      Not a flophouse, it was a transient house, many poor guys just stay for a night or two. My uncle lived in one till there was a famous fire in 1978, Coates Fire in KCMO.

    The Plaintiff doesn't realize HE broke the lease by allowing people to move in and out. He changed the terms of the living arrangements. Cripes, the Plaintiff had SEVERAL people in and out from the very beginning. I was all ready for the Defendant to be a non-paying slacker. However, it turns out the Plaintiff had all kinds of "friends" coming and going. The Defendant had every right to move out early. "Several" roomates was not what he signed up for.

      He lived there as well did you miss that bit? He rented out the loft to the defendant amd they shared the bathroom, kitchen, and living room, so then they are both bound by the lease. The plaintiff though carried on as though he didn't have a tenant by letting people stay over etc.. which means he broke the lease.

      @@sothathappened one probably because he has a dog and two because his father was helping pay his rent. What do you mean accountability? The defendant did nothing wrong, he didn't leave because of the ladder!! He left because the landlord broke the tenancy agreement, the defendant was paying to share the space with one person. Then suddenly other people move in and others stay over so late they crash there. So now he can't use the living room he paid to share, and he has to queue for the bathroom etc... So there is no accountability here for the defendant as he did nothing wrong. The landlord was the problem, so your comment makes no sense.

    Bedbugs are awful. I got them from staying at a motel one night and my home ended up infested for awhile. It made me feel so disgusting. You have to get rid of everything and there were little blood speckles everywhere.

    Legend has it the plaintiff is still questioning how you can break a 6-month lease you signed. Well, the plaintiff broke the agreement before the defendant left. I found it hard to visualize this place, but it sounded like way too much commotion for one dwelling when the agreement was the defendant would be living with the plaintiff only. I get the impression there was a lot of partying and it was an unwelcome ambiance for the defendant.

    Defendant should have turned plaintiff in to code enforcement, the warehouse probably isn’t even zoned for occupants. There was a situation in Oakland across the bay from San Francisco where people lost their lives because they were living in a warehouse that wasn’t inhabitable, it caught fire and many died .

    What is so hard to understand about breaking a lease? It’s not illegal, the tenant just does whatever is agreed upon in the contract. That might be a buy out, it might be you don’t get a security deposit back m, but you can’t make someone stay on a lease😂

    Plaintiff wants to enforce a lease where self serving, but not respect that lease where it concerns his own contractural obligations. Even though the lease will not state it, you cannot lease a house to someone, then after moving in say "BTW, I am giving the key to your house to a couple of other people." The lease comes with the legal protection for the tenant, that the landlord cannot materially change the living conditions during the term of the lease. Landlord breached, but doesn't understand that he breached, because it is all about him. He should not rent until he learns that a lease means mutual obligations.

    Too bad Judge Judy didn't do a little more digging about the lease, as I'm actually wondering if the room was even legal to be rented out...
    In Part 1, it was mentioned that a person has to climb a ladder to enter the room, and that would seem to me to be an immediate fire code hazard, and a landlord shouldn't get permission to be able rent that room due to that and other safety concerns, such as falling off of the ladder...
    Then there is the issue of having only the one bathroom, while I can't (yet) find any U.S. regulation on the minimum number of bathrooms per rented room/person, having 3 permanent tenants plus the extra visitors that stayed over and likely slept on couches or floor, I can't imagine that would pass inspection and another reason why the landlord wouldn't be allowed to rent out that or any other room in the warehouse...
    So if it's actually an illegal tenancy and the landlord wasn't legally allowed to be renting out rooms, perhaps the defendant's countersuit should have been granted and the rent money returned to him...

      I don't think anything in the case was illegal from a code standpoint. Bedroom lofts have ladders, that's how you get to them. It was the intrusion of an unexpected third tenant into the home, where there was already a shared bathroom between landlord and tenant. Nothing illegal to the inspector but a breach of lease by the landlord and discommodious, as JJ put it, as she has rather strong feelings about the ultimate privacy of the bath.

      @@wintercame Yeah, I didn't consider it being like a loft, I was more envisioning an open concept warehouse with very high ceilings (room enough for lots of steel shelving and forklifts to move inventory) with the room(s) possibly being located at a second story height and perhaps needing a 15 foot ladder to climb up there.🙃

    I’m all for artistic living but yea if I move in somewhere and you invite someone to stay cause if hard times that’s your issue I’m moving . I clean my shower twice a week just for ne so sharing a bathroom with more than 1 other person would make me ick and I would def move

    Lease said 2 people, 1 bathroom...when you start adding people, you're breaching your lease! He could have signed a 100 year lease and break it if the landlord breached the contract! Even if it wasn't the bathroom, the bed bugs, the party, you have someone staying long-term, it's a breach.

    Imagine if his family didn’t rally with him and he wasn’t smart, his life could have been ruined.     He doesn’t understand how he gets to break the 6 month lease?? Someone orders a cheese pizza and a coke but later you bring them a coffee,pasta, tenderloin, hotdog, nachos and a sandwich then expect the customer to pay for the entire meal and return happy to the establishment?!? Heck no he can refuse to live there it wasn’t their agreement to have so many people in and out.

    This reminds me of the recent case where someone got a restraining order against a guy, he showed up at his work and inadvertently crossed his path so he said he owed him money for getting within ten feet and "making eye contact" when he saw him. This guy thinks because he has a six-month lease, the guy has to pay four months rent even though he wasn't there. Thank God JJ knows the law.
