Let me summarize JSD.. correct me if im wrong So the 1991 places of worship act excludes the Shree Ram Janmbhoomi Case, yet the Supreme Court in its verdict of 2019 of 1000+ pages reiterates about the places of worship act based on its miss understanding of the Allahabad verdict of the same case where in places of worship act was cited in context of a different case. Also note that in places of worship act 1991 any Mosques nature can be challenged if it has been built on a previously destroyed religious site more than 100+ years..so now we don't need to abolish this act and use this loophole to claim back all the 40000 temples.. JSD is on point as always. Nothing stops us from demanding 40k temples, but the level of bitterness that it will generate and more importantly the time that will be wasted for the enture nation for at least a few decades will make the exercise futile. We should constitute a Truth & Reconciliation Commission to establish criteria for reclaiming the most important temples alone.
The Govt and eminent lawyers should also work for getting Places of Worship Act, Waqf Board, and SC, ST Atrocities Act repealed- they are the most communal acts ever passed
From my POV , JSD has the potential to become CJI . I wish and hope he hold that position one day for sure. And now other thing if he says 40k temples need to be claimed back. I support him. Hindus have been suffering since invasion not just british era but before that too. Constitution had been giving excessively more powers to the particular community in the name of backwardness. And so called secularism is just followed by Majority. Constitution need to be amended not just for this but for all the other laws. Laws should be based on neutral ground. Same for all.
JSD you are God sent with knowledge, education, coolness, understanding the scriptures and able to put it in front of the Judiciary. If someone stole a lot of money from the people/Government and hid it under the ground, does the Government have a right to dig this money out? If your answer is YES then it should be legal for Hindus to claim back their temples. Why should only Hindu structures be expected to be silent, why is not applied in Bethlehem? India was a Hindu society so any other religions are prospering is only because Hinduism does not believe in violence or conversion of the other people.

Supreme Court in 2021 SCC page 1, while dealing with the rights of the deity has said that the rights of the deities once installed can never be diminished. Instead, once installed, this commitment is given a juristic entity. It means, once a deity is installed, that place will remain a temple forever. In other words, the Gyanvapi so-called masjid is still a temple. Now, if a place is legally a Hindu temple, and Hindus want to re-build the structure and worship the installed deity, it cannot be considered "changing the religious character" of that place of worship.
It’s well settled that deity property will continue to be deity property and other’s possession will be invalid. In Mahant Ram Swaarop Das [AIR 1959 SC 951, Para 10], the Court held that: “Even if the idol gets broken or is lost or stolen, another image may be consecrated and it cannot be said that the original object has ceased to exist.”

JSD is on point as always. Nothing stops us from demanding 40k temples, but the level of bitterness that it will generate and more importantly the time that will be wasted for the enture nation for at least a few decades will make the exercise futile. We should constitute a Truth & Reconciliation Commission to establish criteria for reclaiming the most important temples alone.

From my POV , JSD has the potential to become CJI . I wish and hope he hold that position one day for sure. And now other thing if he says 40k temples need to be claimed back. I support him. Hindus have been suffering since invasion not just british era but before that too. Constitution had been giving excessively more powers to the particular community in the name of backwardness. And so called secularism is just followed by Majority. Constitution need to be amended not just for this but for all the other laws. Laws should be based on neutral ground. Same for all.

JSD you are God sent with knowledge, education, coolness, understanding the scriptures and able to put it in front of the Judiciary. If someone stole a lot of money from the people/Government and hid it under the ground, does the Government have a right to dig this money out? If your answer is YES then it should be legal for Hindus to claim back their temples. Why should only Hindu structures be expected to be silent, why is not applied in Bethlehem? India was a Hindu society so any other religions are prospering is only because Hinduism does not believe in violence or conversion of the other people.

Supreme Court in 2021 SCC page 1, while dealing with the rights of the deity has said that the rights of the deities once installed can never be diminished. Instead, once installed, this commitment is given a juristic entity. It means, once a deity is installed, that place will remain a temple forever. In other words, the Gyanvapi so-called masjid is still a temple. Now, if a place is legally a Hindu temple, and Hindus want to re-build the structure and worship the installed deity, it cannot be considered "changing the religious character" of that place of worship.
It’s well settled that deity property will continue to be deity property and other’s possession will be invalid. In Mahant Ram
Swaarop Das [AIR 1959 SC 951, Para 10], the Court held that: “Even if the idol gets broken or is lost or stolen, another image may be consecrated and it cannot be said that the original object has ceased to exist.”
