    I was informed that if a collection agency tries to collect a dept that was sold to them by your grantor, you actually don't have to pay the debt. you never entered into a contract (contract law)with the collector, your only contract was with the grantor. They sold the debt and probably wrote it off at tax time as a loose or insurance write off.

      The problem there is trying proving it to Equifax & Trans Union. The collection agency put the collection on your credit report and it would be quite a fight to try to get Equifax & Trans Union to remove the collection without some sort of proof of this. They are not set up to review legal president in credit contract law.

    Don't forget, collections stop being reported once 6 years old , legally. So if at 5 years old collections. Make sure you're paying up front, or can 110% meet your payment plan. Because once you make a payment your 6 years resets.

    I’m in the U.S. and once I paid all 3 collections on my report (with the agreement to remove from my credit report), my credit score increased by 63 points!

    Hi. Thanks for the info :). One question, what happens to unpaid collections when it disappears from your report after the 7 years? If one does not pay them can they still go back on your credit report? Or what can happen if you don’t pay but are no longer on your report?

      Yes, they typically fall off by themselves but can come back if another collection agency decides to register another collection on your report.

    If you settle a debt, you better settle it for a lot less and make it worth your while because paying anything less than the full amount will hurt your credit as much as pretty much screwing them over for the whole money

    I thought collection agencies are entitled to contact your work BUT to some extent. I thought they can only contact your employment under circumstances like to confirm that you are an employer of said job or you as the debtor given the collection agency permission to contact your work (which is probably almost not the case).

      For the most part yes. Your credit report is a chalkboard they you write on each month with your credit activities. Between 6 & 7 years back, your chalkboard gets erased each month. HOWEVER, a second bankruptcy will stay on your credit report for 14 years and a completed property foreclosure will never be removed.

    You shouldn't call a collector because the call is most likely recorded and can be used against you in the case of a possible lawsuit.

      Most every national corporation records customer service phone calls. If you do not address collections, your credit will not improve.

    Hey Kevin,
    My understanding is no matter if a bad debt is paid in full or not it stays on your report for 7 years. So if you hVe a bad debt paid in full you still won't get a mortgage because it shows delinquincy so really it's best not to pay and wait it out..?

      You can still get a mortgage with a collection that was paid. You just need to have other good credit to support that the collection was an isolated mistake.

      A settled debt is a negative on your credit report. Anytime you pay less than you owe someone, your credit will be hurt long term

      ​@@prabeeshsidhu honestly its better to just ignore and let it go away and fall off your report if possible. I understand you may not be able to do this because it's blocking you from getting a mortgage. I would do a few things if this is the case. maybe try a different morgage lender because if it's just one collection and it's old your credit score can still be good. you can also wait to they call you and challenge the debt with never admiting the debt is yours, ask them fir proof in writing. when you get that still challenge them and say thus us not your debt and you are going to take further action. they sometimes don't want to deal with the hassle. if your debt us more then 5 years old you almost always are better off just waiting to the 7 year mark then calling them and telling them to remove the old debt still without admitting its your debt. what happens when you pay a collection it actually hurts your credit because it shows you are actively paying a collection and stays on for 7 years from the time you made that first payment or payment in full.

    I had a cable bill that was over due because I switched providers, and I paid the bill in full to the grantor but it ended up in collections, now it shows a strike on my credit report. I called the creditor and grantor and they both can’t do anything about it. Do I have any options?

      If the collection still show an amount owing on your credit reports, you will need to send proof that you paid the collection to both Equifax and transunion.

    Today. A lawyer called my work telling me a collection agency retained him and I am in serious legal trouble. I hung up.
    Can they garnish my wages?

      Collection agencies rarely use a lawyer unless the amount owed is significant. Be cautious, it could be a scam.

    Can you negotiate with the collections agency to have the collection removed from your credit report as part of your agreement to settle the debt?

      You can ask them to but you may as well do it yourself to make sure it's done. It will not be removed right away, but listed as paid or settled if you settled the debt.

The original debt fell off in January 2021 but it looks like the creditor contracted another company to handle the account and they re inserted it as first delinquency as April 2016 which isn't correct

      They can only remove it from your credit report if it’s a mistake. If they try to offer you this is actually illegal

    I have an account in collections. But on my credit report it doesn't state the collection agency information, as you suggested at 6:40. It has the information from the original bank. Including on time payments, then the late payments, then the months in collection. So I want to make this debt good, but I don't want to pay the wrong entity, obviously. I only want to have this bad note removed from my credit report. Please advise

    Collections fall off the report after 6 years? So after that time you could technically apply for things that require good credit again?

