      Same here. My class claims to be commercial law but seems like general law to me lmao I did not sign up for this.

    Hello thank you for this video, would you know if emails are considered as legal for correspondence instead of mailing??

    this is a mess of a rule, especially if the mail is lost. there's no evidence that the accepted offer was actually sent on the 9th unless it was sent certified. e-mails could work if the message is flagged for being read...then again proving who reads the email would be a issue. thanks for the video

    Hi, thank you so much for posting this video, for some reason the images helped me understand the rule much better . I have a question for you, if acceptance is only effective as soon as offer is sent/dispatch, then can you pls explain the exception they have about not using the mailbox rule to beat an option? { our professor told us this in class- but I'm still a bit confused about it } thank you!

      Hi Mirna, I'm not sure what is meant by "beat an option". But in most states option contracts are not subject to the mailbox rule. That is, in most states an acceptance of an option contract is only effective when it is received - - not from the moment that it is sent.

    Hello, Is the Mailbox rule broadly applicable or only under the UCC?

    • @USLawEssentials
      @USLawEssentials  5 ปีที่แล้ว +1

      IS, the mailbox rule predates the UCC. So the former, not the latter.

    What this misses is the mailbox rules requires that the offeror either expressly or impliedly authorizes a means of acceptance, then if the offeree uses that method or a faster method then the acceptance is effective when dispatched. This video misses a critical points of the application of the mailbox rule.

    "Probably" and "should" are not correct answers on the MBE.

      HF, you should probably rethink your approach. On the MBE, bar exam essay questions, and most importantly real life (should you pass the bar), you will see questions that introduce facts that will cause you to apply exceptions to the general rule. What if you are dealing with an options contract? What if the options contract is being decided under California law as opposed to New York law? This is an introductory video on a simple topic. Knowing that exceptions can apply, the occasional hedging language is useful. Best of success on the exam! More here: uslawessentials.com

      @@USLawEssentials thank you for the kind wishes but I have already taken two bar exams (Ca and Az) and I passed them on the first try, probably because I relied upon Adaptibar. Barbri is COMPLETELY worthless and law schools should stop forcing students to pay thousands of dollars only to fail.

    • @USLawEssentials
      @USLawEssentials  5 ปีที่แล้ว

      Cool. Your law school forced you to take Barbri? Why did you think it was worthless?

    • @heatherfeather9951
      @heatherfeather9951 5 ปีที่แล้ว

      @@USLawEssentials I graduated from Western State University College of Law, the dean emphasizes the importance of jumping onto the Barbri wagon as a 1L. By graduation, most students have invested so much in downpayments etc that they are forced into using Barbri to prepare. A very manipulated method to steer students in the wrong direction. Barbri's rules actually contracted the Adaptibar rule (you form correct rule statements in some issues by looking at the correct Adaptibar answer).

    • @USLawEssentials
      @USLawEssentials  5 ปีที่แล้ว +1

      Ah, I see. Western State has had a problem with bar passage rates, as have many other schools. Sounds like you're saying the school encouraged students to sign up for BarBri in their first year in hopes of addressing the issue? Anyway, glad you passed and kept up an interest in the mailbox rule. Please let me know if there are any other topics that interest you.
