You don't need to remove everyone's gun on traffic stops. When I was a cop, I used to tell people, "if you don't touch yours, I won't touch mine" and I never had a problem.

He went from 17an hour to possible 4.5M in lawsuits and damages and potentially mental damage as well for life, i would definitely be traumatized for life to even drive knowing a crazy cop will approach me.

Cops disarming a law abiding citizen should require Probable Cause, and not just "Officer Safety". It's crazy to do this if they aren't conducting an arrest!

I have been pulled over here in north Idaho. I told the officer I had a gun on me and he said just leave it where its at and never said another word about it.
I used to live in Jacksonville. Was stopped a few times by JSO. I was never disarmed at any point. In Florida, you are not required to tell an officer that you are armed unless asked. There was NO reason to disarm that person. It was reported that she has been fired and he is suing JSO.

It may not completely be her fault due to incompetence of her training officer. They started by violating his rights once they called for backup for a routine traffic stop.

Absolutely disgraceful. She has no business being around a firearm. She doesn’t even know how to handle them safely, yet she is a cop and gets to carry one each day. That’s insanity. She is going to kill someone someday. In my opinion, every cop SHOULD be a gun expert. Not in marksmanship necessarily, but in safety. They are literally carrying something that can kill either themself or someone. To be anything less than a gun expert in SAFETY, is just negligence and an accident waiting to happen.
As a LEO, if someone is fully cooperative, gives me no uneasy signs, and willingly informs me they are carrying a firearm, I am telling them thanks for the heads up, and carrying on about my day. We as LE should be more confident around firearms. She should have known how to handle the firearm, but there was just zero need to disarm him in the first place.
Exactly. Im a LEO in Oklahoma. EVERYONE has a gun. Unless someone is acting in a manner that is threatening or ive stopped them for a reason related to such actions, im not taking their gun. We are a Constitutional Carry State but still issue permits for those who visit commie states. When a driver hands me a permit with the DL, it just thank them for telling me, hand the permit back, and move along with my stop. I dont ask nor do I care about their gun as long as it stays where it is.

Now I know feelings don't mean much, but I'll say it anyway. I feel she absolutely should have at least apologized. Logically though, she should keep her mouth shut. As a previous comment stated: to mitigate liability. It's the same as you should never admit fault or apologize in a car accident. Even if you're clearly at fault, especially if someone is hurt/injured. Unfortunately, sometimes what we feel we should do, and what we should do from a "cover your ass" stand point, are at odds. But to my understanding she got fired. So once he gets his fat cheque (courtesy of the tax payer of course) all will be "right" (or as "right" as it could be in this situation).

And the scary part is that she even switched hands with the gun after she pulled it out and before laying it down and both times, her finger went straight to the trigger. She needs to be fired and never allowed in law enforcement again!
It was probably a severe case of whoever was training her didn’t cover all of the criteria. Either way her career as an officer is over and all because some dumb shit didn’t train her properly. Seriously there should be a rule that if incidents like happen, it’s not ending at just the incident. It’s coming to the one who was supposed to properly train the officer in the first place.

In Florida, there is no obligation to inform LE you are carrying. LE is also not allowed to disarm someone legally carrying a firearm. Also, no permit required to carry concealed in Florida

I worked as a state trooper for a little over 33 years. During that time, I encountered hundreds and hundreds of people who were armed. Usually they announced that they were armed and I would ask where is it? They would say it is on their hip. I always told them that as long as it stays right there, we will get along fine. I also, would tell them that all law abiding citizens should carry a firearm. One thing that amazed me is they would hand me their driver license and their hand gun carry permit ( back before Constitutional Carry) and I would ask where is it? And they would tell me it is at home on their dresser. Amazing.
Retired cop here in LA for 34 years. This was an example of a DEI hire, more than likely BEFORE the acronym “DEI” was even a thing. Agencies don’t hire the qualified anymore, because nobody wants to be a cop. So, they lower standards and hire many from the “bottom of the barrel” far too often now.

I was a former Green Beret and former CIA Contractor... they wouldn't approve me because I couldn't give them a contact number to the classified CIA contract... They want dummies as cops. In my 40 odd years of legally carrying, I've never had a cop tell me to remove my gun during the four times I had an interaction. It was always "don't take it out" .

