How the Trademark Registration Process Works

  • The trademark registration process in the United States typically takes about 8-10 months from start to finish. This video provides an overview of this process and the steps involved in obtaining registration.
    After filing your trademark application, it will take about three to four months for the USPTO to initially review your application. This step of the process consists of an examining attorney reviewing your application to determine if any conflicts exist with another trademark and ensuring your application meets all the technical requirements.
    After the examining attorney has finished reviewing your trademark, they will then forward it for 30-day period of “publication.” During this publication period, any member of the public (or another company) can oppose your trademark application if they feel they could be damaged by the eventual registration of the mark.
    Once the 30-day publication window closes, the application is sent back to the examining attorney for final review.
    If you filed your trademark "in use," meaning that your products or services were being sold at the time the application was filed, the examining attorney will issue the registration on your trademark, and a registration certificate will come in the mail. If you filed with intent-to-use the trademark, you will be required to file a statement of use proving you are now selling the product or service prior to receiving your registration.

    Very informative! One thing I was not totally clear on. If you file an "Intent-to-Use" when it is time to file a "Proof of Use", is that an additional fee; or merely an subsequent ask once the trademark is approved (and before the trademark is officially registered)? Thank you in advance.

      There are additional fees required to file a proof of use. In most cases, if you are using a private attorney, there will be a fee associated with the filing. There are also government fees of $100/class necessary to make the filing.
