      I think it is clicking the video frames forward with a mouse or keyboard, not a pen. Not nearly as concerning as picking up the whispering from the attorneys’ tables but maybe the same hot mics.

      I couldn't understand how someone could just stab people for any reason, until I found out he's a Mexican. I'm 61 and grew up in East LA and there is nothing like Mexicans for going around stabbing people with knifes for little or no reason. I've seen it hundreds of times. I've had them pull switchblades on me several times for no reason.

    After opening statements I don't think those kids deserved to be stabbed but I do believe the man felt intimidated by a mob. Glad I am not a juror.

      A case of "fuck around and find out". Teens can be brutal but nobody should have lost their life. The kids should have minded their own business and the guy should have walked away.

      I agree with you but he intentionally put himself in that situation which is why I believe he should be found guilty. I think pride got the best of him and he confronted them knowing he had a knife in his pocket and could use the excuse of self defense if it went that way. I don’t think he was scared up until he actually got his shit rocked in the water.
      He also fucked around and is going to find out stabbing someone gets you life in prison because it’s clear as day this wasn’t self defense.

He was looking for his phone minding his business he got swarmed and litterally jumped. If I was that guy I wouldn’t have used a knife because I’m young and know how to fight but he’s old and clearly out of shape so he has every reason to be scared for his life in this situation. He didnt hit anybody or stab anybody until he got jumped.

I do think he was scared for his life and was being attacked but context should matter and I think he put himself in that situation INTENTIONALLY when he easily could have avoided the whole thing. Some people love confrontation when they're adrenaline is up. And I come to that conclusion because he RAN up on them in a threatening manner grabbing at their tubes knocking them off. At that point he made first contact when he didn't have to in my eyes. That's regardless if they were screaming at him... doesn't give someone the right to come at you like that. And theyre saying he threw the first punch on top of that. There were just too many opportunities for the stabbing to be avoided and although those kids did antagonize him the old guy also made choices that lead to death which he should be held accountable for.

      And this doesnt matter in terms of finding him guilty or not but I do have a feeling he was being a creep and checking out girls. The water is knee deep if that and it doesn't appear to be that murky so why the snorkel? I might have missed this but was the phone ever found or was it proven he lost it at the river?

    Self Defense 💯. Didnt see him hit the “woman”, there is no proof of that whatsoever. He got attacked 1st. Once they pushed him down, smacked him in the face and continuously pushed him down, they are the aggresors. When a mob comes after you like a pack of hyenas, you gotta do what you gotta do. Not guilty. These kids are stupid and intoxicated. He doesnt know what they will do once it started, they could have drowned him if he didn’t defend himself.

      It was noted in the opening statement of the defence that at least one phone was in a waterproof phone pouch, which are specifically made to float. I have one. It floats. So, “engineer guy” was correct that the phone could have flowed/floated downstream.

      Yeah, he should’ve kept walking when he initially headed upstream back towards his group, instead of turning back & charging at the teens & grabbing their tubes. This is why you don’t hit a girl telling you to go away, while surrounded by drunk teens you claim to be in fear of you life of, that are all laughing & saying go away. Miu escalated the situation multiple times & had both the option & duty to retreat. He escalated the situation to violence by being the first commit assault. Ditching the weapon & lying to investigators show consciousness of guilt. If you stabbed anyone would you discard the knife, not tell anyone & lie after arrest?

    I know one thing. If I am ever in trouble, I want the defendant's lawyer! I think the evidence so far shows that it was reasonable for him to be intimidated. I am not saying what he did as a result was okay, but it does indicate he had a reasonable doubt for his safety. When this case first happened, the media made it seem like a mad man with a machete started randomly attacking young people. So, I went into it already convinced the guy did things just like they said. We don't live too far from here and it is a big party venue. Many people are out of control with their drinking and there are fights. If you have teens, it is best not to let them go tubing unless at least one responsible adult is with their group and is nearby.

      I don’t know specifically because I don’t know much about this case, but it’s pretty common for someone to be keeping track/adding/subtracting/changing the order of questions as each witness answers so the other lawyer can concentrate on presenting each question with clarity. It’s really unlikely it’s any sort of training. Law clerks/interns can participate in active cases, but it would be really weird if that was going on for a big, publicly available case. Regardless, would’ve been great if somebody in audio figured that out and didn’t allow the mics to pick up constant whispering lol

    The defense needs to close out with the video footage slowed all the way down and without sound and allow the jury to make their decision based on the video, evidence and the testimony that they have seen.

