    Can I get a case review pls also i was able to apply for dreamers but can find a prove that I arrive before 16 but i was in the country .. need to apply for i601a

      I am honestly not sure. As you might know there is currently a class action pending against USCIS regarding the long adjudication periods for I-601As. Unfortunately, from what I understand, the government is fighting the litigation pretty strenuously, arguing that it is reasonable for them to take 3-4 years to adjudicate these waivers. I don't know what is going to ultimately happen. We have to wait to see what the courts say about it. Of course there are appeals that can be taken - this could go on for a long time. In the meantime, I think immigration will continue to take their sweet time in making decisions in these cases.

      Once the biometrics (fingerprints) have been completed you just wait for a response on your I-601A. Unfortunately, I-601As are taking a really long time right now - around 3-4 years

      Hi - thanks for your question. The length of time a waiver can be pending before USCIS depends on where the case is pending. If you look on the receipt notice, you will see where the case is being adjudicated (lower left corner). You can then go to this website to check the processing times for the various applications at the different service centers: egov.uscis.gov/processing-times/. In general, and in my recent experience, I-601s are taking between 13-15 months to be adjudicated, but I have had experience with cases from India taking a bit longer (I do not know why).

      We filled out the I160 waiver on the 30th of May 2023. every time we check it, nothing has been changed. We have been told by the immigration attorney that it will take some time up 3 years.

      Both spouses should file a statement in support of the waiver. The arguments in the statement should focus on hardship to the spouse with lawful status in the US (ie the US citizen or the lawful permanent resident).