      If you pay it just before it falls off, it could take longer to come off but at least it will show as paid. If it's a small amount it's best to look after it if you are able.

    Hey @ Kevin, What if a very old collection from Ontario Student Loans re-appears on your credit report with incorrect information, primarily showing incorrect dates of debt. Its an old debt from the 90's that has recently appeared as brand new, causing credit score to drop drastic. Any suggestions anyone?

      If it's your debt you may need to pay it. Your best bet is to contact both the collection agency and the credit report to see if you can get it removed due to the age of the original collection.

    I have an account in the 2018 collection. I have received an email from a lawyer that if I do not make the payment, he will take me to court. I wonder if they can do it? Since this debt has been in collection for 3 years and I know there are limits in each province, I live in Alberta.

    I am in BC and have a BMO Mastercard debt of a little over 3grand and am past the 180 day mark.. Just recieved an email from Common Collections Agency saying have to pay in full within 10 days or further action can be required. I am in financial strain including not working at the moment.     What if on your credit report it says closed by credit granter? I have a bill with virgin mobile since 2016 and I tried to pay it but they said there’s no account available and on my credit report it says closed by credit granter.

      That means that Virgin Mobile more than likely sent any balance owing to a collection agency.

      If you do not need additional credit for the next 2 - 3 years go ahead and let them fall off by themselves. If you want to improve your credit now you will need to pay them in full right away.

      I think you're on the right track there Marco. Get copies of the contracts to check your signature. Find out where these contracts were signed and work to establish that it wouldn't be possible for you to be in that location at the time of signing. Your own debit card and credit card transactions at store and restaurant locations can help to establish your whereabouts at those times. I know that it sounds like a lot but identity theft is a difficult thing to fight.

    The collection agency just reported to the credit bureau for 118 cad. They only emailed me once and it was in my junk. I found it myself and replied to them, agreed to pay and asked them for details. They replied after 10days apologizing for the delayed reply. even that email went to junk. Now they just reported it to trans union . This is the only collection my account. How do I remove it. Please help

    The collection agency called my work and asking them to connect me. When we were connected, I told the agent that I do not give them and the CA permission to call my work. She said they don't need my permission and the only reason she called my work was because she couldn't get a hold of me since I "do not have a voice mail or picking up my phone."       If you ask them not to contact you by telephone at all they must abide by that. You will need to send a letter requesting that all correspondence be by mail. If they do not cooperate you can make a complaint against them with the Financial Consumer Agency of Canada.

      You will need to come to some sort of agreement with the original grantor. The collection will remain until you do that.

      It would depend on the circumstances. A credit dispute would be a debt that was charged without cause of any kind. I have never heard of a collection agency turning to the courts.

I just mean in terms of proof, I've heard from some that the IP or a digital signature can be used but in the case that the computer was hacked or a family member used the same wifi and the person found out months later (happened to my cousin) would that (the IP or signature) still be evidence?

      I am not a lawyer or versed in digital fraud so I would be unable to comment on your question about hacking @@branden8915. For your second question, you are certainly within your rights to request details of the collection without committing to full or partial payment. In fact, any documents that are sent to you by the collection agency may be able to assist you with your efforts to dispute the debt. If you recall from my video, the collection agency is not obligated to update your credit report whether you paid or settled the account.

    I have around 6 debts with collections to pay off & I plan to have them all paid in full within 2 months. However, there is a 7th item on my credit report which was a vehicle in which I co-signed on. It shows up on my credit karma account as a judgement against me with no amount on it. When I called the company I owe the money to they wanted $10,000 to settle & I was only the co-signer. If I pay off the 6 debts & leave the judgement against me, will my credit score increase? What would you suggest as my best option? Thank you!

      Some provinces in Canada (mine included) have "seize or sue" rules for debt collectors. That means that they can either seize the asset (a vehicle in this case) in order to recoup the debt; or they can sue you for what is owed. They are not allowed to do both. If you live in a seize or sue province, once the seizure took place, you are no longer required to pay the debt. Now getting this fixed on your credit could be difficult but it can be done.

      In Canada, they are regulated by the federal government. So no, they can't just make up a debt and put it on your credit report. Of you have a collection on your credit report that you never had a debt for, that is a mistake. Watch the video again. I am very clear about what you need to do.

      Unless it's a collection for a very large amount, the lawyer bill will be way more than just paying the debts. Follow the instructions in the video and do it yourself.

    hey kevn. i have td coming after me for money for my insurance. i paid in full at the start of the year. a few months later i get a registered letter in the mail saying i owe them 50 dollars and because i didnt pay my policy has been cancled and a check returning all the money i paid to start. over a year goes by i get a call from collections saying i owe td over 400 now. should i still have to pay this?

