I once got pulled over for speeding, arrested for refusing field sobriety, and pleading guilty to misdemeanor possession after passing the breathalyzer back at the station. Should've fought it but after they pushed my court day almost a full year(7 new court dates) I just paid the fine😔
@@phuckyoucensorme Cops aren't noted for being fine upstanding citizens. They took your money and probably knew what they were doing was illegal. No where in the US can you be forced to take a field sobriety test.

Which is why i tell them a super long list of diseases, allergies, plants around me. And in the middle of the test i tell of my major left knee surgery, cataracts and half my intestines and bladder is missing and i gotta pizz on the side of his car wheel right now, its my medical emergency.

As I told Judge at Trial jury duty, "police are liars." I was dismissed.

The sergeant could have easily corrected his officer when he said that his body cam is not public record and that you can't access it . . . but these pigs cover for each other 100% of the time, they will never correct one another, not even if they witness another officer commit a literal crime.
Maybe you can't access it. Body cams fail, or the files get "accidentally" erased before defendants lawyers can complete a FOIA request all the time.

Alcohol does have a smell because it smells very similar to hand sanitizer hand sanitizer is composed of alcohol but not completely and if it’s flavored it’s going to smell almost odorless you can in fact detect chemicals that seem odorless the only chemical you can’t detect that’s odorless is water or engineered poisons.
Call them out for blocking roadways, parking illegal, any infraction you see them do that they would write a ticket to you for.

Ask for a breath test, or let them take you to the nearest hospital for blood or urine tests, and file a lawsuit when nothing shows up for illegal detention. As for the supervisor saying i just got here, he's lying. If you FOYA the dispatchers records for the time the officer called the supervisor, you'll hear him whining that you won't take his field sobriety test. Then asking if you still live at such and such address, then admitting that he sees you there sometimes, just proves that they're always fishing for you to say anything that they can trip you up with since the I smell alcohol lie didn't work.
Unfortunately, prosecutors need cops to be credible witnesses. The odds of getting him prosecuted for perjury if he said that under oath is about nil. It would get brushed off as an honest mistake. He's absolutely allowed to lie to you at the roadside during a traffic stop. He's even trained and encouraged to lie while questioning you if it might help him manipulate you into self-incrimination.

The cop seems to be slurring a bit to much. Maybe he needs the field sobriety test.
I've lost count of how many times I've seen YT videos where the cop claims to detect a strong odor of alcohol from someone who later tests at a 0.00 BAC. Often they rattle off slurred speech and bloodshot watery eyes, but I'm not sure how they can discern this in the dark. From the moment they arrive, the ones with body cams are trying to manufacture and document probable cause for anyone reviewing it later.

Every one of those things you listed are things he's trained to do. The Sergeant would be proud of him for following his training. "Lying" class is called "pretexting" at law enforcement academies. They're also taught to "project authority," meaning that they're _supposed_ to bluff about not knowing your rights. He knows you don't _have_ to answer questions, but he also knows that he can make it uncomfortable for you to exercise that right by pretending he doesn't know you can refuse, or acting offended that you insist on exercising your rights.

Then when he sees everything is in order he makes up the I smell alcohol bit. Aussie had to say was I'm sorry sir I didn't see it correctly you have a nice day. No license, no registration, no proof of insurance needed when you made a mistake.
If "I smell alcohol" can be so freely used and abused by cops, people should start to calling into police departments to report various cops for smelling like they are using alcohol and drugs . . . any report phoned in by the public would meet the same standard.

The BS “I smell alcohol”. In an implied consent State, like where I live that can cost you tens of thousands of dollars if you refuse.
It’s a one year license suspension if you’re drunk, but can be two years if you refuse (and you can be sober!!!)
Once you refuse, your insurance makes you file as a high risk driver (Same as being guilty with a DUI). So you’ll pay 7 years of hyper inflated insurance premiums. If you win in court and are determined to be 100% sober, insurance company doesn’t have to remove your high risk rating.
I'm in an implied consent state. I have to take a chemical test or it's an automatic suspension of license, but the biased, subjective, field sobriety test is still optional.