    I don’t think a 54 y/o man is an “old man”. Everyone knows that a bunch of drunk teenagers usually act like idiots. A grown man should have enough since to turn around and walk away and definitely not pull a weapon. After drawing blood he should have definitely know he had gone to far, unless he has an anger issue he can’t control.

    these teens taunted him. he responded in a drunken stuper by coming to them. he could have just stayed away. i myself have been in simalar situation but walked away. I was at a park and taunted by a bunch of people who i gave no reason to mouth off to me. I was walking my dog and they didn't like my little 25lbs dog cause he is aggressive. I had him on leash and they still taunted me. What did I do? I walked away and said nothing to them. Probably 15 people drunk in a state park where no drinking is allowed. All you have to do is walk away. God Bless the victims family. They will never see or hear him again.😪😪😪😪😪

      He came to me to patch him up so he wouldn't have go to dr.s or hospital. He had family working there and he didn't want them to know.

Instead of taking responsibility for taking part in their friends death they are trying to hang this man for their mistakes. They should be charged.

    The “kids” must have been very close in order to be stabbed with a 3” knife. I’m sorry for those who were hurt & killed but I believe this was self defense. I think it all started because the kids wanted to get a reaction from Nick for views. I’m just glad I’m not a juror.

      Agree. I don’t think his defense attorney is helping by continually referring to the teens trying to humiliate him. Imho that’s why he turned back towards them early on, put his snorkel in his mouth & both hands on one’s tube, out of humiliation. His atty claims he wasn’t drunk but, returned because he saw one holding a phone he thought might have been the phone he was looking for? Yeah, right. Also, his atty exaggerates an open hand slap he received & downplays him hitting the female. It probably was an open hand slap (both were) but, in the moment the crowd was yelling about him hitting (either way, slap or worse is still “hit”) the girl. The atty tried to make it sound like they made it up while talking to police. Imho only one atty seems to be reaching, twisting the facts to fit a narrative, making many assumptions, the defense. If I stabbed someone in self defense I’d call 911. Defendant showed consciousness of guilt.

      Alcohol does crazy things to people. I had a family member black out and physically assault me for no reason. There was nothing to provoke such a thing. I just remember feeling my hair at the back of my head getting torn out, I was on the floor, protecting my face from getting kicked in. I’ve never given anyone a reason in my life to hurt me like that. I will never trust another drunk again, for any reason.

    My opinion has massively changed after witnessing the video. This guy stabbed one kid in the gut and pulled the knife upward…that takes some thought and effort. Whether he felt threatened or not, the rowdy kids/young adults didn’t have weapons, this was overkill. He literally brought a knife to a fist fight. Neither group is in the right but I do wonder about Mr Miu’s thoughts and intentions…he IS smiling at some point and seemed to be very calm and controlled after the stabbings, not devastated by his actions or frightened enough to call police or approach them when he saw them. He would have walked off and gone home no issue. His wife is a sour-faced lump of belligerent misery too.

    In my opinion Choice of words can hurt Someone’s ego . but I didn’t hear no threats. They didn’t threaten to beat them up or hurt him or even threaten his life. They might have hurt his feelings or ego or pride, but that’s just words and you can’t take words personal, And sadly it led to an altercation because he had to prove himself instead of walking away from the situation. Ok he the fact was he was surrounded By a group of people but He walked into that crowd instead ignoring or walking away toward his group and he put himself in a situation where he may have been scared but then he struck first and then brought out a weapon. When everyone was telling him to just leave or go that’s going to be hard to prove that he did not want to stay and fight or the fact he didn’t want to leave. Once again, this is all my opinion not fact form your own opinion.

    Who TF does that woman Madeline thinks she is? Thats not her river, she has no right getting in his face & telling him where to go. He can go wherever he likes. Now Nikolai will die in jail, he is paying dearly & is being held responsible for his actions on that fateful day. But nothing is said about the crimes that were done to him. On the video you can clearly see him getting pushed & falling into the water, twice. Multiple people push him, hit him on the head, push him down again yet no one is charged. That is not fair.

He walked away early on, then returned because he was angry & humiliated by their taunts, pushed on one teen’s intertube. You can’t claim self defense if you create the situation or had opportunities to remove yourself from the threatening situation. If you stabbed anyone in self defense would you ditch the knife & lie about everything or call 911 immediately & tell everyone in your group? His attempts to conceal what he did show consciousness of guilt.

    He hurt a woman in the face in front of group of people. What did he expect? Of course the defended her and had no idea what he would do next.
    So, they didn't get physical to him until after he punched her.
    I'm so done with him claiming self defense. He also lied and said they took his snorkel. No. He dropped it.
    He barely said a word. That was odd, VERY odd. That surely made the groups uncomfortable as he approached and then was near them and refused to leave.
    Not once did he ask about a phone, right??? Not once did he greet them and say, "Hey, my friend dropped his phone. I came over to look for it. ...." He was acting weird the whole time.
    A normal person would say the above or something similar as he approached or by the time he got closer to them. He said almost nothing, yet speaks several languages. It's weird! Why didn't he walk away in the beginning??? The phone was replaceable. Why did he pull out a knife instead of walk away?