      I hope you kept a receipt or paperwork from when you paid the collection. If you did you can send them proof that you paid that account to a different collection agency. You may need to contact Equifax and transunion to also let them know that that new collection was paid previously.

      Paying the debt in full is always better than settling. Once you are clear of the collection for a year or two it will matter less which you do. If you only save a few hundred dollars by settling, it is better to pay it in full.

      Not to my knowledge. You can get the collection to show as paid yourself for free. It will fall off your report eventually.

    Hi Kevin, superb videos' and content. Could you please guide me with the correct process to handle the bad debt collection as R9 from my credit report. I am ready to pay the amount as shown in credit report which is 9 K. Option 1, should I pay in full in once. Option 2. Pay as settlement. Option 3 : Pay in full but in monthly payment to show the payment history. I am going to buy my first home in next 6 months. I already have a car loan and credit card , I am paying the car loan and credit card on time every time my score is 541. Your comments will be very important for me and take me to the level where I can get mortgagee after 6 months. Thanks in advance

      If possible, pay it out in full all at once. You will need to have at least 1 credit card with 100% payment status for at least 1 year after an R9 was paid.

      Hey @@ManishKumar-qf4gx It might be possible to get a mortgage after only 6 months. It will depend heavily on how the rest of your credit report looks. Other factors like amount and source of down payment and your income will also play a roll. I will be happy to assist you. Check your report in about 6 weeks to be sure that the collection shows as settled or paid.

    Hello sir i was emailed by metcredit. For 202 cad and i paid them with credit card of my friend . Can u tell me is there any way that my collection report could be deleted from my credit history if i have paid the amount fully . Or do i have to wait 6 years for it to automatically delete. I am an international student and do-not know about canadian systems . And the metcredit agent told me to wait 15 days for the payment to reflect and then u will get ur paper statement letter.       The collection agency will not remove it. You must update both credit reports yourself and outlined in the video.

      Yes you should. Having unpaid collections will prevent you from getting a mortgage.

      You can do it yourself. Pay off collections, update your credit report, obtain new credit, don't go over your limit and pay it on time. Companies that offer to do this for you are only taking your money.

    I have a collection agency that recently put a claim on my credit report, the claim was from 2017 when I was in high school for a overdraft for my checking account it’s around $711.
    Do I have to pay them or is there a way to take it off my credit report since my contract was not with them directly?
    This is my 3rd bad debt claim on my credit report, do you think this will completely mess up my chances of getting a mortgage within the next 3 years and also what would you recommend your credit score being before going to the back to get a mortgage?
    I just turned 23 years old

      Don't believe what you might see online about not owing a debt directly. The best thing to do always is to pay the collection in full and get your credit report updated as soon as possible.

    Manitoba department of Justice, sent a traffic ticket to a collection agency. When I speak to them they say there is a 30 day grace period before it gets reported to the credit bureaus. Is this true? I'm not sure if i should pay without knowing cause I was asking for a paper/settlement letter to be mailed to me but they keep saying that its not necessary.

    Is there a program that pays your collection agencies and you only payoff one debt with monthly payments. A program that does not involve refinancing your home?

      There are debt settlement companies out there, but I don't recommend them at all. Working with a trustee within a consumer proposal or a bankruptcy is a much better way to go. That might seem extreme but if you have enough collections that you are looking for a way to consolidate them, the damage to your credit is already done.

      For that small amount I recommend that you just pay it in full. Make sure that you hang on to the receipt just in case they sent it to a collection agency. For $41 it probably wasn't worth their time to go to that effort anyway.

    My credit score is different on the Credit bureau.
    On Equifax it shows collection but on Trans union its clean chit. Howz that possible?

      That is very normal. Equifax and Trans Union rarely match exactly.

    What does this mean?

      That means that it was sent to either and internal collection department or a 3rd party collection agency.

    Hi Kevin. My girlfriend has a collection report on her report. She paid it off in full but it’s effecting her chances of getting nee credit. Other than the collection , the rest of things on her report are just perfect. Is there anyway she could get it removed. Please help. She makes 100k a year and has 760 credit score. But still not able to get any nee credit card because of the collection on the account. Please help. We live in BC. Thank you

    I owe a dentist $400
    They contacted me a couple of times but due to some personal reasons I couldn't pay him and as a result he reported $400 to the bureau and my credit score dropped from 760 to 360 immediately.
    So now I've decided to finally pay him the owed $400, question is do I pay him directly since he did not send it to any collection agency as the collection money on my bureau shows only the doctor's office info and not any collection agency
    Do I pay him directly?

