My service is ads, so thats a problem, because he didnt want to pay for the ads either. So to be honesy when selling ads as the service we technically cant refund them their money unless we say "we ll send you a complete refund of our service fee"

You could do a service based offer instead. Like if we don’t get you ROI for 120 days (4 months) then we will work completely for free till you do. You will not have to work for free if you are consistent. It’s like an offer to relieve from their shoulders when the 4 month no ROI offer won’t happen.
