Thank you. Great video ! Love your dog ! 🐶🐶
Thanks Arripa!
So if you can see it you can take a picture of it, so taking pictures of vehicles and buildings is not breaking the law in which therefore cannot legally be prosecuted for.
Yes, I totally agree!
@@TheDeanLawChannelI understand that of course it's not illegal to take a picture of somebody's car parked in a public space, but is it another case if said picture/video was posted on social media and subsequently went viral and ridiculed?
@@nilobeebee no because an opinion is nothing more than opinio.
Thank you po! This is very helpful for a street photographer like me.
Glad it was helpful!
I have a question, if I go to take pictures in a mall, I ask people's permission first, can mall security ask me out for that?
Good evening, thanks for the video. I have a question. I'm just getting started in photography. Can I take photos like a graduation party without a license in Florida?
Its ok naman to be selfish.... share share lang
I'm hoping to start a new project soon documenting the housing shortage in my region. This project intends to photograph homes. I plan to only photograph locations I can see and photograph from public spaces such as streets and sidewalks. I know that I am within my rights to photograph them, but what happens when I publish them? There will be no people in them, only the home. I will not be associating any location information with them, including removing any street numbers or other identifiable wording/names. Could the property owners have me take the photos down? What if I were to print an artsy photo book with the prints?
Not really. If you took the picture on the open street, then it should be ok
Thank you Atty.
You're welcome 😊
its like saying you can walk barefoot around the park, BUT IF YOU ARE WEARING NIKE shoes.... THEN ITS A PROBLEM! lol
He he. Good one
Thank you so much
You're most welcome
Thank you sir
Welcome
Would I be violating the right to privacy by posting on Instagram a photo I took of a person inside a food court in California? This person was walking toward me, among others, and at no point did I capture anything that could be considered embarrassing. However, this person is at the center of my photo, making him appear as the main subject. Please advise, thank you :)
I would say no. It's a mall. There are CCTVs every where. IT's a public place
Dean, would there be a violation of data privacy if I took a picture of a man on the street and posted it on a public social media page for non commercial use e.g. As a photography enthusiast
I would say no. Because it is a public place and the expectation of privacy is low. More so now with all the CCTVs all over.
Great... thank you, Dean.
Thanks for listening
I take photos usually just to go in photo albums or frames.
Hello and thank you! Can I have a question please? If I am in a public space and someone starts to either video record me or takes a picture, do I have a right to request that they don't record me or delete the picture or blur my face?
I would think that according to GDPR, I should have control over my personal information (my face), so if I don't feel comfortable with a recording of me spreading around the internet, the person who took it should be required to delete it, but there is so many people including at least one channel informing about the law that claim you can take pictures and recordings of people in public spaces, and no-one can ask you to delete them.
Yes, if they took you specifically. You have a right to have it blurred. But that is the risk of going out in public.
Thank you, that makes sense.
@@TheDeanLawChannel this cant be true, i can walk down Tottenham court road(west end, london busy street) and film as i walk i dnt have to blur no one out, i am in public.... otherswise no movies would be filmed outside lol, photography would have to be banned if u need to get "everyone" in shot permission, gotta be wrong, i believe its wrong as i go out and film all the time, no one dare say anything, same as i wouldn't dare say anything to someone, i would just move
Very interesting channel. Looking forward to more of this types of vids. Very informative!
Awesome, thank you!
I have a question sir,
I went to the bank a few days ago and saw a cool car outside in the parking lot so I took my phone and took a picture of it and then one of the workers inside the bank came yelling at me saying it was federal property and that I was committing a crime and that will call the police so told me to stop doing that and delete the pictures? Was she right or I could legally take the pictures? Please let me know thanks
If it is outside in the public parking lot, then it is open season. You can legally take pictures of parked cars in public parking areas.
Great video!
I have a question. If a person takes a picture of me in public without me knowing and posts it and it goes viral or prints a picture and sells it as artwork and sells for a large amount. Do i have any say in it? Do i get a cut of the money?
Thanks Dean!
Good question! Yes, you can ask for cut of the profits, since there was no permission. The reasonableness is that you didn't expect someone to make money out of your image.
@@TheDeanLawChannel thanks! More power!
@@TheDeanLawChannel so if a street photography goes viral or copies of the photo makes money, the person in the shot can ask for cut of the money? And if so how much?
I no longer wear Hawaiian shirts into malls since watching this video.
No Hawaiian shirt = No trespassing 💪💪
Ouch!
A few weeks ago I walked up the street where I live in order to get some shots of a beautiful sunset. A man and woman who were in their front yard started accusing me of taking pictures of them, which I was clearly not. I don't even know them. I tried to explain what I was doing, they would not listed and threatened to call the police. I wish they had, maybe the police could have taught them something.
That's the grey line there. But since they were out in public albeit in their front yard, with today's dash cams and neighborhood CCTVs, it would be very hard to invoke violation of privacy
Love the explanation, but i do have a question about street photography. If i go to the mall and take a photo of a person and post it is that illegal? Id probably ask if i could post the photo and give them my business card after i take the photo
This is subjective. Being in public has a limited waiver to privacy. More so now with CCTV cameras everywhere. My best bet is not to make that person the subject of the photo. But to be specific, it is not "illegal" at least in the Philippines
Thank you. I'm a street photographer in PH and I take photos with people in public spaces as my main subjects. I do post them on my page, and their faces are clearly seen. I'm willing to delete them if any of them asked me to. If I understand correctly, what I'm doing is not violating any laws in PH. Is that correct?