Thank you for bringing awareness to this. Law enforcement should never disarm a law abiding gun owner. And excellent point regarding the disarming technique. Don’t take the gun out of the holster, unclip the entire holster from the garment, KEEPING the trigger COVERED.
This is infuriating and a clear example of why proper training is non-negotiable for law enforcement, especially when dealing with legally armed citizens. A holstered firearm is inherently safe-there was no reason for this situation to escalate into a negligent discharge.
She should be charged with negligent discharge of a firearm causing injury like you and I would be, but that's not how it works in America for some reason.

I was an IPSC team captain and RO at our home range, and over the 6 years I was in charge of "Safety Check" quals, (necessary before you can be allowed to compete in tactical competition) I passed TWO cops! Out of the probably 40 who showed up to qualify. The vast majority of them got all pissy and stormed off when they would (inevitably) fail some portion of the SC. You were allowed one failure (except for a ND or a "flag") IF you could accept instruction and then safely carry out the exercise on the very next attempt. But just TRY instructing a cop; yeah, that ain't happening 99% of the time. They wear a gun, so they're already "experts."
Before they became cops, never visited a gun range in their lives and then becomes a cop with a badge and a gun.....effing scary to think of it that way.
So true. I worked at a gun range for two years and we rotated as range officers. Surprisingly...it was very often LEOs that had some of the worst gun safety practices and gun handling skills.
In Indiana the officer literally says don't reach for your gun and I won't reach for mine and we're both walk away and have a good day. There is never a reason to disarm

Got into an argument once because on PRIVATE land i was helping my buddy sight in his first shotgun and a state trooper said "well i see two of you walking in a field with a gun and that looks suspicious" he then proceeds to tell me that its modified because the serial number was supposed to be on the barrel. Not the reciever....thank god the sheriffs showed up and told him to leave he wanted to arrest us😂

This is one thing I despise about laws in states like Nebraska, where I currently live, which demands that we immediately inform any law enforcement or first responders if we're carrying a firearm. Unless they're about to arrest me, there's absolutely no reason they need to know if I'm armed or not. I have no intention of pulling it out, so they're in no danger from me, and a criminal isn't about to tell them they're illegally carrying, so the law doesn't make any difference there. It's literally just one of those "feel good" laws that don't actually make a lick of sense when you think about it.

In Illinois they can tell just by looking up your tags. I was hit by a car that blew a red going about 60mph. I was fine but shaken. Hands were clenched on the wheel. First thing the cop asked was if I was armed and where it was at. I was like are you serious gun is the last thing on my mind at that moment.

I literally got pulled over for the exact same thing last week...Just barely clipping a red light. I have my Texas LTC so the officer asks if I have my gun on me and where. I tell him it's on my waist, he says ok and just goes about the traffic stop as normal... This is how it should be, especially when the driver is being cooperative and respectful

I’ve never received proper training on firearms and I handle my Glock everyday and never put my finger inside the trigger guard unless I know I’m about to pull it.
It's also a violation of a person's 4th amendment right....the right to privacy, unwarranted search and seizure of his property. The cops didn't have or announce they had probably cause. The victim simply informed he had a gun, which doesn't give the cops the authority to search. Officer safety and victim safety isn't enough. The victim has an excellent lawsuit which would be settled out of court. All the victim has to say is he seriously feared he was going die. When his firearm went off, he believed the bullet struck his main artery. And if that's the case, then he would have 4-8 minutes before bleeding out.

Standard police policy with most departments is to disarm people due to how many armed people will go from being not a threat to trying to kill the cop. 2 years back some sheriff deputies in my town approached a man who had been trying to enter the nursing home in town. As he talked to them, mid sentence he pulled a shotgun and just started blasting. Point is you got no idea what the mind set of a person you are talking to is in, so it's wise to disarm them first thing. The problem here is this female cop put her finger on the trigger while disarming him causing a negligent discharge. Whoever trained this woman cop needs to have their certification stripped.
That’s a completely different scenario though. That guy was trying to break into a place this guy didn’t show any aggression at all, followed every command the officer gave him and had 3 cops surrounding him. Unless he’s Doc Holiday he’s not pulling that gun out. I get wanting to be safe but she could have easily killed this guy or herself/partners. Obviously you never know someone’s intentions but I’ve seen even in this comment section where ex officers or active duty officers tell people don’t reach for yours or make sudden movements towards it and I won’t go for mine. You can hear in the video he obviously wasn’t fully agreeing with the officer in the beginning of the video but neither ever got confrontational and he could have never said he had a gun on him and the situation wouldn’t have happened. I know certain states have a must report law and I’m not sure where this happened but maybe that’s the case.

