      not more but ANY! looks like a shadow court atm but it was created to be that. The Book Injustices explains the history of the court in great detail! highly recommend. The court should be an equal member of left and right!

      At a bare minimum, there needs to be two things:
      A written code of ethics with protocol for willful violations and some type of procedure implemented to have a standard pathway to submit complaints regarding justices and the court. Every court in the country has these two things except the SCOTUS.

    If these laws are already on the books regarding taking action on unethical behavior by the Justices, then why aren't they being enforced? Fines are not enough of a deterrent. Incarceration and removal from their position would be far more effective. So grateful for Senator Whitehouse!

      The fines are rubbish - just like the fines handed out by the SEC for insider trading. I'm sorry, but a $250,000 fine is just the cost of doing business when you're making $5 million+ on the activity which led to the fine. That $5 million is an extreme low end of the spectrum; usually these activities are in the tens or hundreds of millions.

      Thank you for raising THE MOST PERTINENT question. I have been fighting with people here for weeks that MOST everything Justice Thomas did was legal and that Justice Gorsuch violated no law in his reporting of a real estate sale and that Jane Robert's employment did NOT generically present an ethical problem related to recusal, and, most importantly, that the "existing laws on the books" did NOT result in the myth that the United States Supreme Court was WHOLLY DEVOID OF FEDERAL STATUTORY OVERSIGHT AND ACCOUNTABILITY. The "problem," for those who identify it as such, is the administrative standard of REMEDIATION adopted by the Judicial Conference as testified by Jeremy Fogel. The Judicial Conference has traditionally allowed justices to amend their annual financial reports years after the fact. As for recusals, the Supreme Court standard tends to be more liberal on the grounds that, since there are only nine justices, there is a desire to seat a FULL COURT on every issue that comes before it. At the district and circuit court levels, recusal is more readily accommodated by substituting another district or circuit judge to take the place of the disqualifying judge. Both remediation and the impact of recusal are legitimate issues at the Supreme Court level.
      Finally, is the dichotomy of the NON-STATUTORY charge to AVOID THE MERE APPEARANCE OF IMPROPRIETY. Where criminal statutes FAIL to sanction judicial ethics to avoid that appearance, you have far worse than a mere "legal distinction." You create a MORAL PARADOX that literally COMPETES with each other for allegiance. It creates the illusion that either desired virtue is co-equal to the other. It is precisely why we see the public outrage that we see. I maintain this illusion of co-equality is precisely that -- illusory. I maintain the law, as written -- including that which it does not prohibit -- is SUPREME (if you'll pardon the hint).

    I'm a bit puzzled by the "civil penalties" portion of these regulations. Why is there nothing more severe? As an employee of 30yrs I certainly would have been offered a time or two of mistaken document filing. However at some point I simply would have been discharged. At the very least in these regulations there should be a 3 strikes and your out provision. AT THE VERY LEAST. Given the size of infraction, relative to the SCOTUS power, there should be an exponentially greater penalty.