Yes and no. Uploading is not the crime. It's the public posting of the pictures. But since you take street photographer, you may be not violating a public law but just a private right
They are trying to bring in "Intent" of use. If photography is used to create a disturbance you have a problem.
Thanks for comments. Creating a disturbance is subjective. Photography at the instant of the camera click cannot cause a disturbance (unless privacy issues come out)
Atty. What if someone took a photo of me and I asked them to remove or take it down on their page? Are they obligated to follow my demand?
Yes
I have a question, if I go to take pictures in a mall, I ask people's permission first, can mall security ask me out for that?
Thank you
I would say no
hello dean, is it still illegal when the professional photographer took a photo inside the mall but this time they asked a consent to a sales lady?
Not illegal in a sense. But if there was consent, then it is within the law.
It would not be illegal, it’s a public setting, however, the mall owners or security guards can ask you to leave, at which point you would be obligated to do so.
LoL @ Hawaiian shirt, Dean!!! Funny
Thanks for the view Vixie!
Sir, salamat po. May question lang po ako. Paano po kapag nasa loob ng Church? May karapatan po ba na pictura sila at i-post without their permission?
If a Church, I would say that privacy is high. So, it would be against their privacy rights
They are finding new ways to get around the 1st Ammendment.
That is possible
And if you're taking photos of a specific person in public that is not a public figure and they ask you to stop, is there a reasonable expectation of privacy there?
No. At least in the U.S. you can photograph anyone who is in public, including children. Now, if you follow somebody and take pictures of them all day, that probably crosses into harassment.
@@stevemadrid6522 that sounds like harassment to me if they're not a public servant
If they ask you stop, then they are invoking their privacy right. You must respect that
@@kevplescia4397 Yes and no. In a mall, no privacy. But in a small restaurant although public, there is a some reasonable
@@kevplescia4397 ok
Is this u.s. or uk?

How about taking pictures and/or videos inside government office? Thanks Dean! More power!
If inside, they can prevent you for security reasons.
@@TheDeanLawChannel in Florida you must commit a crime to be asked to leave public property ......you can legally film anywhere the public is allowed even inside a government building .....they can't just violate your rights for security reasons .....you fail as a lawyer I wouldn't hire you for a traffic ticket
@@victorlorraine6596I have a question, if I go to take pictures in a mall, I ask people's permission first, can mall security ask me out for that?
Hello Dean! May tanong po ako. Ano pong sinasabi ng batas about sa mga paparazzi? Pwede po ba silang makasuhan din? Salamat po
Kung very public figure ang isang tao, less ang rights niya against paparazzi photographers
Public libraries have no photography rule. There is no reasonable expectation of privacy in public buildings. The Canadian charter of rights & freedoms allows freedom of expression. Polices shouldn't infringe the right to photograph people in public.
I didn't know that about Canadian law. Thank you for telling me. Much appreciation. Also, thanks for the view and comment
How about those people who take pictures/videos of car or motorcycle drivers doing bad behavior like parking improperly, parking in handicapped spaces, blocking bike lanes, blocking pedestrian lanes etc. and their license plates are shown in the pictures/video and uploaded to social media?
If its in the open, the picture can be taken. more so if there are committing a violation
@@TheDeanLawChannel Thanks for the reply Dean. Kasi I noticed that there are some automotive social media pages (rhymes with Dysor) that netizens report driver bad behavior to, but these automotive social media pages blur the plate numbers of the cars because they're afraid of a possible cyberlibel case lodged against them.
i hope the part of them "not liking ur shirt" was a joke, coz they are not allowed to judge u on clothes
oh, they will judge you.... they will......... he he
Good day.
Atty., paano ho yung mga nakuhaan on public roads? For example motorcycle riders and their pillion, is it okay to post pictures of them without their knowledge or permissions?
If they are out riding in the public, then they can't complain
Are you allowed to take pictures in court
Yes and no. Yes as it is not illegal but no if the case is sensitive and the judge disallows it
I wear my Hawaiian shirt and take pictures all day long
There you go
Where are you based ? Laws are different in different counties !
Based in the Philippines
i have a question, Is it okay to take a picture of someone who is in a relationship or let's say you don't know that they are in a relationship and I took a picture of that person, is it okay?
Hm.m... a stranger? No.
So you can't take pictures po of someone even if he/she is in the puclic specially he/she is in the private vehicle?
Head shot of a single person on a sidewalk, taken a short distance , within the personal space of someone, eg 3 feet away? Telephoto of the same face? Seems to me the former would be a violation of reasonable expectation of privacy, versus taking a shot of a busy sidewalk or people crowded around a food truck. Less sure about the latter.
If walking in public, not a violation. Subject of photo may complain but if on a sidewalk in a public street, no dice
Nasagot din yung tanong ko as photographer
I hope I helped
