    I work as a registered nurse on a surgical floor. This is what a delirium looks like from medication. Patients will suddenly have no idea where they are, what is happening, and they will get violent. It is more common than people think.

      They will not take the other person away and put him in jail and have to go in front of a judge, unless the other person press charges against them if she didn't press charges they should have never took him they wouldn't have took him plain and simple, she had to say something she may not remember but she had to say something in order for them to take him away and put him in jail as simple as that 🤔

      @@71717did you watch this all the way through because they quite literally explained why he was taken in. Furthermore do you know how our justice system works? Being arrested and actually being convicted are two separate parts of the system and just because you were arrested does not mean you are guilty. That is up to the judge to decide. In a domestic situation most states require separation for the night (please look up Gabby Petito story for further reasons as to why) and in this instance they both admitted to drinking so they were going to simply let one of them drive away because that's a crime? Idk I'm just very confused as to what you're saying and I just think you're ignorant to the facts 🤷🏻‍♀️

    • @PettyDrangonfly
      @PettyDrangonfly 5 หลายเดือนก่อน +49

      @cherylpelletier3165 Exactly! All the way around does not make sense. Just because you call the police because of an issue with a partner, they do not show up and no matter the issue or circumstances have to take one to jail and definitely with no evidence of a domestic issue. They would have to come up with some random charge with zero evidence to support the charges and " my husband is saying I'm not acting right and I'm not sure why but he won't give me my keys so that I can go celebrate my bday by myself! Is not a law that he broke.
      Then they say that they just need to separate for the night and even though she's the one going thru some kind of medical issue and it is causing her to act out irrationally and have no memory the events that took place that night....but the cops thought the best course of action was to leave her there at home...Alone...while having some kind of very dangerous reaction to the meds she took. And they didn't think that any of this was significant or required a trip to the hospital and she didn't want to go get checked out either from what I gather (probably because it would prove something different)
      So instead of taking her to the hospital to get help, they choose to falsely charge him with DV and take him to jail while leaving her alone.
      Come on People!! How could anyone hear these two explain things and not realize that it's all bs

    • @tammybyl4473
      @tammybyl4473 5 หลายเดือนก่อน +92

      @PettyDrangonfly
      At the time of the incident, Kay did not know that it was a reaction to her new medication, this was not found out until later at her follow up Dr's appointment! Also, Kay had told 911 and the officers that Tay was holding her on the bed and not allowing her to leave, that is an illegal offence known as Forcible Confinement, also because they are married, like they stated, it is considered a DV, because a 911 call was made, even though there seemed to be no assault, they will not leave both parties together, as Kay stated, she was also upset that they had left her alone in the state she was in, the police screwed up! Paramedics should have been called for Kay, if Kay had known about the med interaction with the alcohol at the time she would have explained that, but that wasn't the situation unfortunately! Just because things didn't happen the way you think they should have doesn't mean they didn't happen that way! If you're so inclined to be nasty to these people, why are you even watching their channel? Go find some happiness somewhere and let them live their life! I think you need a hug!

      The sad part is that many people that have been in abusive relationships think they will never be in that situation again, yet they slowly figure out that one of their next partners is starting to do similar things. Abusive people know how to love bomb a new partner, hide that side for a while, and then slowly tap into some of the past damage that happened in their partner's past relationship. I 100% believe their story, but I am also sad for victims that one day figure out that they were tricked into it again and feel stupid.
      I was with my ex for 3 years before he put his hands on me. Before that day, I never once felt unsafe with him. I still feel stupid when I think back to the fact that I stayed after that time, but when things turn 180° during a stressful time, you think it is just a one off situation. The only thing that helps me to stop beating myself up is the fact that his brother told his wife that he was struggling watching his brother change into someone he doesn't recognize and doesn't like. That was said before he knew that his brother had changed enough to become physical with me. So if someone that knew him for 25 years was surprised at the change, then I had no chance to catch it earlier. 😢

