On counties, the similar ones should be merged e.g. Kericho and Bomet should be merged and called Kericho-Bomet County. This will reduce the number of counties and cost of governors and senators. Opinion.

Interesting, Zimbabwe going through same challenges, having a fairly progressive consitution, which is, however, not being respected in many respects. One big challenge is the lack of consitutionalism among the politicians and attacks on key freedoms.
For an extended duration, the institutions designated as the public overseers of all governmental operations have exhibited lamentable performance, occasionally descending to the level of collusion with politicians in the embezzlement or concealment of public funds, all while evading accountability. Figures such as Prof consistently focus their attention on the transgressions of politicians without scrutinizing the root causes behind the emergence of such unscrupulous leaders within our nation. Notably, Former US President Trump is not being indicted because the American political establishment is committed to hold him answerable. He faced impeachment twice during his tenure, yet the proponents of impeachment could not muster the requisite numbers to oust him. Instead, it is the nation's institutions that have undertaken the task of bringing the former rogue president to justice. Prof ought to grasp the reality that politicians, much like any individuals bestowed with near-limitless authority, inherently tend towards corruption. It would be a futile endeavor to expend our energies crafting legislation aimed at fundamentally altering their inherent dispositions.

I used to have the same mentality as you, i thought Africa's problem was that our politicians have near-limitless power, its only later that i started questioning my believes and opinions that i realized actually we Africans are wired to be knowledge dependents of the white man that's why at best we can only be plagiarist of western ideology rather than having homegrown solutions., since the white man says its lack of limits everyone is rolling with it.
Look at East Asia, it has its own share of what you term as near-limitless power from former Singaporean prime minister Lee Kuan Yew, to South Korea's military dictator Chun Doo-hwan, to China's CCP regime currently headed by Xi Jinping, but you will never see the nonsense you see in Africa just look at South Africa, Kenya, Nigeria, Ghana, Senegal we have checks and limits in our constitution than any East Asian country but when it comes to practicality we are worse of.
Stop blaming the constitution, institutions and all this other things, we are only over-legalizing the fight against impunity and corruption, the problem is our culture, East Asian culture finds its inception from the Confucian culture which is very intolerant to impunity but African culture has been contaminated with western colonial systems and culture, impunity is everywhere from the politicians misusing the office, to the lowest civil servant collecting bribes, to false pastors in churches down to the lowest farmer adding water to sell more milk, what Africa needs is visionary leaders like Paul Kagame not tribal village idiots going around and bastardizing the word democracy and rule of law to legitimize themselves.

Many agree, what was not discussed is the cost of change; financial, time, planning… which are key inhibitors and main cause to the procrastination soundness. Prof´s community should provide a solution especially in a society on economic life support.

I support the proposal to review our constitution. I think this review should be informed by two key consideration namely;
How do we ensure that the most eligible individuals have equal opportunity to represent us in elective offices. Currently, most eligible Kenyans would not even think of offering themselves to contest for political positions because of the massive odds involved. To start with the party nominations are shambolic, the financial resources involved are enormous and when you lose you lose everything. Those who win are forced to pledge allegiance not only to the voters but also their financiers and this is how conflict of interest kicks in. This is a riddle that needs to be resolved. The process of chosing our leaders ought to be thoroughly inclusive and meritorious. This way we are likely to get good leaders.
The second point that needs to inform constitution review is the need to reduce the economic burden currently imposed by the bulky structures of political representation at national and county levels. Let us substantially reduce the number of political seats and offices.
In conclusion, Kenyans need to recognize that we ail because of the quality of leadership we get. We need to design our constitution in a manner that we are likely to get leaders with capacity and will to deliver.

Can we all agree that the new constitution has not benefited the ordinary mwananchi in any way. Devolution has only devolved corruption, tribalism, nepotism, etc.
Additionally, we are over represented. Lets reduce counties to the former provinces(8), abolish women representatives, reduce MCAs, reduces MPs, etc. This will lift the unnecessary burden of sustaining these people in office and redirect the funds to development.

