Many estate require an administration. An administration is necessary when estate matters need to be handled from the time a person dies until the time that the court approves and finalizes the distribution of estate assets to the appropriate heirs.
Estates are often administered when estate property needs to be sold, estate debts need to be paid, estate attorneys and accountants need to be retained, estate investments need to be managed, or businesses the deceased owned need to be run.
When a person dies with last will and testament, the executor named in the Will is in charge of the administration. If a person creates a revocable living trust and transfers title to their assets to their trust, the Successor Trustee will administer the trust assets after the trust Settlor dies.
If a person dies with no legal plan in place, a judge will appoint an Administrator, perhaps from one or more people who apply for the position as Administrator.

Can a beneficiary who will be making and filing a forced heirship claim request an independent administrator of the succession who is not the executor or administrator named in the will?

What are the pros and cons of having the estate attorney also act as administrator? Would the estate attorney be able to bill some or all of their administration tasks as lawyer fees? That would, of course, enable them to receive a lot more money as administrator than anyone else would be able to get out of a smaller estate.

Can the admin make changes to the estate money disperse rates to an admin? Like instead of 1000$ month take it all out for real estate investments

What if I am the grandchild and co-owner with decease (on their real estate property) who has two surviving heirs? I pretty much know all information about bills, assets, etc.
How does one file in order to get appointed as Administrator? (Decease did not have a will)
Edited:Thanks, very informative video as well.

I parents owned a co-op but my dad wasn’t able to put my mom an the stock certificate, but they were married and lived together for over 50 years. After his death mom and I were both appointed by the court as administrators. Prior to her death she wrote a will apointing me as her soul heir of her of the estate/co-op. Should the co-op haven transferred to my mom once my dad passed way as his wife? I have siblings whom all have signed a waiver appointing me by administrator. Can I get a loan for repairs as an administrator?

What if the administrator has gone on a drunken bender and is not doing anything? We're waiting for him to take care of tax clearance, give us accounting, etc. But he's doing NOTHING

That’s a very good question! My brother wanted to be appointed administrator for my brother who passed away and my mother signed a renunciation letter but I had questions and he got mad at me and won’t speak to me for the past week. What kind of administrator would that be?
