      Yes and the paid propagandists at the CBC also failed to mention that Turdeau's use of the Emergencies Act was proven illegal. A crime against the Canadian people that Turdeau should pay a hefty and permanent price for. At very least we can celebrate the simple fact that Turdeau will never be able to show his face in public again without being mocked, ridiculed and called out for his crimes against Canada and her people.

      You could also say that the blockades and protests in Ottawa also 'worked'. Shortly thereafter, the draconian health measures were eased back or ended. The protest showed Trudeau and co., as well as the rest of the Canadian population, who were unaware of just how outraged were so many of their co-citizens, that personal rights and freedoms would not be taken for granted, at least not without a struggle or large statement. That statement was made, and in the face of this intense response from its constituents, the government panicked and illegally invoked the EA. Done.

      @@terrymckenzie8786 So in your opinion the rule of law can be overridden as long as "it worked". Interesting, have you ever heard the expression "the end justifies the means"? It was used extensively by Lenin and co after the 1917 revolution and used to murder hundreds of thousands of people who had different opinions. Because that is where you end up using that argument, and it doesn't take very long at all. Try living in North Korea for a while, there is a whole system build on "it works". No thank you.

Reporter sits there in casual clothing to downplay/distract from his fierce cbc allegiance and with a smug grin on his face, talking to his audience like children, as if the whole travesty of justice can be lightly brushed off as a trifle misunderstanding. I find this disgusting. Countless people lost their jobs, incomes, and more due to this tyranny; and for this government funded mouthpiece, it's just a middle-school teachable moment in jurisprudence.     It doesn't matter if Freeland thinks it was necessary or not, the high bar of the criteria to invoke the act is clearly laid out AND was not met, period! Invoking the act is a crime against Canadians and Canada itself, therefore it should be dealt with the harshest of penalties.

      The judge didn't use the word "unconstitutional". However, he said "the decision to issue the Proclamation was unreasonable and led to infringement of Charter rights not justified under section 1". So, it was still "unconstitutional" nonetheless.

    You completely missed one of the reasons the feds didn't meet the criteria to impose the act. You started down that road but branched off. That is that the EMA can be declared geographically. It can apply to one or more regions or nationally. The EMA also requires consultation with the provinces. Trudeau met briefly with the premiers. Ontario wanted the act to be declared. BC & Newfoundland/Labrador were OK with the declaration. Quebec was adamantly against as were Alberta and Saskatchewan. Manitoba, New Brunswick, Nova Scotia and PEI were not in agreement with the declaration. That's seven to three against invocation of the EMA. Trudeau not only went ahead with invocation, he made it national. The Judge allowed the brief meeting to stand as a consultation, but the national proclamation was illegal (as I understand the ruling).
    Another factor you didn't quite get to was that by the time the act was actually proclaimed, all the protests outside of Ottawa had been resolved (and all by use of existing laws, which you did mention). There was no need for any invocation of the Act outside of Ottawa.
    As it turned out there was not even a need for the invocation of the act within Ottawa. The demonstration was cleared using existing provincial law and the Criminal Code. The clearing action was planned in advance of the invocation of the EMA. The only thing the EMA ended up 'accomplishing' was violating Sections 2 & 7 of the Charter!
    I don''t usually watch or listen to anything from CBC, but I wondered if CBC could manage to screw up the reporting like the did with the reporting from the Convoy. I wasn't disappointed.

      Well, let's remember that Harper government (including Poillevre) fought the Toronto G20 Summit Protest case (the most arrests of protestors, EVER) against the Harper government's abuse of power and eventually lost in the supreme Court to the tune of 16 million.
      I'm glad the court rejected the Liberal's abuse of power as well because I know once one Party gets away with it, both parties will abuse their power again and again.
      Funny how both sides pretend that they don't do the exact same thing.......
      The system works.

    No bridge was blocked when the Emergency Act was called. The Coutts 4 have not been convicted, innocent until proven guilty in Canada. A neighbourhood protest is not a serious threat to Canada. There was no violence in Ottawa.

      Yeah, and the argument that lots of local Ottawa businesses were inconvenienced and had to shut their doors is spurious, given how many businesses were forced by gov't mandates to shut their businesses during much of the pandemic. Inconvenience does not equal 'national emergency'. It was an emergency for Trudeau and co, who could not cope with the degree of anger at his mandates (peacefully) demonstrated in the streets of Ottawa. It was just too dramatic for the drama teacher to handle.