To remove ethnic mobilization in our presidential elections we must move to a pure parliamentary system of governance or have leader of government who is prime mister from majority party then elect president who is symbol of national unity.....tribalism rears its ugly head mostly during elections. Prime minister will then be accountable to the people through their elected leaders in parliament.
I agree with PLO on the issue of chapter 6. We have failed to adhere to what the writers of our constitution envisaged.
I also agree with him on the issue of counties. Raila himself had suggested we revert back to regions as counties and break up the large ones. We can not afford to increase county numbers remembering some cannot even pay their recurrent expenditure from their own revenues. We have also devolved corruption big time at the counties.

Why do we always run around from the elephant in the room which is financial management of county resources instead we waste resources amending the constitution while the real problem is misappropriation and waste of county funds, as a result counmty folks are denied the benefits of devolution.
The problem is not more offices it is the utilization of resources. What we need is an an amendment of the constitution embedding financial management of resources at the county. Put in systems and procedures on utilization of county funds. How funds are being utilized at the county. Thats where the problem is. We need new structures on county financial management and on source revenue collection.
We need a ward fund. Wards are the real grassroots and real devolution. As it is devolution stopped at county HQ. Wards need to receive their own funds as opposed to funds going to county HQ to be corrupted and wasted. We need a mechanism whereby counties are able to optimally collect their own source revenue. Ideally own source revenue would be able to pay for county operations and then the funds they get from govt go to development projects or at least 70% of funds go for development and 30% to feel in the gaps where county on source revenue is inadequate or to finance major projects.
Today counties are only supposed to meet development threshold of 30% of funds they get from govt; meaning 30% of funds coming to counties from the govt goes for development. can you imagine that. 70% supposedly goes to pay salaries and operational costs. The ideal situation should be the reverse. 70% of funds need to go for development and 30% for operational costs.
Thats why i say we can change the structures of the constitution day long till the cows come home but the people will not feel any difference just the bureacrats. Thats why we do not need to change the constitution we need embed a financial management structure into the constitution.

During the Berlin Conference of 1885 the euros took the over 2000 independent sheikhdoms, kingdoms and chiefdoms and reduced all of Afrika to the present 55 colonial slave states. None of the politicians never speaks on this but it an issue that will have to address eventually.

Drafter of the current constitution left too much to parliament to decide. They ended up mutilating it. You should abolish political parties. You should give the presidency to a different tribe every 5 yrs so each tribe has a shot at the presidency. If you want to end tribalism in Kenya, the govt should own all land. This will enable Kenyans to live wherever they want thereby getting rid of tribalism. In US as you people like to compare, land belongs to govt. One pays taxes on the land they live on or develop. If one does not pay taxes, govt takes back the land and gives it to whoever can afford to pay taxes on that land. This enables Americans to move from state to state as they wish.
I agree with you on most of the things you have said, however on the issue of ending tribalism by the govt owning all land i think you have it misplaced, tribalism is entrenched by the same govt you want to own all land, to end tribalism we must have a mechanism that ensure equal and equitable distribution of the national cake no matter who is or what tribe is occupying the presidency, take for instance what the CS transport was saying today about how he will oversee distribution of new roads in Kenya and supported in the same vein by the DP, to an extent of even quoting the bile, as if when tax is collected it's only done from the two tribes they come from, how do you think other tribes feel when they hear such kind of sentiments???? Secondly the judicial system has to wake up and work, and act promptly, if someone commits a crime there has to be immediate consequences,like the chicken gate scandal,how was it delt with in Europe, those who collaborated with Kenyans to commit the crime in Europe have finished their jail term,and have served as example to anyone who my think of commiting the same crime,in Kenya the case has never gotten to hearing!!!!! there is no way someone can go somewhere, buy a piece of land under willing buyer willing seller, a valid title is issued but when there is a slight political disagreement then you are told to move from your land, like for instance where i live it was open knowledge in 2007 the youth used to say before elections that wether Raila wins or not the people from the mountain must surrender their land, which they bought with their hard earned cash, and true to their word when the post election violence broke out that mission was achieved, to an extent some people were even burnt in church, since then who has been held accountable, who has the judiciary indicted?, How many people went back to thier property in the Rift?If anything some of the suspects are now senior leaders in govt, the judiciary MUST with urgency ensure anyone, your status not withstanding must be expeditiously punished when they break the law, to act as a deterrent for anyone who think they can brake the law by moving people from their rightful property in the name of their community, that way sanity will prevail,bila hiyo zii,and by the way prof is eloquent, informed BUT LACKS ACTION, who does he want to do this things he is talking about, all the time he complains but keeps supporting successive governments that are milking us dry, kindly dispute with facts

