council insurance is done and contracts are worded.

      @@BedsitBob not for the country in general as from what i understand. all councils have a different take on the way they implement it.
      but for South Hampton city council. its part of the conditions of operation. it references the home office definition of "license holder". as you know the home office has statutory definitions for lots of things and license holder is one. that seems to be the root of the requirement. if any. i would guess SHCC did it that way so if the definition gets amended they don't need to revisit every contract, document and so on.
      with Epsom and Ewell (Surrey) council is covered by the definition of "driver / operator" as used by the council in compliance with home office rules. but i don't ever remember seeing the ruling quoted directly or explicitly. it references that they must hold a valid full driving license with no more than six points. i never got the exact wording intention as it was written in a way that could have multiple interpretations. a classic bit of covering all the options. but not pining us down to anything.
      the way other councils go about the wording it or implementing the requirement is not something i have first hand experience of. as for when the rule was made or when the guiding documentation that references it was past down. i have no idea. its been a thing from the 80s to my knowledge. i have however never seen learner driver on any of the insurance offers made to councils and i'v seen several thousand of them over the years.
      personally i would suggest you contact the home office yourself. but i suspect you will get no joy doing that. i did once have a H&S guy suggest its down to the interpretation of the 1974 heath and safety act requiring employers to properly train and qualify staff to operate equipment.
      now i think about it all constabulary's are covered by the same rules. they are all companies subcontracted to county councils under home office rules. they all restrict the use of vehicles to employees with the relevant "full license and training" for the same reason. so perhaps try New Scotland Yard.
      so i suspect the Home offices published restriction will at the end be the definition and the 1974 heath and safety act.

    The parking is one thing, the cut down L plate on the front of the moped is another. That's failing to display, a contravention of the conditions of his licence and likely invalidates his insurance. Speaking of which, does he have business insurance as he is clearly using it in the course of his duties for which he is paid. I would expect the local council will have a copy of the insurance as a public record.

    That traffic warden is illegally riding that bike. He does not have a full license, only a provisional, as seen by the L plates. If you use any motor vehicle as part of your job, you need a FULL driving license. He is also parked on double yellow lines. Two offences. All tickets should therefore be void.

      @@snumbers1 The nonsense you spouted is the fact that during the course of their duty a Civil enforcement officer is allowed to park on the yellow lines, it's preferable they don't to avoid situations like this but they are allowed. Since decriminalisation parking restrictions are not law, they are a civil contravention which is controlled by the council, if you have a valid need to park in contravention you can apply to the council who are able to waive the contravention for you if they feel you have a valid reason for being at that place. and yes, I am an expert in this field.

    Anyone can park on double yellow lines if they are legitimately loading or unloading, all day if necessary. Postmen can park on DYL anytime as can all the emergency services if they are carrying out their duties. Traffic wardens are also allowed to park on DYL if they are issuing parking tickets Special dispensation is also given to scaffolders, glaziers and utilities vehicles. Tradesmen can also pay a small daily fee for a permit of exemption outside their work site. Disabled people can park for up-to 3 hours with a blue badge.

    the double yellows are broken on the corner and so are not legal them selves, the ticketed driver should take photos of the lines and appeal, he will win and the ticket voided, we did

    It's Highways departments who put down yellows lines and all road signs. Usually all traffic enforcers have permission to stop on said lines to issues tickets. Some abuse it.

      Sorry Adrian he is not exempt. Only last week I had a similar case appear before me. The motorist had his appeal dismissed and, additionally, I ordered the cismissal of the C.E.O.

      @@paullee5573 Well then you should reinstate him and dismiss yourself. The TRO (traffic regulation order) will read something like “No person shall, except at the direction of the Police or a Civil Enforcement Officer, cause or allow a vehicle to wait or park upon the restriction”.
      Since the introduction of DPE (decriminalised parking enforcement) it is the duty of the council to enforce highway restrictions. It is also completely within their authority to grant waivers and dispensations. The duty officer (the CEO) is legally authorised to park his vehicle on DYL, if it is necessary for him to carry out his duties. The vehicle does not need to be liveried.

    The Civil Enforcement officer is actually allowed to park on double yellow lines as long as he's doing his statutory duties. Which in this video he was doing. And yes it's one rule for one and another rule for the other but that's life so deal with it.

    Take it to court and fight it - you'd win, those lines aren't legal. They have to be unbroken with end lines to be legal - that's the law, and it can't be misinterpreted or twisted. They are clearly very worn and broken all around the corner so they aren't legal and as such can't be enforced. Any ticket issued on them has been issued illegally and will be thrown out of court.

    Some people make themselves look incredibly dumb. Enforcement officers do have the authority to park wherever they need to to carry out their enforcement duties. The would no doubt prefer not to park in the same manner for which they are about to issue, but how far do you expect them to walk from a parking spot to the infringement?
    When I'm out on the tow truck I'm able to park in a live lane and stop,traffic in order to get the task done.

      @@terryboland3816 If you reasonably suspect someone has committed a serious offence you can affect an arrest. Minor offences are a different kettle of fish.
      The police have certain lawful powers to detain (and arrest) people so long as they have reasonable suspicion a crime has occurred, is occurring or is about to occur. Doesn't always mean they are in the wrong but I wouldn't necessarily trust the police to be right.
      Each case has to be argued on it's individual facts and evidence.

    The council will let you work on your bike with Out a full license but you are not insured as you need to state on your insurance that you are working on your bike , unless things have changed ‘

    Unless you hold a disabled parking permit you cannot park on double yellow lines. The Highway Code states: “Double yellow lines indicate a prohibition of waiting at any time even if there are no upright signs.

    Much, not all, of the U.K. traffic legislation DOES allow Council staff, highway workers, blue light services, exemptions in the course of their work. For example exemptions to park on zig zags and exemption from complying with mandatory signs I can think of off the top of my head.

      wrong by law they are no more excempt than we are, with legislation they are no more excempt than a member of the public and that is via case law and can be fined and prosecuted the same no excuses the council can not excempt staff from the law no matter what law is law

      @@mancpete66 Actually, you are incorrect. There are exemptions to many laws and Civil Enforcement Officers are exempt from most parking restrictions, including parking on double yellow lines.

      I'd assume (maybe wrongly) that he'd probably need to show evidence of his insurance covering work purposes? Somewhere I worked (which wasn't traffic enforcement, mind you) had it stated in the contract that to use your own vehicle for work, you needed to have insurance that specifically covered business use (I think you also needed to provide that evidence to them, but as I had no vehicle and didn't really need to use one, I don't have direct experience there!)

    Double yellows mean no parking at any time except those exempt by virtue of a part of the 1994 Road Traffic act, namely the 5 emergency services or those granted temporary dispensation. Locally employed paedophiles, sorry parking enforcement officers, are exempt from their councils parking restrictions, ie permit parking, or pay and display etc but are not exempt from yellow line rules
