    What evidence should a court be allowed to use to determine if parties intended for there to be a contract

      Well, for starters, the court will look at the contract - or the document that purports to be the contract. If there is a signed contract that is considerable evidence that the parties intended to form a contract. If I'm not understanding your question properly, please let me know.

      Hi LP! I'm not sure but I think you might mean where parties put in the contract a clause stating that the agreement is final, therefore, there is no need for parol evidence. This is often called a merger clause. A merger clause will say something like, "This is the final agreement among the parties etc. etc." The idea is that the parties will exclude any evidence from negotiations or from other agreements to add to or modify the meaning of their contract.