      Normal people don't run up to strangers, touch and move their belongings, then touch their bodies.
      If I saw you on a sidewalk and ran up to you, touched your purse or bags and touched your body, what would you do? They reacted.
      They definitely reacted badly. They aren't 100% innocent.
      But, he left his group and approached a group of strangers without saying anything like, "Hey guys, I'm looking for a phone."
      He was acting weird. They reacted to a weirdo. They had no idea why he wouldn't leave. He was the one that should have gone back to his group.
      I'm looking at this in a non-biased way. They all could have behaved differently. But, he originally approached and touched the guys in the tubes.

    Never in my 55 years on this planet have l ever heard of or seen anyone carrying a knife with swim trunks on. I have been making a living with a knife for more than 30 years. This just baffles me why someone would need to carry a while tubing on a river.

      It’s really not that hard to figure out. if people fish on that river then he has every right to carry a knife at the river, especially because hes snorkeling. People who dive and snorkel carry knives so if they get caught up in fishing line, they can cut themselves free. Go look it up every smart person who dives or snorkels has some sort of knife tool for emergencies like I stated above. I’m also a woman who carries a pocket knife every day. How do I know this and you don’t?

      I am 59 and a woman I carry a pocket knife for any out door activities because it gets used often. Swim trunks have pockets, so there is that.
      I don't see the defendant being aggressive even when being surrounded by a group of men. I have only seen the video. He couldn't get back to his group because the group was between him and his group. At least two people put hands on him.

    If he wasn't able to walk away the ENTIRE time, then h*ll ya, defend yourself all day, but NOT with a KNIFE! You cannot justify using a knife or gun in a fist fight, especially when it was not self defense which means you could not get away. He started the situation, he chose to keep standing there, he chose to try and dispose of the knife and lie. Absolutely not self defense!! If he was THAT scared, which he WAS NOT, he could've ran back to his group, not run at the teens and tell someone to CALL 911. If they had continued to attack him once he ran away and tried to get away, that would've been self defense. Not the case at all here.

      Opinions aside you absolutely can use lethal force in a fist fight under the right conditions such as being heavily outnumbered (13-1), being pushed under water (easily drown, threat to life, nowhere to retreat to (surrounded), another common example would be a petite woman being attacked by a 6ft+ 200lb+ man (this is called disparity of force).
      Also, initial aggression can be withdrawn, at which point the next person to instigate becomes the initial aggression. If words are exchanged that you started, then turn your back and start to walk away, then are attacked, you are no longer the initial aggressor.

      That would be damaging to the prosecutors "story" timeline of events and what really occurred. The defense would love the video to be played, in its entirety. Once the video is seen in full... it really paints a picture of self defense.

    Go back to the video right before the guy yells, he hit a woman, and you will see the kid in the yellow shorts shoving him back down in to the water twice, and after the 2nd shove he stabs him. Clearly self defense. The man had to be terrified, being surrounded and not knowing if they would try to drown him next.

      I agree, and don’t hate me .. but my only cause for pause is; if he was as scared and threatened of the crowd (which he had every right to be) why not be the one to call cops and say “I was basically jumped, and harassed, exc” and give his account of his fear then and there, but again you never know how you’ll react to a situation until your in it … but I agree - self defense - tragedy someone lost their life of course, tragedy it all happened in the first place - I just don’t understand if he was so shaken up why he didn’t cal for help as the original “ victim” (if you will) … anyone else??     Okay, at first I was on the young boys side . After the defense attorney made his initial argument, it’s very clear as day what happened. He walked over and sort of jump at the float because he assumed the phone was his friend’s. You can see that he goes to reach for the phone but drops his gear in the water. Then he looks around for it but the boys taunt him by yelling and telling him to leave. OBVIOUSLY he’s not going to leave right away because he JUST accidentally dropped his gear into the water so NOW he wants to find it! Then you can tell, when the woman walked over, his body language indicated that he was attempting to try to explain his side of the story to the woman but she immediately yells at him and tells him to leave. I haven’t even finished the video yet and I can tell you that the defense has really nailed it and made their reasoning believable. It was also belittling to him, as a man, to be shamed in the way he was for no reason in front of his peers. He probably told them “I’m looking for my friends phone” & the boys took it, whether intentional or not, that he was looking for little girls. Smh. This is sad for everyone.

    Reading the comments on this case has proven to me once and for all that the “jury of your peers” is no longer a functional standard of justice.