    I think one of the main things to ask is why are some demonstrations ok and others are not? It appears that it depends on politics. If you burn churches and riot for a liberal protest it is ok. If you protest liberal covid restrictions, you are a national security threat. That is the problem here. Why is there different rules for different affiliates.

      The whole scale of the protest ballooned when Trudeau started slandering them and their cause before they even got to the Capital. If he showed them even a moderate amount of respect, the movement likely wouldn't have received near as much support as it did and may have died out after a weekend of protesting, but he riled them up by directly insulting them.

    Finally, some common sense and an accurate explanation of the Emergency Act. From day one, I have believed that using this act was illegal and a breach of the Charter. Even after Commissioner Rouleau ruled, I knew this had to be taken to court for a complete, legal verdict. I am happy that Judge Mosley applied the law and the strictest definition, not his personal bias or beliefs. Reading about this ruling has restored my faith in Canada and the Charter. I hope Canadians, regardless of their personal feelings about the Trucker protest, realize the importance of this verdict to our democracy.     There is more to this that he did not touch on. A comment of the judge pointed out that the Liberal government used it to squash an opinion they did not like.
    Specifically, let's compare this to the most recent demonstrations of the Palestinians and Hamas supporters. There has been violence, threats to police and civilians, and damage to property. Why wasn't the Emergencies Act used?
    CBC is doing a great job at covering up the extent of the corruptness by disingenuously up playing the significance of the weapons found. They're also saying words like "unreasonable use." Paid Liberal Media at its finest defending their boss.
    To those in the comments saying, "How can the judge do this, this makes me fear for my saftey". Think about all the canadians who had their bank accounts frozen that were trampled by horses, roughed by police, had credit cards cancled, etc. You have a lot more to be worried about if the government can freeze your bank account when they feel like it.

      Well, let's remember that Harper government (including Poillevre) fought the Toronto G20 Summit Protest case (the most arrests of protestors, EVER) against the Harper government's abuse of power and eventually lost in the supreme Court to the tune of 16 million.
      I'm glad the court rejected the Liberal's abuse of power as well because I know once one Party gets away with it, both parties will abuse their power again and again.
      Funny how both sides pretend that they don't do the exact same thing.......

      Laws must be applied to maintain civil society. Blocking a road is not legal. For the sake of the truckers' right to protest, the road laws were overlooked. However, a unique exception cannot go on forever, or else it becomes the rule. So, after three weeks of being allowed to protest in the streets, the truckers were told to leave. Instead of disbanding or moving to a park or somewhere else off of the roads, they refused and the police thus had to use force to remove them.
      That never necessitated use of the Emergencies Act, however. As the judge in this case noted, there were already laws--such as the Traffic Act--enabling the police to clear protesters off the streets.

    Here's my opinion as an Ottawa resident. Yes it was very noisy. But the government said the emergencies act was a last resort. A last resort implies they tried to anything. To negotiate, to meet in the middle, or even use existing laws? Nope. First they ignored it. Then all of a sudden people's bank accounts were frozen. I know it was wrong. You know it was wrong. But like I said good for you for keeping the comments on.

    I’m almost sixty and was never prouder to be a a Canadian as I was when the common grass roots rose up to protect my rights and my freedoms. This was not a national emergency this was inconvenient., Shame on the Government, Shame on the RCMP who are paid to uphold the law. The decision by justice Mosley is bittersweet to me and it’s incredible that in Canada we were in this position to begin with. Trudeau refused to listen or meet with the demonstrators and instead ruled the land with an iron fist. So much more could have been done.

      Countless masses of people all along the route, waving flags and rooting for them. In the middle of a cold Canadian winter. It was a moving sight (pardon pun) when we went to see them pass by.     Trudeau invoked it because he lives in daddy's shadow and had to be the only other PM to use such a draconian law. He knew it was wrong, which is why he pulled it before the senate could vote on it. Even with the provinces and people strongly indicating they do not want this PM or his government anymore, they cling to it like the kings of old clung to their rule. Trudeau will go down in the history books as the worst PM Canada ever had the unfortunate choice of electing, even if his overinflated opinion of himself, his vanity and arrogance tells him differently.     Trudeau invoked Emergency Act over a bunch of protesters making very loud noises (that was the initial complaint). No wonder the judges found it unreasonable.
    Also, the invocation of the Act made Canada look like fools on the international stage. Our most esteemed PM lectured the world's largest democracy about the right to protest but he couldn't tolerate a noisy one for more than a month.