You can thank Terry vs. Ohio for that one, as they determined that officer safety trumps everything else. Now add a scared cop and you have the recipe for disaster.
It looks like she was trying to remove the holster. But either her nails were too long so she decided to remove the gun instead, or while trying to not break a nail, her grip slipped and she pulled the gun up instead.

I have never been told that I am going to be disarmed for safety. Was only issued one ticket and the Officer thanked me for exercising my 2A rights as I signed for the ticket. I used to live in Jacksonville. Was stopped a few times by JSO. I was never disarmed at any point. In Florida, you are not required to tell an officer that you are armed unless asked. There was NO reason to disarm that person. It was reported that she has been fired and he is suing JSO.

We are a Constitutional Carry State but still issue permits for those who visit commie states. When a driver hands me a permit with the DL, it just thank them for telling me, hand the permit back, and move along with my stop. I dont ask nor do I care about their gun as long as it stays where it is.

Now I know feelings don't mean much, but I'll say it anyway. I feel she absolutely should have at least apologized. Logically though, she should keep her mouth shut. As a previous comment stated: to mitigate liability. It's the same as you should never admit fault or apologize in a car accident. Even if you're clearly at fault, especially if someone is hurt/injured. Unfortunately, sometimes what we feel we should do, and what we should do from a "cover your ass" stand point, are at odds. But to my understanding she got fired. So once he gets his fat cheque (courtesy of the tax payer of course) all will be "right" (or as "right" as it could be in this situation).

It was probably a severe case of whoever was training her didn’t cover all of the criteria. Either way her career as an officer is over and all because some dumb shit didn’t train her properly. In Florida, there is no obligation to inform LE you are carrying. LE is also not allowed to disarm someone legally carrying a firearm. Also, no permit required to carry concealed in Florida

I worked as a state trooper for a little over 33 years. During that time, I encountered hundreds and hundreds of people who were armed. Usually they announced that they were armed and I would ask where is it? They would say it is on their hip. I always told them that as long as it stays right there, we will get along fine. I also, would tell them that all law abiding citizens should carry a firearm. One thing that amazed me is they would hand me their driver license and their hand gun carry permit ( back before Constitutional Carry) and I would ask where is it? And they would tell me it is at home on their dresser. Amazing.
Retired cop here in LA for 34 years. This was an example of a DEI hire, more than likely BEFORE the acronym “DEI” was even a thing. Agencies don’t hire the qualified anymore, because nobody wants to be a cop. So, they lower standards and hire many from the “bottom of the barrel” far too often now.

I was an IPSC team captain and RO at our home range, and over the 6 years I was in charge of "Safety Check" quals, (necessary before you can be allowed to compete in tactical competition) I passed TWO cops! Out of the probably 40 who showed up to qualify. The vast majority of them got all pissy and stormed off when they would (inevitably) fail some portion of the SC. You were allowed one failure (except for a ND or a "flag") IF you could accept instruction and then safely carry out the exercise on the very next attempt. But just TRY instructing a cop; yeah, that ain't happening 99% of the time. They wear a gun, so they're already "experts."
Before they became cops, never visited a gun range in their lives and then becomes a cop with a badge and a gun.....effing scary to think of it that way.

Got into an argument once because on PRIVATE land i was helping my buddy sight in his first shotgun and a state trooper said "well i see two of you walking in a field with a gun and that looks suspicious" he then proceeds to tell me that its modified because the serial number was supposed to be on the barrel. Not the reciever....thank god the sheriffs showed up and told him to leave he wanted to arrest us😂

This is one thing I despise about laws in states like Nebraska, where I currently live, which demands that we immediately inform any law enforcement or first responders if we're carrying a firearm. Unless they're about to arrest me, there's absolutely no reason they need to know if I'm armed or not. I have no intention of pulling it out, so they're in no danger from me, and a criminal isn't about to tell them they're illegally carrying, so the law doesn't make any difference there. It's literally just one of those "feel good" laws that don't actually make a lick of sense when you think about it.

