  • @MeganRyder
    @MeganRyder ปีที่แล้ว +9

    I'm continuosly stunned by the driving laws in the USA, In the UK your insurance is invalid if you don't have a valid license. If you don't have valid insurance, it's an instant tow, and if found guilty your car is crushed. In Oct 2022, 64,682 cars had been crushed that year.

    • @I_Evo
      @I_Evo ปีที่แล้ว +1

      First off you won't be able to get insurance without a licence here in the UK. You're partly correct about what happens if you lose your licence and you're foolish enough to carry on driving, your vehicle won't be covered by any insurance you've previously taken out but the insurers are still likely to pay any third party claims and then come to you for the money. I believe the situation is very similar in the States.
      If you've watched enough Judge Middleton you'll know the situation re towing of vehicles (and the high cost of getting your vehicle released) is also very similar, but can depend on local ordinances. And no your vehicle isn't automatically crushed here if found guilty of having no insurance. Most caught with no insurance get the vehicle insured, pay the towing and storage charge and get their vehicles back in a day or two. Those vehicles that are crushed are the old nails that aren't worth paying to get released, again very similar to Michigan at least.
      The big difference here is that things like no insurance, no licence, speeding, plate offences etc. are mostly dealt with administrativly as fixed penalties through the mail rather than going to court. Stopped (or flashed), letter in the mail, pay the fine, have your licence endorsed and that's it unless for instance the offence is really serious, you want to plead not guilty or you're in danger of getting disqualified then you may get a day in court.

    • @MeganRyder
      @MeganRyder ปีที่แล้ว

      @@I_Evo Apparently I stand corrected. I have watched alot of Judge Middleton and have never heard the mention of the possibilty of car destruction. Also, most of the stops I have watched are exactly like the 'old nails' that get crushed.

    • @I_Evo
      @I_Evo ปีที่แล้ว +1

      @@MeganRyder If you don't pay the release fee and storage charges (and it's not worth auctioning off) then it will eventually be forfeited and scrapped, whichever side of the pond you are on. Does anyone know how much an hour our courts cost the taxpayers including all overhead [electric, water, insurance, etc.]? The same question about the police and jails.
    Because it is time people be made to pay the entire cost when found guilty. I am sick of the little nothing fines that in no way cover what it costs. Same with prisons, let's make the inmate pay the cost of imprisoning them. Why should the taxpayers have to pay for all of this.

      These types of sovcits are so deep in that he probably truly believes that the video will prove that he's innocent and it was in fact the police who broke the law, and he fully expects the police to be arrested in violation of the constitution. You'd think he'd realize by now how its going to turn out, but every time they reach a brick wall such as Judge Middleton denying that their claims have any validity - they just rationalize it as that particular person must be either deluded, ignorant, or knows the truth and is lying. The possibility that maybe, just maybe, THEY are wrong, rather than everyone else, is never considered. If they had the ability to consider that, they'd never have become Sovcits.

  • @TheUluxian

    Right off the bat..UCC 1-308 is commercial code governing contracts. Has nothing to do with criminal court proceedings..🤦 Why is it they always say "they're not involved in commerce", yet continually cite Commercial laws as a defense?
    If that's your opening line..(to quote South Park),
    "You're gonna have a bad time.".

    • @aliquot8404
      @aliquot8404 7 หลายเดือนก่อน

      Q: Why do they cite commercial law?
      Short answers:
      ° They want to do crime & not pay.
      ° They are a mixture of downright delusional and deliberately dense.
      ° They are scofflaws - selfish, shortsighted, stubborn, & stupid.
      °°°°°°°°°°°°°°°°°°°°°°°°°°°°°
      Longer answer:
      They are reality deniers arguing that their crimes be tried in an imaginary court in which THEY create and / or define the laws and rules that must be followed.
      They are narcissists who think they should get away with breaking laws that everyone else has to follow - laws that define a civilized community and ensure public safety. To this end, they try to transform criminal charges into minor infractions that incur no or low penalties.
      Many of them say "My Honor" instead of "Your Honor". I find it deliberately disrespectful. They appear to think they are in charge and deserve the honorific, rather than the actual Judge.
      °°°°°°°°°°°°′°°°°°°°°°°°°.
      In the Same Vein
      In addition to commercial law, maritime courts are referenced.
      Again, they try to change the rules to suit themselves. I see it more as a ploy to distract and downplay, or it may be a power play, like questioning jurisdiction. Might they literally believe they were operating a vessel on the high seas instead of a motorized vehicle on public roads financed by the very registration and license fees that they have avoided paying? Who knows?

    • @jeffhampton7405
      @jeffhampton7405 3 หลายเดือนก่อน

      There’s a complicated web of idiotic reasoning, but it kind of makes sense in the alternate universe where their beliefs are true.
      They cite the UCC because they believe that the US and states were replaced in the 19th century by private corporations. So the argument they’re putting forward is that you can’t be forced to enter a contract with a company against your will. Hence the UCC.
      The “not operating in commerce” thing comes from two places.
      One is 18 U.S.C. § 31, which defines a motor vehicle as something driven for commercial purposes since that’s required for federal jurisdiction. They say the federal definition trumps state statutes because of the supremacy clause, even though the federal statute specifies otherwise.
      The other source is the old edition of Black’s Law Dictionary that’s free online, which they think is binding on courts for some reason. In their definition of driver, it says that it’s one “employed in operating…” They’re reading that to mean someone making money instead of just someone engaged in the activity.

    DNR officers (Department of Natural Resources) in Michigan have the same powers of a State Trooper, but they focus on poachers and fishing without a license type things. They also investigate people who get fish over the amount limit, fish that are undersize limit of length, and much more. Some work at places where fish are grown then let go into the big lakes, and many more small lakes. They stock the lakes and rivers to estimate amounts to stop overfishing. They also watch for people using gill nets who are not authorized, and people snagging.

    The judge and prosecutor do everything they can to get this resolved for him so he can get his license reinstated. The problem is that he does not understand what they are saying, yet, he thinks he can represent himself in a jury trial.
    English is my second language, I don't live in the USA and I'm not familiar with US law but even I understand what the judge and prosecutor are trying to do to help him resolve this matter. Even I understand what they are telling him. In a way I feel almost sorry for him, he doesn't seem to have the mental capacity to understand what is going on around him. These sovcit people pay unknown people on the internet who sell them an idea that they do not have to follow the law (that should in itself be a big red flag), get a fake license plate that will make them light up like a beacon of light to law enforcement and a fake "identification card", sometimes probably nothing more than a form they can themselves fill in and print out.
    These people should not be allowed to have a driver's license and they should be forced to have a guardian that makes important decisions for them as they, as shown, do not seem to have the mental capacity to do so by themselves. I'm not trying to be mean, I'm honestly worried for their wellbeing and their ability to function in a society.