    I'm a criminal defense attorney. Here are some scattered thoughts. Admittedly, I don't think I'm in the same state as them. But many states have mandatory domestic violence arrest policies, if police have "probable cause" to believe that a domestic violence offense has occurred an arrest must follow. The issue that ends up arising with these mandatory arrest policies is that police essentially don't use any common sense, because they figure "we'll just charge the guy, book him, and the DA will dismiss it if it turns out it wasn't DV." But it can be a very traumatic experience for people, especially people with no crim history.
    Some of the things they said are not correct. Any member of the public can bail someone out, that includes alleged victims of DV. Also, he was not "found innocent." The courts are not in the business of determining innocence.
    He was charged with misdemeanor harassment. What probably happened from the cops perspective is this. The cops separated him. They asked her what happened. "I was trying to leave, he was pulling me away from the door, he was holding me down, he was preventing me from leaving." The cops asked him what was going on. "She was trying to leave." Cops ask "did you restrain her?" Taylor: "Yeah, I held her back because she was trying to leave, and she's drunk. etc." Now you have a victim allegation of physical use of force, a defendant admission. Both probably also admitted to being intimate partners. To a cop, that's probable cause, at least to charge a misdemeanor, and "let the courts figure it out" is something you'll hear often from cops on BWC.
    The two ladies that Kay spoke with were probably victim advocates. They're mandatory staff in most jurisdictions. Maybe also an investigator. DAs do speak with victims, but usually not at a court hearing because they're too busy.
    The judge did not make a ruling, the judge in a criminal case does not make findings of fact. The judge likely dismissed it because the prosecutor made an oral/written motion to dismiss. A judge must grant that motion. If the prosecution doesn't proceed on a case, the judge cannot (obviously) prosecute the case for them. The prosecution is the one which likely evaluated the evidence and decided they couldn't proceed on the case. And their inability to proceed on the case is the operative element, they could absolutely proceed on the case without Kay's consent.
    Personally, I think misdemeanor DV is overcharged. And I've talked to even DAs who agree, ultimately it comes down to the fact that error is inevitable, you want to err on the side of overcharging rather than undercharging, because DV can be serious. And it causes a weird courtroom dynamic...most DV cases are quite weak, DAs win substantially less than 50% of even the DV cases they elect to take to trial, it's partially because the context in which DV happens is hard to prove, and part because many of the cases simply don't have aggravated facts. Any defense attorney who has handled enough DV cases can tell you dozens and dozens, if not hundreds, of ridiculous charging stories.
    Finally, the casual behavior of the cops is something I want to address. Those of us who interface with this on a daily basis have a callousness to the system as a whole. Cops arrest people on a daily basis, I then talk to people in jail on a daily basis. It is easy to forget the impact that this type of situation can have on normal people who don't regularly interact with the criminal justice system. To us, it's just a Tuesday, and this is just another dumb borderline PC harassment DV case that, in the scale of what we deal with, is a relatively small and trivial case. To the people involved, this will haunt them for the rest of their lives. I don't interpret the cops acting casually as them thinking he's innocent, more of them thinking that the conduct they're responding to is low-level. But it's always a good reminder, a certain callousness is necessary to stay in the profession, but these things really change people's lives.

      If they really told the cops at time she was having any kind of medical mental issue as they say he did … aren’t they obligated to call medical and not leave her alone??? Why would he and the cops be ok leaving her by herself ?! Obviously she still had access to vehicles ect… you’d think part of story would be him saying I was insistent they get medical there or call a friend or family to be there with her before they so calmly took him off to jail ect… this is why I don’t believe the story and think it’s something made up after!! I believe what you’re saying I just don’t believe them… he said he was happy cops were coming but then was just happy to go off to jail and leave her alone??? I have feeling it was drunk fight when they came she accused him of something… I’m assuming it was true for her to then when she sobered up came up with this story like most dv victims do! I’d like to see police report and see if either said anything about him being worried about her mental state cause if they did… and anything happened to her after they’d kinda be liable wouldn’t they?

    • @asecmimosas4536
      @asecmimosas4536 5 หลายเดือนก่อน +47

      @@GavynGageHudsynGentry they are certainly not obligated haha, at least not in my state. Cops have the discretion to call medics, they usually will if there are visual injuries, or symptoms like issues breathing, drug overdose. Every resource is finite, including medical. If you have a woman who says she's fine, and a man says he thinks she's had some bad wine because she's not thinking straight, I don't think any cops would call medical. Medical is stretched thin as it is, if that is all you have then it makes no sense.
      This is more common than you think. A lot of people with mental health issues call the cops and say "I'm having a mental health episode." Most of these calls don't end up with medical being called, there simply is not enough resources to do that. And that also belies the fact that, the cops are not your Mental health hotline. They are there to solve crimes. Which is also why I don't think the cops would ever be found liable, practically speaking. They get dozens of calls a week from people who try to use them as a MH hotline, and the most common outcome that I see is that they run the names and pick the callers up on warrants (this is very job specific, obviously).
      Which sort of ties into point 2, cops are not babysitters. Once they have made the decision to charge Tay, and they have removed him from the scene, their job there is done. Usually they give the victim a card with victim resources to use. They do not have the time to babysit her until she is sober again. If, say, she was at a bar, the cops would have her call a sober 3rd party to pick her up, but here she was already home. If she drives, they will pull her over and charge her with DUI. There are simply not enough cops to utilize their time that way. She is an adult, and is allowed to call any friends or family that she wants to come and be with her.
      I don't think Taylor was ok with leaving her by herself, when you are arrested you don't have any say in the matter. I agree that he tried to play up too much the calmness of his arrest experience, arrest is government force, it is a constitutional seizure, but I don't think his leaving her alone was indicative of anything because he didn't do it voluntarily.
      I mean, you're certainly able to come to any conclusions about what really happened that night that you'd like to. Obviously, I wasn't there, so I can't say. I think, in most misdo DV cases, we don't and will never know what happened. Sometimes, I think my clients must have done something, because the evidence really doesn't align with nothing happening, but even still I wasn't there, I don't know who started what, or who said what.

When he was protecting his wife, this is unfortunate. He did not have a lawyer when he went to court it sounds like and that was why he was still charged with something.