In Illinois they can tell just by looking up your tags. I was hit by a car that blew a red going about 60mph. I was fine but shaken. Hands were clenched on the wheel. First thing the cop asked was if I was armed and where it was at. I was like are you serious gun is the last thing on my mind at that moment.

I have my Texas LTC so the officer asks if I have my gun on me and where. I tell him it's on my waist, he says ok and just goes about the traffic stop as normal... This is how it should be, especially when the driver is being cooperative and respectful

No it shouldn’t. If you didn’t potentially incriminate yourself… you “violated” the “law”. Texas has duty to inform. Technically you violated the law that’s blatantly unconstitutional

Has that ever happened before? Someone being shot by their own gun when a cop is removing it from a holster or was that a truly unique screw-up?
A news article I found said that the officer (Cardwell) was fired and the victim (Arrington) was having trouble doing his job as a forklift/crane operator.

@ officers shouldn’t have to be “trained” on gun safety in the first place. If you’re around guns it should be common sense not to put your finger on the trigger. Shutting down training initiatives have nothing to do with it lmao. No excuse for ignorance ESPECIALLY when someone is shot. I’ve never received proper training on firearms and I handle my Glock everyday and never put my finger inside the trigger guard unless I know I’m about to pull it.
Allowing officers to disarm a person during a traffic stop is unconstitutional. "Shall not be infringed" is very clear and profoundly absolute.
It's also a violation of a person's 4th amendment right....the right to privacy, unwarranted search and seizure of his property. The cops didn't have or announce they had probably cause. The victim simply informed he had a gun, which doesn't give the cops the authority to search. Officer safety and victim safety isn't enough. The victim has an excellent lawsuit which would be settled out of court. All the victim has to say is he seriously feared he was going die. When his firearm went off, he believed the bullet struck his main artery. And if that's the case, then he would have 4-8 minutes before bleeding out.

How does this even happen? Why was he disarmed in the first place for a traffic stop. Why was her finger anywhere near the trigger. So many questions and probably will never get answers.

Standard police policy with most departments is to disarm people due to how many armed people will go from being not a threat to trying to kill the cop. 2 years back some sheriff deputies in my town approached a man who had been trying to enter the nursing home in town. As he talked to them, mid sentence he pulled a shotgun and just started blasting. Point is you got no idea what the mind set of a person you are talking to is in, so it's wise to disarm them first thing.
The problem here is this female cop put her finger on the trigger while disarming him causing a negligent discharge. Whoever trained this woman cop needs to have their certification stripped.
That’s a completely different scenario though. That guy was trying to break into a place this guy didn’t show any aggression at all, followed every command the officer gave him and had 3 cops surrounding him. Unless he’s Doc Holiday he’s not pulling that gun out. I get wanting to be safe but she could have easily killed this guy or herself/partners. Obviously you never know someone’s intentions but I’ve seen even in this comment section where ex officers or active duty officers tell people don’t reach for yours or make sudden movements towards it and I won’t go for mine. You can hear in the video he obviously wasn’t fully agreeing with the officer in the beginning of the video but neither ever got confrontational and he could have never said he had a gun on him and the situation wouldn’t have happened. I know certain states have a must report law and I’m not sure where this happened but maybe that’s the case.
@ they take it so they feel powerful. The chances of someone admitting they are armed and than attacking are slim to none. Cops like to act like they are in a super dangerous job when based of all numbers they are more dangerous to us and themselves than we are. Absolutely zero need to remove him from the car and take it yet they wanted to power trip. They just paid him

Why the actual f did they pull the gun out of the holster and not just slide the clipped holster out of his band?! Also why were they taking his gun without a warrant in the first place? A traffic stop doesn't waive your rights allowing cops to seize lawful property without a warrant.
You can thank Terry vs. Ohio for that one, as they determined that officer safety trumps everything else. Now add a scared cop and you have the recipe for disaster.
It looks like she was trying to remove the holster. But either her nails were too long so she decided to remove the gun instead, or while trying to not break a nail, her grip slipped and she pulled the gun up instead.

When you're at a traffic stop cops are allowed to remove firearm during traffic stop. Some are cool and let you keep.
Absolute incompetence from A to Z. Very respectful and compliant citizen and then this . . . I've been pulled over a few times with my CCW, I have lead foot. I have never been told that I am going to be disarmed for safety. Was only issued one ticket and the Officer thanked me for exercising my 2A rights as I signed for the ticket. Best online traffic school experience.