      It is unusual for a collection to be put on your credit report directly from the creditor. Be sure that a collection agency is not involved. If it was put on by the dentist then you should pay their office directly. Make sure to get a receipt and send copies of that to both credit reporting agencies so that the collection can be updated as paid.

      Hey Jackie, thanks for your question. I don't really know how collection agencies come up with how much they register collections for. Some are around the same amount or a bit higher than the original debt was. I have seen some that started out at $1,000.00 and the collection was for 3 or 4 times that. The only pattern I have identified is that the older the debt the more they ask for.

      Hey Nilesh;
      I have had personal experience with a local car rental company as well. I photographed the entire car prior to leaving with it. There was a VERY small stone chip in the windshield that I missed. They tried to charge me for a complete windshield replacement. I demanded that they give me the name of the glass company that does their repairs and replacements. When I contacted the glass company with the vehicle VIN, they confirmed that the chip they said happened when I had it, was already repaired a month earlier.
      Did you actually rent a car from & when the collection agency says that you did? If you did, then there could be come things you can do. Check with your credit card company that you used for the car rental to see if car rental insurance is available as a perk on your credit card. Some insurance that you might have on your own vehicle may have additional coverage for rental cars. Check with your car insurance company to see if you have any rental car coverage.
      If the repair has already been done, you will want to see the invoice for the repair that clearly shows the date is soon after you had rented it, the VIN of the vehicle and detailed description of the repair. If the repair cost is significantly more than what is reasonable for the damage, you may have a fight on your hands. If the repair is not yet done then you will want to request that the repair cost be estimated by a local autobody repair shop that you designate.
      Take detailed notes of all your communication with the collection agency, car rental company and autobody repair shops. This could help you fight this with Equifax & Trans Union to get the collection removed by proving that they were just trying to get more money from you than what the actual reasonable repair cost would be.
      Stay calm and reasonable with your interactions.
      Getting angry only gives them the upper hand.

      Hi,
      When I returned the car they find the scratch. I requested to show me footage while taking car so as they can see scratch was there before I rent it. But the guy who was on the counter told me he don't have access to it. There for someone from office will get back to you.
      I waited for 2 days no response then I called them again,same answer will get back to you. Apparently lady called me and said I need to pay 3k for all the damages. Showed me contract which I signed and said it was your responsibility to check before you take it.
      When I asked for explanation of 3k for such a small scratch she sent me a invoice. And since then it is just going back and forth calling and mailing. Finally it has gone in to collection agency.
      This incident took place in 2018.
      They just want to rip me off for nothing. And no valid justification.
      My question to you what would be the consequences if I don't pay this.
      Please advise.

      @@nileshn.8311 If you do not address the collection, it will drag your credit score down significantly. Since it happened so long ago, you may be forced to pay it in full or settle the debt.

      If the collection is not yours and you can prove it you should be able to remove it. If it is yours and you pay it then you can get the collection to read as paid. It will fall off your credit report in time.

Say you have 6 under ranging from 700-2500, you pay them all, am I *unable* to improve my score to house buying level *until* those marks are gone?

      Hey @@branden8915 If you have 6 collections, you are quite a ways away from getting a mortgage in your name with less than 20% down. Once you have paid off the collections you will need to get a new credit card. You will need to keep that one in perfect condition for at least 1 year and more than likely 2. Your credit score will rebuild gradually over time as long as you keep up with that new credit card.

      Actually no. Mortgage lenders like to see the new re-established credit start after all the bad debts have been paid and updated on your credit report.

    Your video isn't informative your not telling the whole truth after 6 years you don't have to pay a collection agency once it falls off either of your credit reports and after it falls off as long as you don't edmit that it's your debt and ignore them completely they can't put it back on a report all they can do is email or call you so why would I pay them if they can't put it back on my report not telling people this that don't know will make them reset the debt which is pointless and if you reset your collection paying it off in full does not affect your actual score because regardless of it being settled or paid in full its the fact that there's a collection on your report is the thing that hurts your score not the status this video is olny relevant if your planning on getting a mortgage or any other majour loan

      You are correct in theory that bad debts most of the time disappear off your credit report after 6 years. However, I pull credit reports for my clients every few days so I see quite a few of them in the course of my work as a mortgage broker. On more than a few occasions, I have seen debts older than 6 and even 9 years re-appear on Equifax to ruin my clients credit report. Like it or not, this is the truth.