      Great explanation. Reminds me of Season 3 of the Serial podcast where they describe the justice system as a train ride where once you're on, it's difficult to get off. Luckily this was no big deal to them at the time but even needing to take a day or multiple days off of work to deal with this or get expensive legal advice on the expungement for example is out of reach for many or seriously sets them back from being able to take care of their family.

    When I was on Cymbalta I was rushed to the hospital with Tachycardia (my sodium and calcium levels were extremely low), and my white blood cell count was super high. It was assumed that I was high on something and I was given a high dose of Ativan to bring my BP down. I have naturally low BP, so I ended up in the hospital for 5 nights, completely out of it from low BP, being given shots in my stomach to bring it back up. I was on an antibiotic IV drip the whole time. They brought in an Infectious Disease Specialist to try to find anything that could have caused the crazy high WBC count, and found nothing. I was sent home with no conclusions. I looked up the side effects of the medications that I was on and found out that Cymbalta can cause Hyponatremia and Hypocalcemia, which caused the Tachycardia. It can also cause IBS, which I was dealing with regularly until I stopped taking it. It worked great for the depression, unfortunately. I had to start again on the long list of anti-depressants to find what works for me. I honestly feel like that medication shouldn't be on the market anymore.

There was no reason/drive for her to leave the house after that. Also, like they said in the video, they would not have had to book Tay at all if there was a third party available who Tay could have stayed with instead. In the state that it happened in, the law only requires mandatory separation. @@trjolly I am glad that your son can take this medication and drink on his medicine. You seem proud as you keep posting. But, I can tell you this medication is awful for others as I was on this medication and hated all of my side effects. I didn't drink on this medication as I take other medicine as well. But, what they described as being confused is a true thing as I seemed more confused than I have been in the 2 weeks I have been off that dang medication. I will never promote that medication. Please understand that not every medication works for everyone and be respectful that everyone's medical journey is different!

      @@trjollyas far as YOU KNOW. I'd wager a guess that you definitely don't know the extent of the impact of that medication, because realistically your son may not even know the extent. Unsure why you're wearing him using this med with alcohol as a badge of honor.

    Damn! You guys are awesome!❤ Kay, when you were talking about Cymbalta my heart dropped. I have dealt with depression for over 20 years and I'm grateful that I have found a regime that has worked for me but I struggled with depression and one medication after another for years and I had the same symptoms when I was on Cymbalta but the Drs refused to believe me, but this was like 20 years ago so hopefully the Drs are more aware now. Stay strong, both of you ❤

    i feel so sorry for kay and tay for what people were saying, when it went viral everyone was hating without knowing what actually happened and the fact that they all were like “omg i can’t believe it, he’s such a bad person” and all that is so sad because they didn’t deserve that and i see how much it’s affected them, people just have to stop hating and start focusing on their lives and their problems instead of other’s.

    I went through a similar situation. I kept trying to leave my house, and my husband of 13 years was like "something's not right, it's 4am" , And I was confused and disoriented. Come to find out I had had a seizure. I had two other seizures after that incident within 2 weeks apart. This sounds so much like me when I have seizures. And you stated that you took new medicine. One of the side effects of most medicines with alcohol is seizures.. so scary. I kept trying to leave too, and I even tried to fight my husband that night, with the other seizures, I tried to fight family members that were around me after I came out of the seizure. I was so disoriented.

    Kay and Tay, thank you for taking the time to share your story. You don't owe any of us any explanations or anything but I want you to know how brave you both are (Matt and Abby you guys are really cool too). Unfortunately, there are some really malicious people out there who love to harm or hurt others and I am so sorry you had to go through this. Kay, I am so thankful you are off Cymbalta now and are doing much better overall. I had a horrible experience with a different anti-depressant (Wellbutrin) so I can understand side effects and how awful they can be. I am glad you both are sharing the truth and that you guys are doing much better overall. I wish you both the best. God bless you. 💜🙏

    I've been saying this since this became a huge thing, you can't assume based off of something that happened once 5 years ago that you don't have the whole story and it's not your relationship to speak on. It's sad that people have caused them to have to relive this, thank you for sharing.

    The police let me drive completely drunk because I said “I wasn’t”. They are so poorly trained, not equipped for most of their encounters and they think every situation is a war situation! More EMT and medical need to be on scene!

      A cop in my area just let a drunk driver go home the other day after he poured out the beer he "cracked open" on the way to the store according to him. I was so mad because they didn't do any sobriety tests no breathalyzer nothing, just a ticket and let him drive away. The amount of people that could have been injured or died. I wish they would have more training and be more strict on such dangerous situations.

      @@kaylarayla_you realize not all cops are poorly trained and some have saved lives and protected us so please don’t have this mindset about all police as I have many family members who are cops and are GREAT people and everyone is different on the way they work or treat others I don’t wanna be rude I just hate when people think this about cops(:

      I fell asleep at the wheel drunk after a concert and hit someone infront of me and cops ripped me out of the car and had me do the whole sobriety field test infront of an entire parking lot of concert goers and I failed miserably, but they let me go anyways because I promised I was “just tired”
      Still my fault and responsibility though. Can’t just blame someone else for your own decision
