Amanda Knox Reconvicted of Slander in Italy

- Amanda Knox was mobbed by reporters outside a court in Italy. She was wrongfully convicted by an Italian court of brutally murdering her roommate Meredith Kercher. She served four years of a 26-year sentence before an appeals court overturned the conviction. After 16 years, she returned to Italy to face a slander charge related to the case. She was found guilty and was sentenced to three years in prison but since Knox already served longer than that on the murder charge, she was released.

This Sociopath doesn’t deserve any sympathy, she has always made this about herself, what about Meredith. Amanda may not have been directly responsible for the murder but she is an accomplice.
She did not return to court to face new charges, as falsely stated in this report. However this should be the end ot it bearing in mind that she was definitively convicted of the criminal defamation, on appeal, back in 2011 by the Italian Supreme Court. Let's be clear about the offence for which she was convicted. It was not simply slander but effectively perverting the course of justice. She accused Lumumba of the murder, effectively as a credible eye witness who was there at the time it happened.
The offence, specifically, is laid out in Article 368 of the Italian Penal Code. The Article states that "anyone who with a denunciation, complaint demand or request, even anonymously or under a false name, directs a judicial authority or other authority with an obligation to report, to blame someone for a crime who he knows is innocent, that is he fabricates evidence against someone, shall be punished with imprisonment from two to six years".
And that is what she did, 3 times. Logically, had she been there at the time then obviously she knew Lumumba was not, and thus innocent. If she was not then obviously she knew she was fabricating evidence against him as the murderer. Guilty as charged either way.
The false claim by the reporter that she had been interrogated for 50 hours is also more nonsense, as is Knox's claim that she had been coerced into falsely accusing Lumumba.
The reason this case has rumbled on for so long is because Knox will not let it lie. She went to the European Court of Human Rights alleging that her human rights had been violated. The ECHR ruled that she should have had a lawyer present with her during her interrogation ( a fact which the Italian Supreme Court had already accepted, taken into account, and ruled on, prior to the original trial ) and that the interpreter had been overly "familiar" with her. But the ECHR did not otherwise criticise the correctness of the already definitive verdict. The ECHR did not support her assertion ( at the Appeal Court) that she had been coerced into accusing Lumumba. That is not suported by the evidence, even by Knox's own testimony at her trial, or by what she wrote in her book, in neither of which does the claim actually arise, However the Supreme Court decided, in the light of the ECHR decision, which awarded her a paltry 10,400 euos in damages, that an appeal court should reconsider the conviction specifically with regard to Italy's obligations under the Convention on Human Rights. The Appeal Court's Motivation will be an interesting read.
The Appeal Court - as I have argued elsewhere - came to the correct decision on re-affirming the conviction. Knox remains a convicted felon.
Oh, and she was not exonerated but, bizarrely, acquitted (apparently the evidence was insufficient ) of the murder charge.
Really? Produce evidence to show how the interview with her was conducted. That it was within a reasonable time frame with a lawyer present and no unreasonable coercion. You can't do that because no recordings were ever produced by the Italians to confirm that they did things properly despite this being a legal requirement for police.
@@rogershuttleworth7669 "Produce evidence to show how the interview with her was conducted... You can't do that because no recordings were ever produced" Records WERE produced. @@rogershuttleworth7669 By the way "Produce evidence to show how the interview with her was conducted. That it was within a reasonable time frame with a lawyer present and no unreasonable coercion." Why??? She was not a suspect, even after arrest, which was merely for withholding evidence. She was at the police station uninvited, and was put to work merely making a list of visitors to the flat; its in evidence. She handed over her phone when asked "any more?" and cops found she had hidden Patrick's message saying dont come, no work tonight. Then she snapped - and babbled on for hours "it was him! it was him!" All as described by many witnesses at trial. Even Sollecito blamed her that night and for many months.

@@sursorn5575 Yep. Your ignorance has no end. Under Italian law, an acquittal is a finding of innocence.
According to the Italian legal website "La Legge per Tutti" (The Law for Everyone):
"How does absolution work for not committing the fact?
The acquittal for not having committed the fact is pronounced by the judge whenever the crime has been committed, but not by the accused.
This is the case, for example, of the classic "exchange of persons", in which one subject is wrongly accused instead of another.
In conclusion: the acquittal for not having committed the fact completely exonerates the accused, who has nothing to do with the crime being tried.
Precisely because this type of absolution enshrines the total innocence of the accused from all guilt, it is said that it falls within the hypothesis of "absolution with full formula". "
Therefore, under Italian law, Knox and Sollecito were found to be legally "innocent", not just "not guilty".