    It's almost as if we were hallucinating on LSD when we first heard about the truckers' protest. In that distorted view, it seemed like the truckers were out of a zombie apocalypse - frothing at the mouth, brandishing weapons and flamethrowers, looking like they stepped right out of 'The Walking Dead', and not having slept for days. In this bizarre, acid-induced fantasy, they appeared as a menacing force, a mere three days' march from Ottawa.
    But then, reality set in as the effects of the acid wore off. We realized these were not villains from a dystopian saga. These were our truckers, the very people who deliver our food and essentials. The so-called 'weapons' were nothing more than bibles, hockey sticks, and garbage bags used for cleaning up the neighborhood. This stark contrast highlighted a critical misjudgment.
    In the light of day, it's clear that a grave error was made. Sending a child to do a man's job - that's how it feels looking at JT's decision to invoke the Emergency Act against these peaceful protesters. It's time for a change in leadership. Trudeau, it's time to step down and take your 'Parrot from WEF' with you.
    As Canadians, we pride ourselves on our freedom and unity:

    People gathered in a big way to express concern over covid mandates. Powers that be were railroading policy and accepting no questioning. It was apparent to some then and has been shown presently the response to covid was flawed. Government refused to talk and used muscle in to disband a legal, peaceful protest.       To be fair it did not meet the strict criteria of the CSIS act (as far as a judge looking strictly at the law was concerned) but even Judge Mosley pointed out that without the benefit of hindsight. (Knowing how it was going to turn out.) He too would have likely implemented the Act as well.

    When Russian forces start coming to take over Canada's northern territory, that may be time to invoke the EA. At that point even the Canadian military, if left at its current dismal state would be overwhelmed and likely not capable of containing the threat to the territorial integrity of Canada. This would be a scenario for the EA, not some parking congestion issue in a few blocks of downtown Ottawa.

    If anyone wants to see a justification for suspending civil liberties over national security, research El Salvador. The country was crippled by cartels and gang activity.

    Failed to mention ,the food banks were overwhelmed with too much food, the homeless was being fed, the crime went down while they were there as per the chief and the roads where kept clean and cleared.

    Even one of the provinces participated in this Judicial review I recall - and it was confirmed that their input to 'not apply the EA to their province' was ignored. Not much of a consultation there JT ! The EA could have been applied in a specific zone.... if it were at all legal to invoke. Funny that an untested argument by Lametti was the basis for invocation in the public enquiry (not just the CSIS definition).... but when tested in a real court - fell completely apart -- then Lametti resigns as his MP seat hours later.

    Actually, it was a rogue trucker who had the weapons.
    This wasn't a sign of terrorism. He probably was a gun smuggler who got caught.
    I am not for illegal gun smuggling, but stick to the actual facts related to the protest.
    This incident, I recall, as I am a resident of Alberta, was dealt with by law enforcement quickly.
    And the individual in question was shunned by the actual truckers because they knew the Feds would overblow the situation and it played into the Feds narrative that the truckers were all crazy Mega supporters.
    Instead of focusing on the real issue of the protest.
    As for the Coutts boarder crossing. One lane was left open for regular traffic AND truckers who had to cross the border.
    Many had time sensitive cargo including the export of beef, a major export for Alberta.
    These personal vehicles and truckers were waved through and had the support of the Truckers during the Protest.
    Of course a Federal funded media station is going to use false information to prove that the Emergency Act was completely warranted.
    I am so sick of propaganda and lies of our current government.

      CBC is always fair. Conservatives invariably cry foul or call it bias when the story doesn't favour them. Left, Centre or Right, you can expect to be displeased sometimes in a society of free speech, something conservatives paradoxically forget.

This piece is damage control and an attempt to hide from their responsibility for supporting the government's illegal actions, not balanced journalism. Journalists would have been interviewing protesters and broadcasting them unedited, that's not what they're doing. They're constructing a narrative that they had no responsibility for what happened and that there's some possibility that the government wasn't acting illegally when neither of those things was true.

Previously, I tried hard to listen to shows like Power Political, but many experts would discuss without providing any background, which is quite challenging for immigrants whose mother tongue is not English. This program presents viewpoints, backgrounds, and explanations in a clear and concise manner, making it easy to understand.

    So at the end of the day, it’s just violate the rights of Canadians and then later on, when a judge decides it was wrong to do so, “we disagree” and no justice to those violated. People lost their homes and businesses, spent time in jail for simply protesting, and there’s no restitution.