I have always said that democracy is not the best form of governance in developing countries based on the examples you gave. I don't think you can arrest 100 government officials without creating chaos.
The form of government prescribed by any subsequent Constitution should be based on timeless principles for Africa's/African's independence from anything or anyone. Subsequent writings should establish the formal and final causes of Africa and make possible the freedom that is the birthright of all Africans.
Can the panel pls clarify the situation where you change / amend the constitution is changed to suit the system that is in place at that moment is it not unconstitutional
I have gone through the comments and I frankly wonder why nobody is telling Prof. the truth. The fact that he has not explained his tangible proposals to amend the constitution. What exactly is he proposing? He is wasting our time with difficult English. Nothing substantial.
Our biggest challenge is the fight for the state by rich individuals who want power, but hide behind their ethnic groups. Today Gachagua speaks like every Kikuyu has a problem with Luo, when, frankly, we need each other. He has to speak that stupidly, otherwise he will not survive politically.
We must ask ourselves - from where does this desire to exclude others come? This desire to dehumanize others through police violence? From the massacre in 1969 to to the massacre in 2023. Lumumba does not feel bothered by these issues?
That some fellow calls himself president but congratulates police for maiming civilians - not a tone of sympathy. How did we become this cold and heartless? What is this madness? What are we really fighting over in this country? The people who plot and cheer up this state violence against civilians will pay a heavy price. It is my prayer every morning that the people who enabled this state violence pay dearly.
The one significant solution will be to have Kenya embrace regionalism - a federal structure where we have 13 regional governments, inclusive of Nairobi. The regions can handle day to day political affairs like education, health, roads, water, electricity, land etc while the national government can handle national issues like defense, currency and foreign policy. Of great importance will be the police and the courts - the regions should have their police units accountable to the regional government. Never again shall a hateful mob in police uniforms storm our homes, evict children and pump nine bullets into their backs, as sick people cheer them on. Never again shall the police protect Kalenjin militia as it lobs poisoned arrows and spears in Sondu and Jimo, and cross over to cause havoc, as happened in July and August 2023.
We demand partial autonomy for every region. Otherwise we will move full throttle, exercise our self determination rights, secede from the Kenyan state, and create a country conceived in liberty, where we are not dehumanized. We have nothing to lose by fighting for our liberty. Enough is enough.
Dear Prof. Lumumba, fix the issue, otherwise, one day there will be a violence that none of you will ever quell. Do not waste our time with cosmetic and nonsensical changes. Use your intellect, charisma, and persuasion to propose a game changer that will preserve the country and foster cohesion. We negotiated for our independence on the understanding that the 1963 constitution will have provision for regionalism. It is not too late to go back to that system.
The day we are fully done with the Kenyan state must never arrive. Because that is the day the Kenyan state will end as we know it currently. It is the leech that has sucked the blood of our children and showed us utmost contempt. It is in Kisumu where the life of a Luo child was snuffed off by the shield and boots procured by the corrupt hateful Kenyan state. And nothing happened. The day we wake up to fight this bloody system, we will send a strong message that will reverberate for centuries, and permanently put a stop to this injustice.
Tell the powers that be, that the collective bitterness of a people, brought by decades of political injustice, will swell and burst, with very serious consequences. And we avoid this potential violence by creating institutions that guarantee the partial autonomy for each region and ending this fight for the state once and for all.
We are peace loving citizens who want to live, work, study, trade anywhere. Nobody should ever desire to subjugate or rule another. Nobody should ever dream of suspending the constitution, and unleashing terrorists in Subarus to fire into the estates and spread terror. Because none of us is immune to a state of lawlessness and disorder. The law is here to make us better. The social contract is here to avoid the situation where human life is short and brutal, as Hobbes states in the Leviathan. If our state does not accord to us equal citizenship, if it does not treat all of us as shareholders, if it cannot guarantee liberty to everyone, then it better be fixed. And be fixed now. Yes, Our problems cannot all be fixed in our lifetime. But our tribal fight for the state will be fixed forever by devolving political power to each of the units that comprise Kenya.
